Bu hak ilk ba\u015fta olumlu bir geli\u015fme olarak de\u011ferlendirilse bile grev hakk\u0131n\u0131 i\u00e7ermemektedir. Anayasaya g\u00f6re toplu s\u00f6zle\u015fme yap\u0131lmas\u0131 s\u0131ras\u0131nda uyu\u015fmazl\u0131k \u00e7\u0131kmas\u0131 halinde taraflar Kamu G\u00f6revlileri Hakem Kuruluna (KGHK) ba\u015fvurabilecekler ve\u00a0 KGHK kararlar\u0131 kesin ve ba\u011flay\u0131c\u0131 olacakt\u0131r. Ola\u011fan \u201cuyu\u015fmazl\u0131k, arabulucuk ve grev\u201d mekanizmas\u0131 burada i\u015fletilmemektedir. Anayasa \u00f6zg\u00fcr toplu pazarl\u0131k de\u011fil t\u00fcm kamu g\u00f6revlilerini kapsayan genel bir grev yasa\u011f\u0131 anlam\u0131na gelen zorunlu tahkimi benimsemi\u015ftir.<br \/>\n<!--more-->Bilindi\u011fi gibi en temel haklardan olan sendika hakk\u0131 ile grev ve toplu pazarl\u0131k haklar\u0131 bir b\u00fct\u00fcn\u00a0 olu\u015ftururlar ve birbirinden ba\u011f\u0131ms\u0131z d\u00fc\u015f\u00fcnelemezler. Grev hakk\u0131n\u0131 i\u00e7ermeyen bir d\u00fczenleme kabul edilmemelidir.<br \/>\n2- ULUSLARARASI HUKUKUN ULUSAL HUKUKA \u00dcST\u00dcNL\u00dc\u011e\u00dc VE ANAYASA 90. MADDE SON FIKRA<br \/>\nUluslararas\u0131 s\u00f6zle\u015fmelerin T\u00fcrkiye\u2019nin i\u00e7 hukuk ile ili\u015fkisini d\u00fczenleyen Anayasan\u0131n 90. maddesi, usulune g\u00f6re onaylanm\u0131\u015f uluslararas\u0131 s\u00f6zle\u015fmeleri kanun h\u00fckm\u00fcnde kabul etmi\u015f ve bunlara kar\u015f\u0131 Anayasaya ayk\u0131r\u0131l\u0131k iddias\u0131 ile Anayasa Mahkemesine ba\u015fvurulamayaca\u011f\u0131n\u0131 h\u00fckme ba\u011flam\u0131\u015ft\u0131r.\u00a0 Ayr\u0131ca 90. Maddenin son f\u0131kras\u0131na 2004 y\u0131l\u0131nda eklenen yeni c\u00fcmle\u00a0 usulune g\u00f6re onaylanm\u0131\u015f temel hak ve \u00f6zg\u00fcrl\u00fcklere ili\u015fkin s\u00f6zle\u015fmelerle kanunlar\u0131n ayn\u0131 konuda farkl\u0131 h\u00fck\u00fcmler i\u00e7ermesi nedeniyle \u00e7\u0131kabilecek uyu\u015fmazl\u0131klarda uluslararas\u0131 s\u00f6zle\u015fmelerin esas al\u0131nmas\u0131n\u0131 hi\u00e7 bir tart\u0131\u015fmaya yer vermeyecek netlikte ortaya koymu\u015ftur.<br \/>\nAnayasa 11. madde \u201c Anayasa h\u00fck\u00fcmleri, yasama, y\u00fcr\u00fctme ve yarg\u0131 organlar\u0131n\u0131, idare makamlar\u0131n\u0131 ve di\u011fer kurulu\u015f ve ki\u015fileri ba\u011flayan temel hukuk kurallar\u0131d\u0131r\u201d\u00a0 demektedir. Dolay\u0131s\u0131 ile 90. madde son f\u0131kra h\u00fckm\u00fc, ku\u015fkuya yer vermeyecek \u015fekilde ba\u011flay\u0131c\u0131 niteliktedir. Bu noktadan hareketle ILO\u2019nun 87, 98 ve 151 no\u2019lu s\u00f6zle\u015fmeleri ulusal hukuktan \u00fcst\u00fcnd\u00fcr.<br \/>\nHer ne kadar 87 say\u0131l\u0131 s\u00f6zle\u015fmenin s\u00f6zel metninde grevden bahsedilmemi\u015f olsa bile ILO\u2019nun Sendika \u00d6zg\u00fcrl\u00fc\u011f\u00fc Komitesi (S\u00d6K), yerle\u015fik ve istikrarl\u0131 kararlar\u0131nda 87 say\u0131l\u0131 s\u00f6zle\u015fmenin di\u011fer \u00e7al\u0131\u015fanlar yan\u0131nda kamu g\u00f6revlileri i\u00e7in de grev hakk\u0131n\u0131 g\u00fcvenceye ald\u0131\u011f\u0131n\u0131 kabul etmi\u015ftir. Yine \u0130nsan Haklar\u0131 Avrupa S\u00f6zle\u015fmesi (\u0130HAS)\u2019\u0131n 11. maddesinde toplu s\u00f6zle\u015fme ve grev hakk\u0131ndan s\u00f6z edilmemesine ra\u011fmen \u0130nsan Haklar\u0131 Avrupa Mahkemesi ( \u0130HAM)\u2019n\u0131n 2000\u2019li y\u0131llardan itibaren istikrar kazanan kararlar\u0131 ile toplu s\u00f6zle\u015fme ve grev hakk\u0131 11. maddenin g\u00fcvencesi alt\u0131ndad\u0131r. Bu nedenle kamu g\u00f6revlileri kapsayan genel bir grev yasa\u011f\u0131 ILO ve Avrupa Konseyi mevzuat\u0131na ayk\u0131r\u0131l\u0131k ta\u015f\u0131maktad\u0131r.<br \/>\nUluslararas\u0131 s\u00f6zle\u015fmelerin do\u011frudan uygulanamamas\u0131n\u0131n en \u00f6nemli gerek\u00e7esi olarak soyut ve genel olmalar\u0131 ileri s\u00fcr\u00fclse bile ILO\u2019nun 87 ve 98 no\u2019lu s\u00f6zle\u015fmeleri, ILO\u2019nun denetim organlar\u0131 kararlar\u0131 ile ete kemi\u011fe b\u00fcr\u00fcnm\u00fc\u015ft\u00fcr ve birbirinden ayr\u0131 d\u00fc\u015f\u00fcn\u00fclemez.\u00a0 \u0130HAM i\u00e7tihatlar\u0131 da uygulamay\u0131 kolayla\u015ft\u0131r\u0131c\u0131 niteliktedir.<br \/>\n3- 4688 SAYILI KAMU G\u00d6REVL\u0130LER\u0130 SEND\u0130KALARI KANUNUNDA DE\u011e\u0130\u015e\u0130KL\u0130K YAPILMASINA \u0130L\u0130\u015eK\u0130N KANUN TASARISI TASLA\u011eI HAKKINDA DE\u011eERLEND\u0130RME VE \u00d6NER\u0130LER<br \/>\nAnayasa ile kamu emek\u00e7ilerine verilen toplu s\u00f6zle\u015fme hakk\u0131 ile ilgili olarak aradan on ay ge\u00e7mi\u015f olmas\u0131na ra\u011fmen hen\u00fcz yasal d\u00fczenlemeler yap\u0131lmam\u0131\u015ft\u0131r. H\u00fck\u00fcmet\u00a0 4688\u2019de de\u011fi\u015fiklikler yaparak toplu s\u00f6zle\u015fme uygulamas\u0131n\u0131 ba\u015flatmaya haz\u0131r de\u011fildir. \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakan\u0131 Faruk \u00c7elik\u2019in a\u00e7\u0131klamalar\u0131ndan anla\u015f\u0131ld\u0131\u011f\u0131 kadar\u0131 ile\u00a0 h\u00fck\u00fcmetin 15 A\u011fustos 2011 tarihi i\u00e7in toplu s\u00f6zle\u015fme de\u011fil, toplu g\u00f6r\u00fc\u015fme \u00e7a\u011fr\u0131s\u0131nda bulunaca\u011f\u0131\u00a0 kesinle\u015fmi\u015f gibidir. Bakan\u2019\u0131n \u201cmemurlarla ve toplu s\u00f6zle\u015fme ile ilgili Anayasa uyum yasas\u0131n\u0131 \u00e7\u0131karaca\u011f\u0131z bununla ilgili takvimin h\u0131zla i\u015flemesi i\u00e7in elimizden gelen gayreti g\u00f6steriyoruz\u201d a\u00e7\u0131klamas\u0131 ilgili yasal d\u00fczenlemenin tamamlanmad\u0131\u011f\u0131n\u0131 do\u011frulamaktad\u0131r. Yap\u0131lacak d\u00fczenlemelerin ans\u0131z\u0131n \u00e7\u0131kar\u0131labilecek bir KHK ile yap\u0131lmas\u0131 riski de bulunmaktad\u0131r. KHK de\u011fi\u015fikli\u011fi yerine, yeni bir yasa \u00e7\u0131kar\u0131lmal\u0131d\u0131r.<br \/>\nUyum yasalar\u0131n\u0131n halen \u00e7\u0131kmam\u0131\u015f olmas\u0131, bu konu ile ilgili g\u00f6z \u00f6n\u00fcnde bulundurulmas\u0131 gereken en \u00f6nemli noktalar olan T\u0130S\u2019in d\u00fczeyi, taraflar\u0131, kapsam\u0131, dayan\u0131\u015fma aidat\u0131 ve \u00f6zellikle uyu\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcm\u00fc temelinde KGHK\u2019n\u0131n yap\u0131s\u0131 ve tarafs\u0131zl\u0131\u011f\u0131na ili\u015fkin memur konfederasyonlar\u0131na, yasan\u0131n kendi talepleri do\u011frultusunda \u00e7\u0131kar\u0131lmas\u0131n\u0131n sa\u011flanmas\u0131 konusunda bir olanak sunabilir. Bu olana\u011f\u0131n konfederasyonlar taraf\u0131ndan birlikte de\u011ferlendirilerek ortak bir kar\u015f\u0131 duru\u015fun sa\u011flanmas\u0131nda ve taleplerin ortakla\u015ft\u0131r\u0131lmas\u0131nda\u00a0 birlikte hareket etmek \u00f6nemlidir. Bu s\u00fcre\u00e7te birlikte hareket etmek konusunda g\u00f6sterilecek kararl\u0131l\u0131k Y\u00fcksek \u0130dari Kurul\u2019da al\u0131nan \u201ctoplu g\u00f6r\u00fc\u015fme de\u011fil, toplu s\u00f6zle\u015fme\u201d karar\u0131n\u0131n da arkas\u0131nda durmak olacakt\u0131r.\u00a0 Bu do\u011frultuda bu tarihe kadar toplu g\u00f6r\u00fc\u015fme masas\u0131na sendikam\u0131z yetkisi \u00fczerinden oturan konfederasyonumuz KESK \u00f6nc\u00fcl\u00fc\u011f\u00fcnde Kamu- Sen ve Memur-Sen\u2019e yap\u0131lacak bir \u00e7a\u011fr\u0131n\u0131n gerekli oldu\u011funu d\u00fc\u015f\u00fcn\u00fcyoruz.<br \/>\nDi\u011fer yandan Anayasa de\u011fi\u015fikli\u011fine ra\u011fmen kamu emek\u00e7ileri konfederasyonlar\u0131n\u0131n uyum yasalar\u0131 \u00e7\u0131kart\u0131lmayarak, toplu s\u00f6zle\u015fme yerine tekrar toplu g\u00f6r\u00fc\u015fme masas\u0131na \u00e7a\u011fr\u0131lmak suretiyle oyalanm\u0131\u015f olmalar\u0131 kar\u015f\u0131s\u0131nda nas\u0131l bir tav\u0131r al\u0131naca\u011f\u0131 konusu, ortak hareket etme temelinde \u00f6nem arzeden di\u011fer bir konudur. Toplu s\u00f6zle\u015fme taraflar\u0131n\u0131n Kamu \u0130\u015fveren Heyeti ile Kamu G\u00f6revlileri Heyeti olaca\u011f\u0131 taslakta belirtildi\u011fine g\u00f6re ve Kamu G\u00f6revlileri Heyeti 3 konfederasyon ba\u015fkanlar\u0131ndan olu\u015faca\u011f\u0131na g\u00f6re Anayasa\u2019ya ra\u011fmen 15 A\u011fustos\u2019ta tekrar toplu g\u00f6r\u00fc\u015fme masas\u0131na gidilip gidilmeyece\u011fi konusu netlik kazanmal\u0131d\u0131r. Bu do\u011frultuda 3 konfederasyon birlikte hareket etmelidir. Toplu g\u00f6r\u00fc\u015fme masas\u0131na, toplu g\u00f6r\u00fc\u015fme yapmak amac\u0131yla de\u011fil toplu s\u00f6zle\u015fme prosed\u00fcr\u00fcn\u00fcn \u015fartlar\u0131n\u0131 konu\u015fmak amac\u0131yla gidilmelidir. Toplu s\u00f6zle\u015fme s\u00fcrecinde ise\u00a0 taleplerin ortakla\u015ft\u0131r\u0131lmas\u0131 temelinde 3 konfederasyon olu\u015fturacaklar\u0131 bir ara\u015ft\u0131rma komisyonu \u00fczerinden ortak bir duru\u015f sergilemelidir.<br \/>\nYap\u0131lacak d\u00fczenlemenin i\u00e7eri\u011fi tam olarak bilinmesede kesin olan KGHK karar\u0131n\u0131n ba\u011flay\u0131c\u0131 oldu\u011fu ve grev hakk\u0131n\u0131n engellenece\u011fidir. Toplu \u0130\u015f S\u00f6zle\u015fmesinin d\u00fczeyi ve prosed\u00fcr\u00fc ve s\u00f6zle\u015fmeden kimlerin faydalanaca\u011f\u0131 belli de\u011fildir.<br \/>\nBu s\u00fcre\u00e7te g\u00f6z \u00f6n\u00fcnde bulundurulmas\u0131 gereken en \u00f6nemli noktalar olan T\u0130S\u2019in d\u00fczeyine, taraflar\u0131na, kapsam\u0131na, dayan\u0131\u015fma aidat\u0131na\u00a0 ve \u00f6zellikle\u00a0 uyu\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcm\u00fc temelinde KGHK\u2019ya ili\u015fkin olarak \u00f6nerilerimiz a\u015fa\u011f\u0131daki gibidir:<br \/>\n1- \u00c7o\u011fulcu bir T\u0130S d\u00fczeni olu\u015fturulmal\u0131d\u0131r. Kamu emek\u00e7ilerinin tamam\u0131n\u0131 ilgilendiren haklarla ilgili konularda Kamu \u0130\u015fveren Heyeti ile Kamu G\u00f6revlileri Heyeti aras\u0131nda genel bir\u00a0 T\u0130S imzalanmal\u0131d\u0131r. Di\u011fer yandan kurulu bulundu\u011fu hizmet kolunda en \u00e7ok \u00fcye say\u0131s\u0131na sahip sendikan\u0131n, \u00e7al\u0131\u015fanlar\u0131n g\u00f6rev yapt\u0131klar\u0131 kamu kurumu ile ayr\u0131 T\u0130S yapabilme yetkisi olmal\u0131d\u0131r. Ayr\u0131ca i\u015fyeri ve kurum d\u00fczeyinde de toplu i\u015f s\u00f6zle\u015fmelerine olanak tan\u0131nmal\u0131d\u0131r.<br \/>\n2- \u00dclke d\u00fczeyinde T\u0130S i\u00e7in taslakta ifade edildi\u011fi \u015fekliyle\u00a0\u00a0 Kamu \u0130\u015fveren Heyeti ile Kamu G\u00f6revlileri Heyeti \u015fu ki\u015filerden olu\u015facakt\u0131r: \u201cKamu \u0130\u015fveren Heyeti, Ba\u015fbakanl\u0131k M\u00fcste\u015far\u0131 veya g\u00f6revlendirece\u011fi bir M\u00fcste\u015far yard\u0131mc\u0131s\u0131n\u0131n ba\u015fkanl\u0131\u011f\u0131nda Maliye Bakanl\u0131\u011f\u0131 B\u00fct\u00e7e ve Mali Kontrol Genel M\u00fcd\u00fcr\u00fc, Devlet Personel Ba\u015fkan Yard\u0131mc\u0131s\u0131 ve Sosyal G\u00fcvenlik Kurumu Sigorta \u0130\u015fleri Genel M\u00fcd\u00fcr\u00fcnden olu\u015facakt\u0131r.\u00a0 Kamu G\u00f6revlileri Heyeti ise ba\u011fl\u0131 sendikalar\u0131n \u00fcye say\u0131s\u0131 itibariyle en \u00e7ok \u00fcyeye sahip \u00fc\u00e7 konfederasyonun birer temsilcisinden olu\u015fur. Heyetin ba\u015fkan\u0131 en \u00e7ok \u00fcyeye sahip konfederasyonun temsilcisidir.\u00a0 Kamu i\u015fverenleri ad\u0131na Kamu \u0130\u015fveren Heyeti Ba\u015fkan\u0131n\u0131n belirleyece\u011fi kurum temsilcileri ile kamu g\u00f6revlileri ad\u0131na her bir hizmet kolunda yetkili sendika ba\u015fkanlar\u0131 toplu s\u00f6zle\u015fme g\u00f6r\u00fc\u015fmelerine teknik heyet olarak i\u015ftirak edeceklerdir.\u201d Bu d\u00fczenleme taraflara e\u015fit ko\u015fullarda pazarl\u0131k hakk\u0131 tan\u0131mamaktad\u0131r. \u0130\u015fveren heyetinde 4 ki\u015fiye kar\u015f\u0131l\u0131k Kamu G\u00f6revlileri hayetinde 3 ki\u015fi bulunmaktad\u0131r. Teknik heyetin i\u015flevi belli olmad\u0131\u011f\u0131ndan her bir\u00a0 hizmet kolunda yetkili sendika ba\u015fkanlar\u0131\u00a0 teknik heyette de\u011fil Kamu G\u00f6revlileri Hayeti\u2019nde yer almal\u0131d\u0131r. Yani Kamu G\u00f6revlileri Heyeti 3 konfederasyonun birer temsilcileri ile\u00a0 her bir hizmet kolunda yetkili sendika ba\u015fkanlar\u0131ndan olu\u015fturulacak \u015fekilde kapsam\u0131 geni\u015fletilmelidir. Hizmet kolu d\u00fczeyindeki T\u0130S, ilgili sendika ve ilgili kurum veya kurulu\u015f aras\u0131nda yap\u0131lmal\u0131d\u0131r.<br \/>\n3- Toplu \u0130\u015f S\u00f6zle\u015fmesine konu olacak h\u00fck\u00fcmler \u00e7al\u0131\u015fanlar\u0131n mali ve sosyal haklar\u0131n\u0131n yan\u0131 s\u0131ra, \u00e7al\u0131\u015fma ya\u015fam\u0131n\u0131 ilgilendiren t\u00fcm konular\u0131 kapsamal\u0131d\u0131r.<br \/>\n4- Dayan\u0131\u015fma aidat\u0131, sendika \u00fcyesi olmayanlar\u0131n da T\u0130S\u2019ten yararlanmas\u0131na olanak tan\u0131mas\u0131na ra\u011fmen sendikal \u00f6rg\u00fctlenmeyi zay\u0131flatan bir uygulamad\u0131r. B\u00f6yle bir d\u00fczenlemeye yasada yer verilmemeli, bu d\u00fczenleme T\u0130S h\u00fckm\u00fc olmak \u00fczere sonraya b\u0131rak\u0131lmal\u0131d\u0131r.<br \/>\n5- Kamu G\u00f6revlileri Hakem Kurulunun Yap\u0131s\u0131na \u0130li\u015fkin Bakanl\u0131k \u00d6nerileri ve Sendikam\u0131z\u0131n \u00d6nerileri<br \/>\nUyu\u015fmazl\u0131k durumunda nihai karar\u0131n KGHK\u2019ya ait olaca\u011f\u0131 ve karar\u0131n ba\u011flay\u0131c\u0131 olaca\u011f\u0131 Anayasa\u2019n\u0131n 53. maddesinde ifade edilmi\u015ftir. KGHK\u2019n\u0131n karar\u0131n\u0131 T\u0130S metni sayan h\u00fck\u00fcm Anayasa\u2019n\u0131n 90. maddesi uyar\u0131nca i\u00e7 hukukun bir par\u00e7as\u0131 haline gelen temel hak ve \u00f6zg\u00fcrl\u00fcklere ili\u015fkin\u00a0 87, 98 ve 151 say\u0131l\u0131 ILO s\u00f6zle\u015fmeleri, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi\u2019nin 10. maddesi uyar\u0131nca\u00a0 verilen kararlar ayk\u0131r\u0131l\u0131k olu\u015fturdu\u011fundan KGHK\u2019ya b\u00f6yle bir yetki verilmemelidir. Ancak bu engellenemiyor ise yap\u0131lacak d\u00fczenlemede\u00a0 KGHK\u2019n\u0131n ba\u011f\u0131ms\u0131z ve tarafs\u0131z nitelikte olmas\u0131 \u00f6nemlidir ve taraflar e\u015fit say\u0131da temsil edilmelidir. Bakanl\u0131k \u00f6nerisine g\u00f6re KGHK, 7\u2019si h\u00fck\u00fcmet\u00a0 3\u2019\u00fc memur konfederasyonu temsilcilerinden olmak \u00fczere toplam 10 \u00fcyeden olu\u015facakt\u0131r. Yani kamu g\u00f6revlilerini temsilen Kurul\u2019da yaln\u0131zca 3 \u00fcye olacakt\u0131r. Yasada T\u0130S s\u00fcrecinde grev ve toplu eylem hakk\u0131n\u0131n kullan\u0131m\u0131n\u0131 s\u0131n\u0131rlayacak bir d\u00fczenlemeye yer verilmemelidir. G\u00f6r\u00fc\u015fmeler s\u0131ras\u0131nda \u00e7\u0131kabilecek anla\u015fmazl\u0131klar kar\u015f\u0131s\u0131nda g\u00f6r\u00fc\u015fme masas\u0131n\u0131n terk edilmeyerek taleplerimiz do\u011frultusunda kararl\u0131 ve kesin bir duru\u015f i\u00e7inde olunmas\u0131 gerekmektedir ve bu duru\u015ftan taviz verilmemelidir. KGHK karar\u0131na kadar T\u0130S s\u00fcrecinde grev ve toplu eylem hakk\u0131 kullan\u0131lmal\u0131d\u0131r.<br \/>\nAncak,\u00a0 KESK 4. Ola\u011fan Genel Kurulu\u2019nda uzla\u015fmazl\u0131k durumunda grev \u00f6rg\u00fctleme, en \u00fcst organ olan Genel Kurul\u2019un g\u00f6revi say\u0131lmam\u0131\u015f, grev reddedilerek, bunu yine \u201cikili ittifak\u201d \u00fczerinden olu\u015fturulan KESK Genel Meclisi\u2019nin de\u011ferlendirece\u011fi s\u00f6ylenmi\u015ftir.<br \/>\nKESK, i\u015f\u00e7i ve emek\u00e7i s\u0131n\u0131flar\u0131n \u00e7\u0131karlar\u0131n\u0131 korumak ve haklar\u0131n\u0131 elde edebilmek i\u00e7in sahip olmalar\u0131 gereken m\u00fccadele ara\u00e7lar\u0131ndan en \u00f6nemli ikisinin toplu s\u00f6zle\u015fme ve grev oldu\u011funun fark\u0131ndal\u0131\u011f\u0131 ve bilinci ile fiili ve me\u015fru m\u00fccadele \u00e7izgisini, bu u\u011furda bedeller \u00f6deyerek kazanm\u0131\u015f bir m\u00fccadele \u00f6rg\u00fct\u00fcd\u00fcr. Toplu s\u00f6zle\u015fme ve grev; grev karar\u0131 al\u0131nmas\u0131na kar\u015f\u0131 \u00e7\u0131kan KESK delegelerinin de bildi\u011fi gibi, sendikay\u0131 sendika yapan en \u00f6nemli \u00f6gelerdir ve birbirlerinin tamamlay\u0131c\u0131s\u0131d\u0131r. Grevler s\u0131n\u0131f m\u00fccadelesinin en g\u00fc\u00e7l\u00fc m\u00fccadele bi\u00e7imi, i\u015f\u00e7i ve emek\u00e7ilerin hak arama m\u00fccadelesinde i\u015fverene ve kapitalizme kar\u015f\u0131 en g\u00fc\u00e7l\u00fc, en etkili silah\u0131d\u0131r.<br \/>\nEkonomik ve sosyal haklar a\u00e7\u0131s\u0131ndan kazan\u0131mlar elde etmek \u00fclkenin ekonomik ve sosyal politikalar\u0131na emek\u00e7ilerden yana taraf olarak ve buna uygun tutumlar alarak m\u00fcdahale etmekle ve gerekti\u011finde bu silah\u0131n kullan\u0131lmas\u0131 ile\u00a0 m\u00fcmk\u00fcnd\u00fcr. Bu temelde y\u00fcr\u00fct\u00fclen, teslimiyet\u00e7i olmayan bir m\u00fcdahale ile m\u00fccadeleye b\u00fct\u00fcnl\u00fck ve ivme kazand\u0131rmak gerekti\u011fi a\u00e7\u0131kt\u0131r.<br \/>\nKamu emek\u00e7ileri m\u00fccadelesi, bu m\u00fccadelenin en \u00f6nemli arac\u0131 olan grev silah\u0131ndan yoksun bir \u00e7izgide y\u00fcr\u00fct\u00fclemez.
