K\u00fclt\u00fcr Sanat Hizmet Kolunda, sanat kurumlar\u0131nda \u00e7al\u0131\u015fan personel ile s\u00f6zle\u015fmeli personelin hizmet gere\u011fi gece 24.00\u2019den sonra yapaca\u011f\u0131 fiili fazla \u00e7al\u0131\u015fma kar\u015f\u0131l\u0131\u011f\u0131nda ayda 50 saati ge\u00e7memek \u00fczere fazla \u00e7al\u0131\u015fma \u00fccretinin 5 kat\u0131 tutar\u0131nda fazla \u00e7al\u0131\u015fma \u00fccreti \u00f6denece\u011fi, Devlet Opera ve Balesindeki opera sanat\u00e7\u0131lar\u0131 ile G\u00fczel Sanatlara ba\u011fl\u0131 Orkestra, Koro ve Topluluklarda \u00e7al\u0131\u015fan sanat\u00e7\u0131lara hizmetin gere\u011fi olarak g\u00f6rev esnas\u0131nda giymesi gereken k\u0131yafetlerin her y\u0131l eyl\u00fcl ay\u0131nda kurumca verilmesi, ta\u015f\u0131n\u0131r kay\u0131t kontrol yetkililerinin mali sorumluluk zamm\u0131n\u0131n artt\u0131r\u0131lmas\u0131, burs alan ve devlet\u00e7e okutulan \u00e7ocuklar i\u00e7in aile yard\u0131m\u0131 \u00f6dene\u011fi verilmesi konusunda Kamu i\u015fveren heyeti ile uzla\u015fmaya var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: left;\">Bunun d\u0131\u015f\u0131nda kalan konulardan, M\u00fcze Ara\u015ft\u0131rmac\u0131s\u0131, Ar\u015fivci, Folklor Ara\u015ft\u0131rmac\u0131s\u0131 , K\u00fct\u00fcphaneci , Kitap Patalo\u011fu ve Sosyolog unvanl\u0131 kadrolarda bulunan personelin \u00f6zel hizmet tazminatlar\u0131n\u0131n \u00f6zel hizmet tazminat cetvelinin E b\u00f6l\u00fcm\u00fcn\u00fcn\u00a0 birinci s\u0131ras\u0131n\u0131n d bendinde \u00f6ng\u00f6r\u00fclen tazminat ve ek tazminat oranlar\u0131n\u0131n \u00f6denmesi konusunda anla\u015fmazl\u0131k ya\u015fanm\u0131\u015ft\u0131r. Kamu i\u015fvereni d bendine g\u00f6re \u00f6zel hizmet tazminat\u0131 verilmesini \u00f6nermi\u015f, sendikam\u0131z K\u00fclt\u00fcr Sanat-Sen \u0131srarla c bendine g\u00f6re tazminat\u0131n \u00f6denmesi gerekti\u011fini belirtmi\u015ftir. ( Kamu \u0130\u015fvereni 1.dereceli kadro i\u00e7in\u00a0 %100 \u00fczerinden, sendikam\u0131z %130 oran\u0131 \u00fczerinden \u00f6zel hizmet tazminat\u0131 \u00f6denmesi gerekti\u011fini belirtmi\u015ftir.) Bu konuda anla\u015f\u0131lamad\u0131\u011f\u0131 halde bu madde tutana\u011fa yazd\u0131r\u0131lm\u0131\u015f ve Kamu G\u00f6revlileri Hakem Kuruluna\u00a0 gidecek maddeler i\u00e7erisinde de\u011ferlendirilmi\u015ftir. <strong><span style=\"text-decoration: underline;\">Bu konu sadece k\u00fclt\u00fcr ve sanat hizmet kolunda tart\u0131\u015f\u0131lm\u0131\u015ft\u0131r.<\/span><\/strong> Elde edilecek her t\u00fcrl\u00fc kazan\u0131m sendikam\u0131z\u0131n kazan\u0131m\u0131 olacakt\u0131r. Toplu S\u00f6zle\u015fme G\u00f6r\u00fc\u015fmeleri devam ederken K\u00fclt\u00fcr Sanat Sen\u2019in \u0131srarl\u0131 iste\u011fi \u00fczerine K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131 m\u00fcste\u015far\u0131 Say\u0131n \u00d6zg\u00fcr \u00d6ZARSLAN, Personel Daire Ba\u015fkan\u0131 Say\u0131n Ahmet YILMAZ g\u00f6r\u00fc\u015fme heyetine sendikam\u0131z\u0131n talepleri ve Bakanl\u0131k \u00e7al\u0131\u015fmalar\u0131 hakk\u0131nda bilgi vermi\u015ftir. Say\u0131n \u00d6ZARSLAN\u2019\u0131n verdi\u011fi bilgiye g\u00f6re; sanat\u00e7\u0131lar\u0131n \u00fccretleri ve emeklilik durumlar\u0131 ile ilgili yeni bir yasa tasar\u0131s\u0131 haz\u0131rlanmakta oldu\u011fu belirtilmi\u015f,\u00a0 \u00e7e\u015fitli di\u011fer konularla ilgili yap\u0131lacak yasa tasar\u0131s\u0131nda sendikan\u0131n taleplerine uygun olarak gerekli de\u011fi\u015fikliklerin yap\u0131laca\u011f\u0131 belirtilmi\u015ftir. Verilen bilgilerden de anla\u015f\u0131laca\u011f\u0131 gibi sendikam\u0131z\u0131n talepleri Bakanl\u0131k\u00e7a da desteklenmi\u015ftir. Ayr\u0131ca sadece K\u00fclt\u00fcr ve Sanat Hizmet Kolu talepleri g\u00f6r\u00fc\u015f\u00fcl\u00fcrken ilgili Bakanl\u0131k yetkilisi gelip bilgi<br \/>\nvermi\u015ftir. Di\u011fer hizmet kollar\u0131nda b\u00f6yle bir durum ya\u015fanmam\u0131\u015ft\u0131r. Toplu S\u00f6zle\u015fme g\u00f6r\u00fc\u015fmelerinde misafir sanat\u00e7\u0131lar\u0131n yani s\u00fcreli s\u00f6zle\u015fmeli sanat\u00e7\u0131lar\u0131n sendika \u00fcyeli\u011fi konusu \u0131srarla dile getirilmi\u015f olup, Devlet Personel Ba\u015fkanl\u0131\u011f\u0131n\u0131n yeni bir g\u00f6r\u00fc\u015f vermesi konusunda s\u00f6zl\u00fc mutabakata var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: left;\">G\u00f6r\u00fc\u015fmeler esnas\u0131nda Enformasyon Memuru kadrosunda bulunanlar\u0131n kadro unvanlar\u0131n\u0131n Turizm ara\u015ft\u0131rmac\u0131s\u0131 kadrosu olarak d\u00fczeltilmesi talebi konusunda da olumlu cevap al\u0131nm\u0131\u015f olup, bu konuda en k\u0131sa zamanda kanun de\u011fi\u015fikli\u011fi yap\u0131laca\u011f\u0131 bizzat Maliye Bakanl\u0131\u011f\u0131 m\u00fcste\u015far\u0131 \u00a0taraf\u0131ndan ifade edilmi\u015ftir.<\/p>\n<p style=\"text-align: left;\">\u00dczerinde uzla\u015f\u0131lamayan hizmet kolumuza \u00f6zg\u00fc mali ve sosyal haklardan a\u015fa\u011f\u0131da belirtilenler de kamu hakem heyetine g\u00f6t\u00fcr\u00fclecektir.<\/p>\n<p style=\"text-align: left;\">1-\u00a0\u00a0\u00a0\u00a0\u00a0 657 say\u0131l\u0131 kanunun ek ge\u00e7ici 16. Maddesi kapsam\u0131ndaki orkestra, koro ve topluluk sanat\u00e7\u0131lar\u0131, sanatkarlar\u0131 ve sanat\u00e7\u0131 \u00f6\u011fretmenleri ile Devlet sanat\u00e7\u0131lar\u0131n\u0131n yani idari s\u00f6zle\u015fmeli sanat\u00e7\u0131lar\u0131n \u00fccretlerinin genel \u00fccret art\u0131\u015f\u0131ndan ayr\u0131 olarak %20 oran\u0131nda artt\u0131r\u0131lmas\u0131<\/p>\n<p style=\"text-align: left;\">2-\u00a0\u00a0\u00a0\u00a0Arkeolog, M\u00fcze Ara\u015ft\u0131rmac\u0131s\u0131, K\u00fct\u00fcphaneci, Kitap Patalo\u011fu ve Folklor Ara\u015ft\u0131rmac\u0131lar\u0131n\u0131n ek g\u00f6stergelerinin 3600 \u2018e y\u00fckseltilmesi<\/p>\n<p style=\"text-align: left;\">3-\u00a0\u00a0\u00a0\u00a0G\u00fczel sanatlar genel m\u00fcd\u00fcrl\u00fc\u011f\u00fcne ba\u011fl\u0131 orkestra koro ve topluluk m\u00fcd\u00fcrl\u00fcklerine ba\u011fl\u0131 olarak \u00e7al\u0131\u015fan\u00a0 t\u00fcm personelin harc\u0131rah kanununun33. Maddesinin C f\u0131kras\u0131 h\u00fckm\u00fcn\u00fcn uygulanmas\u0131<\/p>\n<p style=\"text-align: left;\">4-\u00a0\u00a0\u00a0\u00a0Enformasyon memuru kadrosunda \u00e7al\u0131\u015fan personelin kadro unvan\u0131n\u0131n Turizm Ara\u015ft\u0131rmac\u0131s\u0131 olarak de\u011fi\u015ftirilmesi<\/p>\n<p style=\"text-align: left;\">5-\u00a0\u00a0\u00a0\u00a0\u00a0 2182 say\u0131l\u0131 kanun veya 458 say\u0131l\u0131 KHK h\u00fck\u00fcmlerinden yararlanamayan personele , 657 say\u0131l\u0131 kanunun 37 ve 64 \u00fcnc\u00fc maddelerinden yarg\u0131 karar\u0131yla yararlananlar d\u0131\u015f\u0131nda kalan t\u00fcm idari s\u00f6zle\u015fmeli sanatkarlar ile ek ge\u00e7ici 12. Maddenin (D) f\u0131kras\u0131 kapsam\u0131nda de\u011ferlendirilen idari s\u00f6zle\u015fmeli personele kesene\u011fe esas intibaklar\u0131nda derece ve kademe verilmesi<\/p>\n<p style=\"text-align: left;\">6-\u00a0\u00a0\u00a0\u00a0\u00a0 657 say\u0131l\u0131 Kanunun ek ge\u00e7ici 16 \u0131nc\u0131 maddesinde yer alan ek g\u00f6sterge d\u00fczenlemesinin sanat ve sahne uygulat\u0131c\u0131lar\u0131 pozisyonunda de\u011ferlendirilen idari s\u00f6zle\u015fmeli personele de uygulanmas\u0131<\/p>\n<p style=\"text-align: left;\">7-\u00a0\u00a0\u00a0\u00a0Mesleki ya\u015f\u0131 s\u0131n\u0131rl\u0131 olan \u0130dari S\u00f6zle\u015fmeli Bale ve Dans sanat\u00e7\u0131lar\u0131na fiili hizmet s\u00fcresi zamm\u0131n\u0131n y\u0131lda 120 g\u00fcn olarak verilmesi,<\/p>\n<p style=\"text-align: left;\">Konular\u0131 ile yukar\u0131da belirtti\u011fimiz \u00f6zel hizmet tazminat\u0131 konusu Kamu G\u00f6revlileri Hakem Kurulunda \u00a0\u00a0g\u00f6r\u00fc\u015f\u00fclecektir. \u00dczerinde g\u00f6r\u00fc\u015fme yap\u0131lmas\u0131nda uzla\u015f\u0131lan ancak dan\u0131\u015fma kurulunda g\u00f6r\u00fc\u015f\u00fclerek sonu\u00e7land\u0131r\u0131lmas\u0131nda mutabakata var\u0131lan \u00a0hususlar ile ilgili olarak KESK ve K\u00fclt\u00fcr Sanat-Sen \u015ferhli olarak tutana\u011f\u0131 imzalam\u0131\u015ft\u0131r. \u015eerhimizde bu konular\u0131n Toplu S\u00f6zle\u015fme masas\u0131nda g\u00f6r\u00fc\u015f\u00fcl\u00fcp, karara ba\u011flanmas\u0131 gerekti\u011fi ifade edilmi\u015ftir. Dolay\u0131s\u0131yla sendikam\u0131z bu taleplerin mali ve sosyal haklarla olan ili\u015fkisi nedeniyle toplu s\u00f6zle\u015fmenin konusu dahilinde sonu\u00e7land\u0131r\u0131lmas\u0131n\u0131 savunmaktad\u0131r.
