Tasar\u0131da \u00f6ng\u00f6r\u00fclen d\u00fczenlemelere ana ba\u015fl\u0131klar halinde de\u011finmeden, sonda s\u00f6yleyece\u011fimizi hemen ba\u015fta s\u00f6yleyelim.&nbsp; Bu torba yasa tasar\u0131s\u0131 ile 2,5 milyonu a\u015fk\u0131n kamu emek\u00e7isinin umutlar\u0131 bir kez daha karart\u0131lm\u0131\u015ft\u0131r. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\">\u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131 ile aylard\u0131r yapt\u0131\u011f\u0131m\u0131z toplant\u0131larda taraflar olarak \u00fczerinde uzla\u015fma sa\u011flad\u0131\u011f\u0131m\u0131z hi\u00e7bir konuya yasa tasars\u0131nda yer verilmemi\u015ftir. Torba yasa tasar\u0131s\u0131nda, 2012-2013 toplu s\u00f6zle\u015fme s\u00fcrecinde g\u00f6r\u00fc\u015f\u00fclmesine izin verilmeyerek Kamu Personeli Dan\u0131\u015fma Kuruluna havale edilen 161 konunun hi\u00e7 birisine ili\u015fkin tek bir d\u00fczenleme bile yer almamaktad\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\">Y\u0131llard\u0131r kadro bekleyen y\u00fcz binlerce s\u00f6zle\u015fmeli ve ge\u00e7ici personelin beklentisi bo\u015fa \u00e7\u0131kart\u0131lm\u0131\u015ft\u0131r. S\u00f6zle\u015fmeli personelin kadroya ge\u00e7irilmesi, 2005 y\u0131l\u0131ndan sonra g\u00f6reve ba\u015flayan kamu emek\u00e7ilerine bir derece verilmesi, disiplin cezalar\u0131n\u0131n aff\u0131, yard\u0131mc\u0131 hizmetler s\u0131n\u0131f\u0131na d\u00e2hil personele ek g\u00f6sterge verilmesi, 399 say\u0131l\u0131 KHK\u2019ye tabi s\u00f6zle\u015fmeli personelin, memurlara tan\u0131nan izin haklar\u0131ndan ayn\u0131 \u015fekilde yararlanmas\u0131, kad\u0131n memurlara hamileli\u011fin ba\u015flang\u0131c\u0131ndan itibaren ve anal\u0131k izninin bitiminden itibaren bir y\u0131l s\u00fcreyle gece n\u00f6beti ve gece vardiyas\u0131 g\u00f6revi verilmemesi gibi sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fc i\u00e7in kanun tasar\u0131s\u0131 tasla\u011f\u0131 haz\u0131rlanmas\u0131na ra\u011fmen bug\u00fcne kadar en k\u00fc\u00e7\u00fck bir ad\u0131m dahi at\u0131lmam\u0131\u015ft\u0131r. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">T\u00fcm bunlar\u0131n yerine \u00c7al\u0131\u015fma bakanl\u0131\u011f\u0131 ile sendikalar-konfederasyonlar olarak yapt\u0131\u011f\u0131m\u0131z toplant\u0131larda \u00e7ekince koydu\u011fumuz konular yine bir torban\u0131n i\u00e7erisine doldurulmu\u015ftur.&nbsp; <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\"><strong>De\u011ferli Bas\u0131n Emek\u00e7ileri;<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Peki, ne var bu torbada?&nbsp; Bu torbada,&nbsp; kamuda \u00fcst d\u00fczey y\u00f6netici olarak atanabilmek i\u00e7in gerekli ko\u015fullar\u0131n alt \u00fcst edilmesi dolay\u0131s\u0131yla kariyer ve liyakat ilkesinin tamamen ortadan kald\u0131r\u0131lmas\u0131 vard\u0131r. Otoriter ba\u015fkanl\u0131k sistemine giden yolun ta\u015flar\u0131n\u0131n d\u00f6\u015fenmesi i\u00e7in t\u0131pk\u0131 12 Eyl\u00fcl referandumun da oldu\u011fu gibi AKP\u2019nin devletle\u015fmesi s\u00fcrecinin h\u0131zland\u0131r\u0131lmas\u0131 vard\u0131r. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\">AKP\u2019nin bu torbas\u0131nda, \u201cH\u00fck\u00fcmet memuru\u201d yaratarak zaten doru\u011fa \u00e7\u0131kan siyasi kadrola\u015fman\u0131n \u00f6n\u00fcndeki son kalelerin de i\u015fgali vard\u0131r. Kamu Hastaneleri Birlikleri d\u00fczenlemeleri ile hastanelerin y\u00f6netimine \u00f6zel sekt\u00f6rden y\u00fcksek maa\u015fla sa\u011fl\u0131k\u00e7\u0131 olmayan CEO lar\u0131n atanmas\u0131na benzer bir uygulaman\u0131n t\u00fcm kamu alan\u0131nda genelle\u015ftirilmesi vard\u0131r. AKP\u2019nin bu son torbas\u0131nda i\u015fe g\u00f6re personel de\u011fil yanda\u015fa g\u00f6re i\u015f-mevki yaratma vard\u0131r. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Di\u011fer taraftan tasar\u0131 ile kamu emek\u00e7ilerinin disiplin cezalar\u0131n\u0131n aff\u0131 beklentisi de bo\u015fa \u00e7\u0131kar\u0131lmaktad\u0131r. Ba\u015f\u0131ndan beri y\u00fcz k\u0131zart\u0131c\u0131 su\u00e7lar d\u0131\u015f\u0131nda kalan t\u00fcm disiplin cezalar\u0131n\u0131n affedilece\u011fi beklentisi yarat\u0131lan kamu emek\u00e7ilerine 28 \u015eubat \u015foku ya\u015fat\u0131lm\u0131\u015ft\u0131r.&nbsp; AKP iktidar\u0131na g\u00f6re disiplin su\u00e7lar\u0131 nedeniyle 28 \u015eubat s\u00fcrecinde memuriyetten \u00e7\u0131kar\u0131lanlardan ba\u015fka ma\u011fdur olan kamu emek\u00e7isi bulunmamaktad\u0131r. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Bildi\u011finiz gibi Anayasa Mahkemesi bu y\u0131l\u0131n ba\u015f\u0131nda 666 say\u0131l\u0131 KHK\u2019n\u0131n baz\u0131 maddelerinin iptaline ili\u015fkin ba\u015fvuruyu de\u011ferlendirerek karar\u0131n\u0131 a\u00e7\u0131klam\u0131\u015ft\u0131r. Anayasa Mahkemesinin s\u00f6z konusu karar\u0131 ile 666 KHK\u2019n\u0131n kamu kurumlar\u0131n\u0131n \u00e7ok b\u00fcy\u00fck b\u00f6l\u00fcm\u00fcnde fazla mesai \u00fccretini ortadan kald\u0131ran 15. Maddesi iptal edilmi\u015ftir. Ancak bu torba tasar\u0131 ile Anayasa Mahkemesinin kamu emek\u00e7ileri lehine verdi\u011fi bu \u00f6nemli karar ortadan tekrar kald\u0131r\u0131lmak istenmektedir. Dolay\u0131s\u0131yla bu torbada fazla mesai \u00fccretinin tamamen kald\u0131r\u0131lmas\u0131yla kamu emek\u00e7ilerinin sefalet ko\u015fullar\u0131na itilmesi vard\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\"><strong>De\u011ferli Bas\u0131n Emek\u00e7ileri,<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\"><strong>E\u011fer kamu emek\u00e7ilerinin ba\u015f\u0131na \u00f6r\u00fclmek istenen bu torba yasa tasar\u0131s\u0131 yasala\u015f\u0131rsa;<\/strong><\/span><\/p>\n<p style=\"margin: 0cm 0cm 10pt 36pt; text-align: justify; text-indent: -18pt;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\">$1\u00d8Kamuda,&nbsp; M\u00fcd\u00fcr, \u0130l M\u00fcd\u00fcr\u00fc, Daire Ba\u015fkan\u0131 kadrolara yap\u0131lacak atamalarda aranan s\u0131ras\u0131 ile 8, 10 ve 12 y\u0131ll\u0131k hizmet s\u00fcresi&nbsp; 5 y\u0131la indirilecek. Bu pozisyondakiler i\u00e7in 5 y\u0131l\u0131n hesab\u0131nda sadece kamudaki s\u00fcreler de\u011ferlendirilecek. <\/span><\/p>\n<p style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\">$1\u00d86400 ek g\u00f6stergeli Genel M\u00fcd\u00fcr ve \u00fcst\u00fc kadrolara atanmada yine 5 y\u0131l hizmet yeterli olacak. 5 y\u0131l\u0131n hesab\u0131nda bu kez \u00f6zel sekt\u00f6rdeki s\u00fcreler de de\u011ferlendirilecek. \u00dcstelik bu kadrolara daha \u00f6nce hi\u00e7 memuriyeti olmayanlar da atanabilecek.<\/span><\/p>\n<p style=\"margin: 0cm 0cm 10pt 36pt; text-align: justify; text-indent: -18pt;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\">$1\u00d8M\u00fcd\u00fcr ve \u00fcst\u00fc kadrolara atanmada belirli s\u00fcre o kurumda \u00e7al\u0131\u015fm\u0131\u015f olma, belirli b\u00f6l\u00fcmleri bitirmi\u015f olma gibi \u015fartlar aranmayacak.<\/span><\/p>\n<p style=\"margin: 0cm 0cm 10pt 36pt; text-align: justify; text-indent: -18pt;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\">$1\u00d8Adalet Bakanl\u0131\u011f\u0131, \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131 ve D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131 gibi kurumlardaki \u00fcst d\u00fczey kadrolara meslek mensubu olmayanlar da atanabilecek. \u00d6rne\u011fin Adalet Bakanl\u0131\u011f\u0131na ba\u011fl\u0131 m\u00fcd\u00fcrl\u00fcklerin b\u00fcy\u00fck b\u00f6l\u00fcm\u00fcne atanabilmek i\u00e7in, hukuk fak\u00fcltesi mezunu olma, h\u00e2kim, savc\u0131 ya da avukat olma \u015fartlar\u0131n\u0131n yan\u0131 s\u0131ra ve kamuda belli bir hizmet s\u00fcresine sahip olma \u015fart\u0131 da ortadan kald\u0131r\u0131lacak. Yani mesle\u011fin gerektirdi\u011fi hizmet y\u0131l\u0131, fak\u00fclte-e\u011fitim \u015fartlar\u0131 kald\u0131r\u0131lacak. Adalet Bakanl\u0131\u011f\u0131ndaki \u00fcst d\u00fczey kadrolara \u0130lahiyat Fak\u00fcltesi mezunu, meslekle uzaktan yak\u0131ndan ilgisi olmayanlar atanabilecek.<\/span><\/p>\n<p style=\"margin: 0cm 0cm 10pt 36pt; text-align: justify; text-indent: -18pt;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\">$1\u00d8B\u00f6ylesine \u00f6nemli g\u00f6revlere atanmada tek kriter sadece ve sadece AKP yanda\u015fl\u0131\u011f\u0131 olacak. Kamuda y\u0131llarca hizmet eden gerekli \u015fart ve nitelikleri ta\u015f\u0131yanlar\u0131n ba\u015f\u0131na bu <strong>Yanda\u015f-CEO-T\u00fcccar<\/strong> tak\u0131m\u0131 amir olarak atanacak. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\">Bunun ad\u0131, AKP iktidar\u0131na biatta kusur etmeyecek \u201ch\u00fck\u00fcmet memurlu\u011fu\u201d yarat\u0131lmas\u0131 de\u011fil de nedir? Zaten kamu alan\u0131nda ciddi mesafe kaydedilen siyasi kadrola\u015fman\u0131n tamamlanmas\u0131 de\u011fil de nedir? Bunun ad\u0131,&nbsp; kamu hizmetinin s\u00fcreklili\u011finin yok edilmesi, kamu personel al\u0131m\u0131nda uyulmas\u0131 gereken kurallar\u0131n yok say\u0131lmas\u0131 de\u011fil de nedir?<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\"><strong>&nbsp;De\u011ferli Bas\u0131n Emek\u00e7ileri,<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Burada \u00f6zellikle bir konunun alt\u0131n\u0131 \u00e7izmek istiyoruz. Ne yaz\u0131k ki bu tasar\u0131da AKP iktidar\u0131n\u0131n \u201c\u00f6l\u00fcm\u00fc g\u00f6sterip s\u0131tmaya raz\u0131 etme mant\u0131\u011f\u0131\u201d bir kez daha y\u00fcz\u00fcn\u00fc g\u00f6stermi\u015ftir. Bu durumu AKP h\u00fck\u00fcmetinin medyay\u0131 manip\u00fcle etmesinin, kamuoyunu bilin\u00e7li olarak yanl\u0131\u015f y\u00f6nlendirmek i\u00e7in t\u00fcm olanaklar\u0131n\u0131 seferber etmesinin do\u011fal bir sonucu olarak g\u00f6r\u00fcyoruz. Medyaya, hemen her g\u00fcn \u201cmemura m\u00fcjde\u201d man\u015fetleri att\u0131ran AKP iktidar\u0131n\u0131n yaratt\u0131\u011f\u0131 sis perdesinin de etkisiyle, kamu emek\u00e7ilerinin geni\u015f bir b\u00f6l\u00fcm\u00fcnce hatta ne yaz\u0131k ki baz\u0131 sendika ve konfederasyonlarca bu torba yasa tasar\u0131s\u0131n\u0131n yasala\u015fmas\u0131 durumunda ortaya \u00e7\u0131kacak tablo t\u00fcm netli\u011fi ile g\u00f6r\u00fclememektedir. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">S\u00fcrg\u00fcn-Rotasyonla, bireysel performansa dayal\u0131 \u00fccretlendirmeyle, kamuda g\u00fcvencesizli\u011fi art\u0131racak istihdam bi\u00e7imlerinin yayg\u0131nla\u015ft\u0131r\u0131lmas\u0131 tehdidi alt\u0131nda tutulan milyonlarca kamun emek\u00e7isi \u201cKorktu\u011fumuz gibi de\u011filmi\u015f. Neyse torba yasa tars\u0131s\u0131nda bunlar yok\u201d diyecek duruma getirilmi\u015ftir. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Bu tasar\u0131dan beklentisi olan, hatta KPDK toplant\u0131lar\u0131nda bug\u00fcn bu torba yasa tasar\u0131s\u0131yla birebir \u00f6rt\u00fc\u015fen \u00f6nerilerde bulunan, yanda\u015fl\u0131\u011f\u0131 tescilli konfederasyon y\u00f6netiminin g\u00f6rmezden geldi\u011finin aksine bu tasar\u0131 t\u00fcm kamu emek\u00e7ilerinin ya\u015fam\u0131n\u0131 alt \u00fcst edecektir. Nas\u0131l m\u0131? <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">\u00d6ncelikle i\u015f g\u00fcvencesinin sadece kadrodan ibaret olmad\u0131\u011f\u0131n\u0131 hat\u0131rlatmak isteriz. Gelece\u011fe g\u00fcvenle bakmay\u0131 engelleyen her \u015feyin i\u015f ve \u00fccret g\u00fcvencesinin bir unsuru oldu\u011fu unutulmamal\u0131d\u0131r. Dolay\u0131s\u0131yla \u00e7al\u0131\u015fma ya\u015fam\u0131nda belirsizlik yaratan, yar\u0131n\u0131n nas\u0131l olaca\u011f\u0131n\u0131 g\u00f6rmeyi engelleyen her geli\u015fme g\u00fcvencesizli\u011fi derinle\u015ftirmektedir. Bug\u00fcne kadar kamu alan\u0131nda g\u00fcvencesizli\u011fi gittik\u00e7e art\u0131ran, istihdam\u0131 onlarca par\u00e7aya ay\u0131ran bir s\u00fcre\u00e7 ya\u015fanm\u0131\u015ft\u0131r. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Ba\u015fta 6111 say\u0131l\u0131 torba yasa ve onlarca Kanun H\u00fckm\u00fcnde Kararname ile kamu alan\u0131nda ta\u015feronla\u015ft\u0131rma yayg\u0131nla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r.
