Devlet Personel Ba\u015fkanl\u0131\u011f\u0131 (DPB) taraf\u0131ndan 22.03.2013 tarihinde konfederasyonumuza g\u00f6nderilen yaz\u0131da; s\u00f6z konusu toplant\u0131n\u0131n g\u00fcndeminin 2012-2013 y\u0131llar\u0131n\u0131 kapsayan <strong>toplu s\u00f6zle\u015fmede kesinle\u015fmi\u015f kararlar\u0131n g\u00f6r\u00fc\u015f\u00fclmesi<\/strong> olarak belirlemi\u015fti. Ancak 27 Mart 2013 \u00c7ar\u015famba ak\u015fam saatlerinde Devlet Personel Ba\u015fkanl\u0131\u011f\u0131 taraf\u0131ndan konfederasyonlara yeni bir yaz\u0131 daha g\u00f6nderilerek <strong>657 DMK yap\u0131lmas\u0131 d\u00fc\u015f\u00fcn\u00fclen de\u011fi\u015fiklikleri<\/strong> i\u00e7erir yeni bir g\u00fcndem g\u00f6nderilmi\u015ftir. De\u011fi\u015fiklik yaz\u0131s\u0131n\u0131n bir g\u00fcn \u00f6nce g\u00f6nderilmesi dikkat \u00e7ekici olmakla birlikte yeni Dan\u0131\u015fma Kurulu Toplant\u0131s\u0131n\u0131n g\u00fcndemi ve kurulda ge\u00e7en konu\u015fmalar \u00fczerinden konu ile ilgili d\u00fc\u015f\u00fcncelerimiz a\u015fa\u011f\u0131daki gibidir:<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"background-color: yellow;\">1- 657 say\u0131l\u0131 kanunda \u00f6ng\u00f6r\u00fclen personel stat\u00fclerinin de\u011ferlendirilmesi,<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">Bu madde direk i\u015f g\u00fcvenli\u011finin kendisi olmakla birlikte h\u00fck\u00fcmet \u00fc\u00e7 b\u00fcy\u00fck konfederasyonu ve yetkili sendika ba\u015fkanlar\u0131n\u0131 \u00e7a\u011f\u0131rarak konu ile ilgili fikirlerini almak istediklerini belirtmi\u015ftir. Unutmamak gerekir ki h\u00fck\u00fcmet daha \u00f6nce <strong>anayasa yap\u0131m s\u00fcreci, kad\u0131na y\u00f6nelik \u015fiddetin engellenmesi yasas\u0131 <\/strong>gibi bir\u00e7ok konu ve d\u00fczenlemede sivil toplum \u00f6rg\u00fctlerinin s\u00f6z\u00fcm ona g\u00f6r\u00fc\u015f\u00fcn\u00fc alm\u0131\u015ft\u0131 ama sonu\u00e7ta yine t\u00fcm s\u00f6ylenenlere kulak t\u0131kayarak yine kendi bildi\u011fini yapm\u0131\u015ft\u0131. H\u00fck\u00fcmetin konu ile ilgili \u00fc\u00e7 farkl\u0131 \u00f6nerileri de bulunmu\u015ftur bunlar;<\/p>\n<p style=\"text-indent: -18pt; text-align: justify;\">$1a)<span style=\"font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>Kamu aln\u0131ndaki t\u00fcm stat\u00fclerin(4A memur, 4B s\u00f6zle\u015fmeli \u00e7al\u0131\u015fan, 4C ge\u00e7ici personel, 4D daimi i\u015f\u00e7i)&nbsp; teke indirilerek \u00e7al\u0131\u015fanlar\u0131n hepsinin s\u00f6zle\u015fmeli olmas\u0131 ve ayr\u0131m yap\u0131lmadan <strong>\u00e7al\u0131\u015fanlar <\/strong>olarak nitelendirilmesi<\/p>\n<p style=\"text-indent: -18pt; text-align: justify;\">$1b)<span style=\"font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>T\u00fcm kamu \u00e7al\u0131\u015fanlar\u0131n\u0131n iki ba\u015fl\u0131k alt\u0131nda toplanarak kamu \u00e7al\u0131\u015fan\u0131 memur ve\/veya kamu i\u015f\u00e7isi olarak nitelendirilmesi<\/p>\n<p style=\"text-indent: -18pt; text-align: justify;\">$1c)<span style=\"font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>T\u00fcm \u00e7al\u0131\u015fanlar\u0131n i\u015f g\u00fcvenceli kamu \u00e7al\u0131\u015fan\u0131 memur olarak nitelendirilmesi<\/p>\n<p style=\"text-align: justify;\">Bunlar\u0131 se\u00e7enek olarak sunan h\u00fck\u00fcmet ayn\u0131 zamanda anayasa komisyonunda anayasan\u0131n <span style=\"font-size: 9.5pt; line-height: 115%;\">128. Maddesinde <\/span>yer alan <strong>\u2018Devletin asli ve s\u00fcrekli i\u015fleri devlet memurlar\u0131 eliyle g\u00f6r\u00fcl\u00fcr\u2019<\/strong> ibaresinin kald\u0131r\u0131larak \u201c<strong>\u00e7al\u0131\u015fanlar eliyle g\u00f6r\u00fcl\u00fcr\u201d<\/strong> ibaresinin konmas\u0131n\u0131 teklif etmi\u015ftir ki buda hali haz\u0131rda bir plan\u0131n bulundu\u011funun g\u00f6stergesidir. 128. Madde devlet memurlu\u011funu anlatan ve Anayasal g\u00fcvence sa\u011flayan bir maddedir ve bu madde de\u011fi\u015firse, buna ba\u011fl\u0131 olarak 657 say\u0131l\u0131 DMK\u2019da devlet memurlu\u011fu kavram\u0131 yok say\u0131lacak ve i\u015f g\u00fcvencesi olmayan bir istihdam sistemi getirilecektir.<\/p>\n<p style=\"text-align: justify;\">Birbirinden olduk\u00e7a farkl\u0131 bu \u00f6neriler g\u00f6stermektedir ki h\u00fck\u00fcmet her konuda yapt\u0131\u011f\u0131 gibi sahte demokrasi g\u00f6sterilerine devam etmekte ve emek\u00e7ilerin zihinlerini buland\u0131rmak istemektedir. \u00d6zelle\u015ftirmelerin g\u00fcvencesizli\u011fin AKP d\u00f6neminde tavan yapt\u0131\u011f\u0131n\u0131 da d\u00fc\u015f\u00fcnecek olursak son d\u00f6nemde emek alan\u0131na yap\u0131lan sald\u0131r\u0131lar\u0131n en b\u00fcy\u00fc\u011f\u00fc ile kar\u015f\u0131 kar\u015f\u0131ya oldu\u011fumuz maalesef bir ger\u00e7ektir.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"background-color: yellow;\">2- Personel da\u011f\u0131l\u0131m\u0131ndaki dengesizli\u011fin de\u011ferlendirilmesi,<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">Belirli s\u00fcrelerle mesela \u00fc\u00e7 veya be\u015f g\u00f6rev y\u0131l\u0131n\u0131n sonunda t\u00fcm kamu \u00e7al\u0131\u015fanlar\u0131n\u0131n rotasyona(g\u00f6rev yeri de\u011fi\u015ftirme) tabi tutulmas\u0131 \u00f6nerisidir. Bu giri\u015fim hali haz\u0131rda var olan, il m\u00fcd\u00fcr\u00fc ve \u00fcst kademe y\u00f6neticilere uygulanan rotasyonun t\u00fcm \u00e7al\u0131\u015fanlar\u0131 kapsamas\u0131 anlam\u0131na gelmektedir. Kamuda yakla\u015f\u0131k 2,5 milyon kamu emek\u00e7isi \u00e7al\u0131\u015fmaktad\u0131r. Her defas\u0131nda harc\u0131rah yolluk \u00f6denerek yer de\u011fi\u015fikli\u011fi yap\u0131lmas\u0131ndan do\u011facak maliyete uyum sorunlar\u0131ndan kaynaklanan i\u015f veriminde ki d\u00fc\u015fme de eklenince bu durumun ger\u00e7ekle\u015ftirilebilirlik durumu tart\u0131\u015f\u0131l\u0131r haldedir. Di\u011fer bir se\u00e7enekte harc\u0131rahs\u0131z yolluksuz \u00e7al\u0131\u015fanlar\u0131 s\u00fcrg\u00fcn hayat\u0131na mahkum etmek olabilir ki h\u00fck\u00fcmetin emek d\u00fc\u015fman\u0131 politikalar\u0131 da g\u00f6z \u00f6n\u00fcne al\u0131n\u0131rsa as\u0131l ger\u00e7e\u011fe d\u00f6n\u00fc\u015febilecek durum bu olur.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"background-color: yellow;\">3- Kamu kurulu\u015flar\u0131nda y\u00f6neticilik g\u00f6revlerine atanmada aranan hizmet s\u00fcresi \u015fart\u0131 ile y\u00f6neticilik g\u00f6rev s\u00fcrelerinin de\u011ferlendirilmesi,<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">AKP h\u00fck\u00fcmeti kadrola\u015fmada kendinden \u00f6nce gelen h\u00fck\u00fcmetlerin \u00e7ok \u00fcst\u00fcnde bir performans sergilemi\u015f olmas\u0131na ra\u011fmen, kamu alan\u0131na iktidardan gitse dahi y\u0131llarca yetecek kadroyu yerle\u015ftirmenin \u00e7abas\u0131 i\u00e7erisindedir. \u00dcst d\u00fczey y\u00f6netici atamalar\u0131nda \u015fu haliyle 10-12 y\u0131l olan zorunlu hizmet s\u00fcresinin kadro unvanlar\u0131na g\u00f6re 3-5-7 hizmet y\u0131l\u0131 \u015fart\u0131na d\u00fc\u015f\u00fcrmek istemektedir. Cemaatin gen\u00e7 neferlerine kadro a\u00e7\u0131lmas\u0131 gerekmektedir.<\/p>\n<p style=\"text-align: justify;\">Somut bir \u00f6rnekle a\u00e7\u0131klamak gerekirse; 2013 de K\u00fclt\u00fcr ve Turizm Bakan\u0131n\u0131n de\u011fi\u015fmesi ile Profes\u00f6r unvanl\u0131 K\u00fct\u00fcphaneler Ve Yay\u0131mlar Genel M\u00fcd\u00fcr\u00fcn\u00fcn yerini K\u00fclt\u00fcr Turizm Uzman Yard\u0131ms\u0131 olarak AKP eliyle i\u015fe al\u0131nan personelin <strong>almas\u0131<\/strong> birka\u00e7 y\u0131l i\u00e7erisinde b\u00f6yle bir kurumun en \u00fcst d\u00fczey y\u00f6neticili\u011fine <strong>iktidara yak\u0131n olan birinin<\/strong> kolayl\u0131kla gelinebilece\u011fini g\u00f6stermektedir. &nbsp;<\/p>\n<p style=\"text-align: justify;\">Kamuya d\u0131\u015far\u0131dan CEO tarz\u0131 y\u00f6netici atanabilmesinin sa\u011flanmas\u0131 \u00fcst d\u00fczey devlet memurlar\u0131n\u0131n iktidarlarla gelip gitmesi i\u00e7in d\u00fczenlemeler yap\u0131lmas\u0131 hedeflenmektedir. Yani <strong>kamu g\u00f6revlisi <\/strong>halka hizmetle g\u00f6revli kamu \u00e7al\u0131\u015fan\u0131 demek iken iktidara hizmet eden tamamen iktidar g\u00fcd\u00fcm\u00fcndeki personel haline getirilmek istenmektedir. Bu y\u00f6neticilerden kas\u0131t Daire Ba\u015fkanlar\u0131ndan ba\u015flamak \u00fczere Genel M\u00fcd\u00fcrler, Genel M\u00fcd\u00fcr Yard\u0131mc\u0131lar\u0131 ve M\u00fcste\u015farlard\u0131r.&nbsp; Yani kurumlar\u0131n hiyerar\u015fide en \u00fcstte olan y\u00f6n y\u00f6neticilerini kapsamaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"background-color: yellow;\">4- Kariyer mesleklere atanma \u015fartlar\u0131n\u0131n de\u011ferlendirilmesi,<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">KPSS, Yabanc\u0131 Dil S\u0131navlar\u0131ndan yeterli d\u00fczeyde puan alamayan ilgili ki\u015filerin kolayl\u0131kla bu mesleklere atanmas\u0131 ve k\u0131sa s\u00fcrede \u00fcst d\u00fczey y\u00f6netimlere gelmesini hedeflemektedir. Kariyer mesleklere atama \u015fartlar\u0131n\u0131n de\u011fi\u015ftirilmesinden kas\u0131t \u00f6rne\u011fin her meslek i\u00e7in gerekli olan <strong>dil \u015fart\u0131n\u0131n kald\u0131r\u0131lmas\u0131<\/strong>, \u00fc\u00e7 y\u0131l olan uzman yard\u0131mc\u0131l\u0131\u011f\u0131 s\u00fcrelerinin iki y\u0131la d\u00fc\u015f\u00fcr\u00fclmesi, uzman yard\u0131mc\u0131l\u0131\u011f\u0131ndan uzmanl\u0131\u011fa ge\u00e7i\u015fteki tez \u015fart\u0131n\u0131n esnetilmesi gibi konular\u0131 kapsamaktad\u0131r. En somut haliyle; T\u00fcrkiye&#8217;nin Bern B\u00fcy\u00fckel\u00e7ili\u011fine 12 bin dolar maa\u015fla <strong>yabanc\u0131 dil bilmeyen bir Bas\u0131n Ata\u015fesi<\/strong> atanabilir, Ata\u015fe&#8217;ye ayl\u0131k 6 bin dolara terc\u00fcman da tutulabilir. Bu madde de ki atanma \u015fartlar\u0131n\u0131n de\u011ferlendirilmesin kas\u0131t niteliksiz olan parti kadrolar\u0131n\u0131n mevzilendirilmesidir. &nbsp;<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"background-color: yellow;\">5- 657 say\u0131l\u0131 kanunda \u00f6ng\u00f6r\u00fclen disiplin cezalar\u0131n\u0131n de\u011ferlendirilmesi,<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">Kamu G\u00f6revlileri Dan\u0131\u015fma Kurulu toplant\u0131s\u0131nda, \u00c7al\u0131\u015fma Bakan\u0131n\u0131n Devlet Personel Ba\u015fkan Yard\u0131mc\u0131s\u0131na konu ile ilgili bir f\u0131kra anlatmas\u0131n\u0131 istemi\u015ftir. F\u0131krada: &nbsp;\u201ck\u0131nama cezas\u0131 alan bir memura cezas\u0131 amiri taraf\u0131ndan telefonda tebli\u011f edilirken memur; te\u015fekk\u00fcr ediyorum m\u00fcd\u00fcr\u00fcm bende sizi k\u0131n\u0131yorum deyip telefonu y\u00fcz\u00fcne kapatm\u0131\u015f.\u201d<\/p>\n<p style=\"text-align: justify;\">Yani yap\u0131lmas\u0131 d\u00fc\u015f\u00fcn\u00fclen de\u011fi\u015fikliklerin bu kadar basit ve masumane oldu\u011funu ifade etmek istiyorlar.&nbsp; Uyar\u0131 ve k\u0131nama cezalar\u0131n\u0131n kald\u0131r\u0131lmas\u0131n\u0131 iyi niyetli bir d\u00fczenleme olarak alg\u0131latmaya \u00e7al\u0131\u015f\u0131yorlar. Hali haz\u0131rda \u00e7al\u0131\u015fanlara verilen cezalar <strong>su\u00e7la orant\u0131l\u0131<\/strong> d\u00fczeyde ger\u00e7ekle\u015fmemektedir. Torba yasa ile disiplin amirlerine tan\u0131nan <strong>yetki geni\u015fletilmi\u015f <\/strong>ve amirlerin keyfi uygulamalar yapmalar\u0131na zemin haz\u0131rlam\u0131\u015ft\u0131r. Yap\u0131lacak bu d\u00fczenleme ile kar\u015f\u0131l\u0131\u011f\u0131 uyarma olacak bir hatan\u0131n bile ayl\u0131ktan kesme, kademe ilerleme ve memuriyetten at\u0131lma gibi cezalarla sonu\u00e7land\u0131r\u0131labilece\u011fi unutulmamal\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\">T\u00fcm bu de\u011ferlendirmelerin \u0131\u015f\u0131\u011f\u0131nda emek\u00e7iler i\u00e7in gelecek en b\u00fcy\u00fck sald\u0131r\u0131 dalgas\u0131 budur. \u0130\u015f g\u00fcvencesi bizim a\u00e7\u0131m\u0131zdan tart\u0131\u015f\u0131lmaz bir noktad\u0131r ve \u00e7ocuklar\u0131m\u0131za b\u0131rakaca\u011f\u0131m\u0131z mirast\u0131r. Bizi bekleyen tehdidi \u00e7ok iyi g\u00f6rmek ve tedbirini almak zorunday\u0131z.
