Konfederasyon: Kamu Emek\u00e7ileri Sendikalar\u0131 Konfederasyonu (KESK)&#8217;nu<\/p>\n<p style=\"text-align: justify;\">c. Sendika: K\u00fclt\u00fcr Sanat ve Turizm Emek\u00e7ileri Sendikas\u0131 (K\u00fclt\u00fcr Sanat-Sen)&#8217;n\u0131<\/p>\n<p style=\"text-align: justify;\">d. \u0130\u015fyeri: Madde 6 (a) bendinde yer alan kurumlar\u0131<\/p>\n<p style=\"text-align: justify;\">e. Kamu g\u00f6revlisi: Kamu kurum ve kurulu\u015flar\u0131 ile ba\u011fl\u0131 ortakl\u0131klar\u0131nda i\u015f\u00e7i stat\u00fcs\u00fc d\u0131\u015f\u0131nda bir kadro veya pozisyonda \u00e7al\u0131\u015fan kamu \u00e7al\u0131\u015fan\u0131n\u0131,<\/p>\n<p style=\"text-align: justify;\">f. Kamu i\u015fveren vekili: Ba\u015fbakanl\u0131k ve K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131&#8217;n\u0131n kamu eliyle y\u00fcr\u00fct\u00fclen hizmetin verildi\u011fi Madde 6<\/p>\n<p style=\"text-align: justify;\">(a) bendinde yer alan kurum ve kurulu\u015flar\u0131 temsile ve b\u00fct\u00fcn\u00fcn\u00fc sevk ve idareye yetkili olanlar ile yard\u0131mc\u0131lar\u0131n\u0131,<\/p>\n<p style=\"text-align: justify;\">g. Kamu \u0130\u015fveren Vekili Temsilcisi: Ba\u015fbakanl\u0131k ve K\u00fclt\u00fcr ve Turizm<\/p>\n<p style=\"text-align: justify;\">Bakanl\u0131\u011f\u0131&#8217;n\u0131 temsile ve b\u00fct\u00fcn\u00fcn\u00fc sevk ve idareye yetkili olanlar ile bunlar\u0131n yard\u0131mc\u0131lar\u0131n\u0131,<\/p>\n<p style=\"text-align: justify;\">h. \u015eube: K\u00fclt\u00fcr Sanat-Sen&#8217;e ba\u011fl\u0131 ilgili \u015eube Ba\u015fkanl\u0131\u011f\u0131n\u0131,<\/p>\n<p style=\"text-align: justify;\">i. S\u00f6zle\u015fme: Ekleri ile birlikte bu toplu i\u015f s\u00f6zle\u015fmesini<\/p>\n<p style=\"text-align: justify;\">j. Taraflar: Bu Toplu \u0130\u015f S\u00f6zle\u015fmesine taraf olan i\u015fveren ve sendika<\/p>\n<p style=\"text-align: justify;\">k. Mevzuat: Yasa, t\u00fcz\u00fck, y\u00f6netmelik, genelge, y\u00f6nerge v.b.&#8217;ni ifade eder.<\/p>\n<p style=\"text-align: justify;\">MADDE 4- S\u00d6ZLE\u015eMEN\u0130NAMACI<\/p>\n<p style=\"text-align: justify;\">Bu toplu s\u00f6zle\u015fmenin amac\u0131:S\u00f6zle\u015fmesinin yap\u0131lmas\u0131, muhtevas\u0131 ve sona ermesi ile ilgili hususlar\u0131 d\u00fczenleyerek;<\/p>\n<p style=\"text-align: justify;\">KESK ve K\u00fclt\u00fcr Sanat-Sen ile Ba\u015fbakanl\u0131k ve K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131 aras\u0131nda, taraflar\u0131n temsil, hak ve y\u00fck\u00fcml\u00fcl\u00fcklerini, taraflar\u0131n hak ve yetkilerini, sendikal izinleri, \u00e7al\u0131\u015fanlar\u0131n e\u011fitimi, \u00e7al\u0131\u015fma ko\u015fullar\u0131 ve s\u00fcrelerini, i\u015f g\u00fcvencesini, i\u015fe alma ve i\u015ften ayr\u0131lma usullerini, her t\u00fcrl\u00fc mali,sosyal ve \u00f6zl\u00fck hak ve yard\u0131mlar\u0131, izin, atanma, yer de\u011fi\u015ftirme ve y\u00f6netime kat\u0131lma haklar\u0131n\u0131, disiplin h\u00fck\u00fcmlerini, yasaklar\u0131n kald\u0131r\u0131lmas\u0131 ile kar\u015f\u0131l\u0131kl\u0131 \u00f6dev ve sorumluluklar\u0131 ve \u00f6zel h\u00fck\u00fcmleri g\u00f6stermektir.<\/p>\n<p style=\"text-align: justify;\">MADDE 5- \u0130LKELER<\/p>\n<p style=\"text-align: justify;\">Bu toplu s\u00f6zle\u015fmenin uygulanmas\u0131nda;Taraflar i\u015fyerlerinde \u00e7al\u0131\u015fma ortam\u0131n\u0131n olu\u015fturulmas\u0131nda, \u0130nsan Haklar\u0131 Evrensel Bildirgesi, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi ve Avrupa \u0130nsan Haklar\u0131 Mahkemesi kararlar\u0131n\u0131, Avrupa Sosyal \u015eart\u0131, Uluslar aras\u0131 \u00c7al\u0131\u015fma \u00d6rg\u00fct\u00fc S\u00f6zle\u015fmeleri ve yetkili organ kararlar\u0131n\u0131, BM \u0130kiz S\u00f6zle\u015fmelerini ve organ kararlar\u0131n\u0131 asgari norm olarak kabul ederler.<\/p>\n<p style=\"text-align: justify;\">MADDE 6- KAPSAM VE YARARLANMA<\/p>\n<p style=\"text-align: justify;\">a) Bu Toplu \u0130\u015f S\u00f6zle\u015fmesi, K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131, Atat\u00fcrk K\u00fclt\u00fcr Merkezi Ba\u015fkanl\u0131\u011f\u0131, Devlet Tiyatrolar\u0131 Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc, Devlet Opera ve Balesi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc, Atat\u00fcrk Ara\u015ft\u0131rma Merkezi Ba\u015fkanl\u0131\u011f\u0131, T\u00fcrk Dil Kurumu Ba\u015fkanl\u0131\u011f\u0131, T\u00fcrk Tarih Kurumu Ba\u015fkanl\u0131\u011f\u0131, Atat\u00fcrk K\u00fclt\u00fcr, Dil ve Tarih Y\u00fcksek Kurumu Ba\u015fkanl\u0131\u011f\u0131, T\u00fcrkiye Yazma Eserler Kurumu Ba\u015fkanl\u0131\u011f\u0131 ile bunlara ba\u011fl\u0131 ve ilgili i\u015fyerlerinin t\u00fcm\u00fcn\u00fc kapsar.<\/p>\n<p style=\"text-align: justify;\">b) Bu Toplu \u0130\u015f S\u00f6zle\u015fmesi h\u00fck\u00fcmlerinden K\u00fclt\u00fcr Sanat ve Turizm Hizmet Kolunda bulunan i\u015fyerlerindeki 657 say\u0131l\u0131 kanunun 4\/A, 4\/B, 4\/C maddesine tabi \u00e7al\u0131\u015fanlar, 657 say\u0131l\u0131 kanun uyar\u0131nca sanat kurumlar\u0131nda t\u00fcm s\u00f6zle\u015fmeli \u00e7al\u0131\u015fanlar ile ge\u00e7ici hizmet s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fanlar, \u00f6zel kanunlar\u0131na g\u00f6re kamu g\u00f6revlisi olarak kabul edilen s\u00f6zle\u015fmeli personel yararlan\u0131r.<\/p>\n<p style=\"text-align: justify;\">c) Bu Toplu \u0130\u015f S\u00f6zle\u015fmesinin y\u00fcr\u00fcrl\u00fck s\u00fcresi i\u00e7inde i\u015fveren, sendikas\u0131z \u00e7al\u0131\u015fanlar\u0131n \u00fccretlerine; Toplu \u0130\u015f S\u00f6zle\u015fmesinde\u00f6ng\u00f6r\u00fclen zamlardan ayr\u0131 ve farkl\u0131 zam yapamaz. Yapmas\u0131 durumunda bu zamdan b\u00fct\u00fcn sendikal\u0131 \u00e7al\u0131\u015fanlar da ek olarak ve ayr\u0131ca yararlan\u0131rlar.<\/p>\n<p style=\"text-align: justify;\">MADDE 7- TOPLUS\u00d6ZLE\u015eMEN\u0130NH\u00dcK\u00dcMLER\u0130<\/p>\n<p style=\"text-align: justify;\">a) Bu Toplu \u0130\u015f S\u00f6zle\u015fmesinin &#8220;Kapsam ve Yararlanma &#8221; ba\u015fl\u0131\u011f\u0131n\u0131 ta\u015f\u0131yan 6. maddesinde, s\u00f6zle\u015fmeden yararlanaca\u011f\u0131 belirtilen \u00e7al\u0131\u015fanlara uygulanan mevzuat\u0131n bu S\u00f6zle\u015fmeye ayk\u0131r\u0131 h\u00fck\u00fcmlerinin yerini bu S\u00f6zle\u015fme h\u00fck\u00fcmleri al\u0131r.<\/p>\n<p style=\"text-align: justify;\">b) Yasalardan do\u011fan haklara ek olarak, bu Toplu \u0130\u015f S\u00f6zle\u015fmesinde yer alan h\u00fck\u00fcmler, s\u00f6zle\u015fmeden yararlanan \u00e7al\u0131\u015fanlar y\u00f6n\u00fcnden S\u00f6zle\u015fmenin y\u00fcr\u00fcrl\u00fck s\u00fcresinin ba\u015flang\u0131c\u0131ndan itibaren, yeni bir S\u00f6zle\u015fme yap\u0131l\u0131ncaya kadar h\u00fck\u00fcm do\u011furmaya devam eder.<\/p>\n<p style=\"text-align: justify;\">c) Bu toplu i\u015f s\u00f6zle\u015fmesinde aksi belirtilmedik\u00e7e, idari ve hizmet akitleri toplu i\u015f s\u00f6zle\u015fmesine ayk\u0131r\u0131 olamaz. \u0130dari ve hizmet akitlerinin toplu i\u015f s\u00f6zle\u015fmesine ayk\u0131r\u0131 h\u00fck\u00fcmlerinin yerini, bu toplu i\u015f s\u00f6zle\u015fmesindeki h\u00fck\u00fcmler al\u0131r. \u015e\u00f6yle ki; idari ve hizmet akitlerindeki kamu \u00e7al\u0131\u015fan\u0131 lehine h\u00fck\u00fcmler sakl\u0131d\u0131r ve hizmet akdinde belirtilmeyen konularda bu toplu i\u015f s\u00f6zle\u015fmesinin h\u00fck\u00fcmleri uygulan\u0131r.<\/p>\n<p style=\"text-align: justify;\">d) Bu toplu i\u015f s\u00f6zle\u015fmesinin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten \u00f6nce kamu \u00e7al\u0131\u015fanlar\u0131na sa\u011flanan ve bu toplu i\u015f s\u00f6zle\u015fmesinde de\u011fi\u015ftirici ya da yok edici h\u00fck\u00fcm bulunmayan kamu \u00e7al\u0131\u015fan\u0131 lehine hak ve menfaatler kazan\u0131lm\u0131\u015f hak olarak aynen devam eder.<\/p>\n<p style=\"text-align: justify;\">e) Toplu i\u015f s\u00f6zle\u015fmesi, mevzuat ile kamu \u00e7al\u0131\u015fan\u0131 yarar\u0131na tan\u0131nm\u0131\u015f ve tan\u0131nacak haklar\u0131n uygulanmas\u0131na engel olamaz. Bu toplu i\u015f s\u00f6zle\u015fmesinden daha fazla hak sa\u011flayan yasalar \u00e7\u0131karsa, bu s\u00f6zle\u015fme h\u00fck\u00fcmlerinin yerini al\u0131r.<\/p>\n<p style=\"text-align: justify;\">f) S\u00f6zle\u015fmede belirtilmeyen konularda mevzuat h\u00fck\u00fcmleri uygulan\u0131r.<\/p>\n<p style=\"text-align: justify;\">MADDE 8- UYGULAMAESASLARI:<\/p>\n<p style=\"text-align: justify;\">a) Toplu \u0130\u015f S\u00f6zle\u015fmesinin B\u00fct\u00fcnl\u00fc\u011f\u00fc: Bu Toplu \u0130\u015f S\u00f6zle\u015fmesi gerek maddelerin a\u00e7\u0131k anlamlar\u0131 ve gerekse de de\u011findi\u011fi b\u00fct\u00fcn hususlarda ge\u00e7erlidir. B\u00f6l\u00fcm ve madde ba\u015fl\u0131klar\u0131 maddelerin anlam\u0131n\u0131 tamamlar.<\/p>\n<p style=\"text-align: justify;\">b) Yorum: Bu Toplu \u0130\u015f S\u00f6zle\u015fmesi amac\u0131 d\u0131\u015f\u0131nda yorumlanamaz, taraflar yoruma gerekli g\u00f6rd\u00fckleri maddeleri \u00f6ncelikle aralar\u0131nda g\u00f6r\u00fc\u015ferek ortak bir \u00e7\u00f6z\u00fcm yolu bulmaya \u00e7al\u0131\u015f\u0131rlar. \u00c7al\u0131\u015fanlardan ve \u00f6zg\u00fcrl\u00fcklerden yana yorum esas al\u0131n\u0131r.<\/p>\n<p style=\"text-align: justify;\">c) Toplu \u0130\u015f S\u00f6zle\u015fmesinin Y\u00fcr\u00fct\u00fclmesi: Bu Toplu \u0130\u015f S\u00f6zle\u015fmenin y\u00fcr\u00fct\u00fclmesi i\u015fveren ve sendikayla birlikte sa\u011flan\u0131r. Sendika, Genel Merkez Y\u00f6netim Kurulu, \u015eube Y\u00f6netim Kurulu, \u0130\u015fyeri Sendika Temsilcileri taraf\u0131ndan temsil edilir. \u0130\u015fveren, kendisi ya da i\u015fveren vekili taraf\u0131ndan temsil edilir.<\/p>\n<p style=\"text-align: justify;\">d) Uyu\u015fmazl\u0131klar\u0131n Giderilmesi: Taraflar uyu\u015fmazl\u0131klar\u0131 aralar\u0131ndag\u00f6r\u00fc\u015ferek \u00e7\u00f6zmeye \u00e7aba g\u00f6sterirler. Bu ama\u00e7la yap\u0131lacak toplant\u0131 \u00e7a\u011fr\u0131s\u0131na kar\u015f\u0131 taraf uymak zorundad\u0131r. \u00c7a\u011fr\u0131da bulunan taraf, g\u00f6r\u00fc\u015f\u00fclmesini istedi\u011fi konular\u0131 ve toplant\u0131n\u0131n tarihini en az yedi g\u00fcn \u00f6nceden kar\u015f\u0131 tarafa bildirir. Toplant\u0131da, taraflar aras\u0131nda uyu\u015fma sa\u011flanamazsa, i\u015fveren ve sendika uyu\u015fmazl\u0131k konular\u0131n\u0131 g\u00f6r\u00fc\u015fmek \u00fczere on be\u015f g\u00fcn i\u00e7inde yeniden biraraya gelir.<\/p>\n<p style=\"text-align: justify;\">e) Bu g\u00f6r\u00fc\u015fmelerden sonu\u00e7 al\u0131namad\u0131\u011f\u0131 takdirde taraflar\u0131n hukuki ve demokratik her t\u00fcrl\u00fc m\u00fccadele y\u00f6ntemlerini se\u00e7me, deneme ve uygulama haklar\u0131 sakl\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\">MADDE 9-\u0130\u015eVEREN\u0130NHAK VE Y\u00dcK\u00dcML\u00dcL\u00dcKLER\u0130<\/p>\n<p style=\"text-align: justify;\">a) \u0130\u015fveren, bu Toplu \u0130\u015f S\u00f6zle\u015fmesine ayk\u0131r\u0131 olmamak \u00fczere i\u015fin tanzimi, i\u015fyerinin sevk idaresi ile ilgili kararlar almaya yetkilidir.<\/p>\n<p style=\"text-align: justify;\">b) \u0130\u015fveren, i\u015fyerinde \u00e7al\u0131\u015fanlar\u0131n g\u00fcvenli\u011fi ve sa\u011fl\u0131\u011f\u0131 a\u00e7\u0131s\u0131ndan gereken her t\u00fcrl\u00fc \u00f6nlemi eksiksiz almakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p style=\"text-align: justify;\">c) \u0130\u015fveren, \u00e7al\u0131\u015fanlar\u0131n t\u00fcm haklar\u0131n\u0131 zaman\u0131nda ve noksans\u0131z olarak yerine getirmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p style=\"text-align: justify;\">d) \u0130\u015fveren, sendika veya konfederasyonun her konudaki bilgi talebini \u00f6ncelikli olarak yerine getirir. Sendika ve i\u015fveren vekilleri birbirine yazd\u0131klar\u0131 yaz\u0131lara en ge\u00e7 15 g\u00fcn i\u00e7erisinde yaz\u0131l\u0131 yan\u0131t vermek zorundad\u0131r.<\/p>\n<p style=\"text-align: justify;\">e) \u00c7al\u0131\u015fanlar\u0131 ilgilendiren her t\u00fcrl\u00fc yasa, t\u00fcz\u00fck, y\u00f6netmelik, genelge, vb. haz\u0131rl\u0131k \u00e7al\u0131\u015fmalar\u0131nda sendika g\u00f6r\u00fc\u015f\u00fc al\u0131n\u0131r.<\/p>\n<p style=\"text-align: justify;\">f) \u0130li\u015fik kesme durumu hari\u00e7, i\u015fveren \u00e7al\u0131\u015fan\u0131n onay\u0131 olmadan, \u00e7al\u0131\u015fan\u0131n \u00fccretinden alaca\u011f\u0131n\u0131 mahsup edemez.<\/p>\n<p style=\"text-align: justify;\">g) \u0130\u015fveren, sendikal \u00e7al\u0131\u015fmalar konusunda \u00e7al\u0131\u015fanlara ve sendikaya, sendikay\u0131 temsil yetkisine sahip ki\u015filere her t\u00fcrl\u00fc kolayl\u0131\u011f\u0131 sa\u011flar.<\/p>\n<p style=\"text-align: justify;\">h) \u0130\u015fveren, \u00e7al\u0131\u015fanlar\u0131 ilgilendiren her t\u00fcrl\u00fc mevzuat ve s\u00fcreli yay\u0131nlar\u0131 sendika ve konfederasyona g\u00f6nderir.<\/p>\n<p style=\"text-align: justify;\">i) \u00c7al\u0131\u015fanlar, g\u00f6revlerini yaparken \u00f6zel ve t\u00fczel \u00fc\u00e7\u00fcnc\u00fc ki\u015filere zarar vermeleri halinde aleyhlerine a\u00e7\u0131lacak davalarda i\u015fveren hukuki destek sa\u011flar.<\/p>\n<p style=\"text-align: justify;\">j) \u00c7al\u0131\u015fanlar, yasalarla d\u00fczenlenmi\u015f stat\u00fc, teknik e\u011fitim ve unvanl\u0131 kadrolar\u0131 d\u0131\u015f\u0131nda her ne sebeple olursa olsun ba\u015fka kadro ve stat\u00fclerde \u00e7al\u0131\u015ft\u0131r\u0131lamaz.<\/p>\n<p style=\"text-align: justify;\">k) Sendika temsilcileri, kendi g\u00f6rev alanlar\u0131na giren konular\u0131 g\u00f6r\u00fc\u015fmek \u00fczere, i\u015fveren veya vekillerinden toplant\u0131 talebinde bulunabilirler. Ola\u011fan\u00fcst\u00fc bir sebep olmad\u0131k\u00e7a, yaz\u0131l\u0131 olarak ba\u015fvurduklar\u0131 tarihten itibaren 3 (\u00fc\u00e7) i\u015fg\u00fcn\u00fc i\u00e7inde talep yerine getirilir.<\/p>\n<p style=\"text-align: justify;\">l) \u00d6zel yasalar\u0131 bulunan sanat kurumlar\u0131n\u0131n disiplin kurullar\u0131nda sendika temsilcisi yer al\u0131r.<\/p>\n<p style=\"text-align: justify;\">m)\u0130\u015fveren sendikal bildiri, gazete, dergi ve benzeri materyallerin, i\u015fyerlerinde engellenmeden da\u011f\u0131t\u0131m\u0131 i\u00e7in gerekli tedbirleri al\u0131r.<\/p>\n<p style=\"text-align: justify;\">n) \u0130\u015fveren, \u00e7al\u0131\u015fanlar\u0131n aidat kesinti listesini 4688 Say\u0131l\u0131 Yasa h\u00fck\u00fcmlerine g\u00f6re sendikaya zaman\u0131nda ve d\u00fczenli olarak vermekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p style=\"text-align: justify;\">o) \u0130\u015fyerinde mevcut ve olu\u015fturulacak kurul ve komisyonlarda i\u015fveren ve sendika e\u015fit say\u0131da temsilci bulundurur.<\/p>\n<p style=\"text-align: justify;\">MADDE 10-\u0130\u015eYER\u0130OLANAKLARINDANYARARLANMA<\/p>\n<p style=\"text-align: justify;\">\u0130\u015fveren, sendika, \u015fube ve i\u015fyeri temsilcilerinin talepleri do\u011frultusunda i\u015fyerlerinde yap\u0131lacak olan e\u011fitim, seminer, konferans, tiyatro ve di\u011fer etkinliklerde salon, ara\u00e7 ve gere\u00e7lerini \u00fccretsiz kulland\u0131r\u0131r.<\/p>\n<p style=\"text-align: justify;\">MADDE 11-\u0130\u015eYER\u0130NDE SEND\u0130KAL \u00c7ALI\u015eMALAR<\/p>\n<p style=\"text-align: justify;\">a) Sendikan\u0131n merkez ve \u015fube y\u00f6neticileri ya da g\u00f6revlendirece\u011fi ki\u015filer, i\u015fverenle her zaman g\u00f6r\u00fc\u015febilir. Ayn\u0131 zamanda, i\u015fyerindeki sendika \u00fcyeleri ve \u00e7al\u0131\u015fanlar ile de her zaman g\u00f6r\u00fc\u015febilir.<\/p>\n<p style=\"text-align: justify;\">b) Kamu \u00e7al\u0131\u015fanlar\u0131, sendikal faaliyetlerinden \u00f6t\u00fcr\u00fc hi\u00e7bir ceza ve farkl\u0131 uygulamaya tabi tutulamazlar.<\/p>\n<p style=\"text-align: justify;\">MADDE 12- SEND\u0130KAL \u0130Z\u0130NLER<\/p>\n<p style=\"text-align: justify;\">a) Sendika temsilci ve g\u00f6revlilerine kongre, konferans, seminer, y\u00f6netim, denetim, genel kurul ve temsilciler kurulu gibi sendikal toplant\u0131lara kat\u0131lmalar\u0131 i\u00e7in, sendikan\u0131n veya \u015fubesinin yaz\u0131l\u0131 talebi \u00fczerine \u00fccretli idari izin verilir. Verilecek izinler di\u011fer yasal izinlerden mahsup edilemez.<\/p>\n<p style=\"text-align: justify;\">b) Sendikan\u0131n yurt i\u00e7i ve yurt d\u0131\u015f\u0131nda d\u00fczenleyece\u011fi her t\u00fcrl\u00fc e\u011fitim, seminer, konferans vb. toplant\u0131lar\u0131na kat\u0131lacak sendika \u00fcyelerine e\u011fitim s\u00fcresi ve yol s\u00fcresi dikkate al\u0131narak \u00fccretli idari izin verilir.<\/p>\n<p style=\"text-align: justify;\">c) Sendika ve \u015fube y\u00f6neticileri ile i\u015f yeri temsilcileri, amirine bilgi vermek ko\u015fulu ile sendikal faaliyetler i\u00e7in i\u015fyerinden ayr\u0131labilir.<\/p>\n<p style=\"text-align: justify;\">MADDE 13-\u0130\u015eYER\u0130 SEND\u0130KATEMS\u0130LC\u0130L\u0130\u011e\u0130:<\/p>\n<p style=\"text-align: justify;\">a) \u0130\u015fyeri sendika temsilcileri sendika t\u00fcz\u00fc\u011f\u00fcne g\u00f6re i\u015fyerinde \u00e7al\u0131\u015fan \u00fcyeler taraf\u0131ndan belirlenir.<\/p>\n<p style=\"text-align: justify;\">b) \u0130\u015fveren vekili, temsilci se\u00e7imi i\u00e7in gerekli mekan\u0131 temin eder.<\/p>\n<p style=\"text-align: justify;\">c) \u0130\u015fyeri sendika temsilcileri, i\u015fyerinde \u00e7al\u0131\u015fan \u00fcyelerin yasa ve bu s\u00f6zle\u015fmeden do\u011fan haklar\u0131n\u0131n tam ve eksiksiz uygulan\u0131p uygulanmad\u0131\u011f\u0131n\u0131 takip etmek, bu konuyla ilgili \u00fcyelerden gelecek dilek ve \u015fik\u00e2yetleri, i\u015fveren veya vekiliyle g\u00f6r\u00fc\u015f\u00fcr ve \u00e7\u00f6z\u00fcme ba\u011flar.<\/p>\n<p style=\"text-align: justify;\">d) \u0130\u015fyeri sendika temsilcileri \u00fcyeler ve \u00e7al\u0131\u015fanlarla ihtiya\u00e7 duyduklar\u0131nda g\u00f6r\u00fc\u015febilirler. Bu g\u00f6r\u00fc\u015fmeler toplant\u0131 bi\u00e7iminde de yap\u0131labilir.<\/p>\n<p style=\"text-align: justify;\">MADDE14-DUYURUPANOSUVESEND\u0130KATEMS\u0130LC\u0130L\u0130KODASI:<\/p>\n<p style=\"text-align: justify;\">a) Duyuru Panosu:<\/p>\n<p style=\"text-align: justify;\">Sendika ilan tahtas\u0131n\u0131n i\u015fyerlerinde i\u015fveren taraf\u0131ndan yapt\u0131r\u0131larak bulundurulmas\u0131 zorunludur. \u0130lan tahtalar\u0131n\u0131n personelin toplu giri\u015flerinin bulundu\u011fu yerlerde as\u0131lmas\u0131na dikkat edilir.<\/p>\n<p style=\"text-align: justify;\">b) Temsilcilik odas\u0131:<\/p>\n<p style=\"text-align: justify;\">\u0130\u015fyerlerinde temsilcilik odas\u0131 bulundurulmas\u0131 zorunludur. Mekan olarak fiilen oda bulundurulamayan k\u00fc\u00e7\u00fck i\u015fyerlerinde haftan\u0131n belli bir g\u00fcn\u00fcn\u00fcn, belli bir b\u00f6l\u00fcm\u00fcnde i\u015fyeri odalar\u0131ndan birisi sendikaya tahsis edilir. B\u00fcy\u00fck i\u015fyerlerinde temsilcilik odas\u0131nda sendikan\u0131n uygun g\u00f6rece\u011fi demirba\u015flar bulundurulur. Sendika odas\u0131na dahili telefon hatt\u0131 \u00e7ekilir. Sendika isterse, ayr\u0131ca telefon hatt\u0131 tahsis edebilir.<\/p>\n<p style=\"text-align: justify;\">MADDE15-SEND\u0130KAVE\u015eUBEY\u00d6NET\u0130C\u0130LER\u0130\u0130LESEND\u0130KA\u0130\u015eYER\u0130<\/p>\n<p style=\"text-align: justify;\">TEMS\u0130LC\u0130LER\u0130 VE \u0130\u015eYER\u0130 SEND\u0130KATEMS\u0130LC\u0130LER\u0130N\u0130NG\u00dcVENCES\u0130<\/p>\n<p style=\"text-align: justify;\">a) \u0130\u015fyerinde \u00e7al\u0131\u015fan \u015fube y\u00f6netim, denetleme, disiplin kurullar\u0131,\u015fubeye ba\u011fl\u0131 il ve il\u00e7e temsilcilik y\u00f6netim kurulu \u00fcyeleri ile i\u015fyeri sendika, sendika i\u015f yeri temsilcileri ve \u00fcyeler, sendikal faaliyetleri nedeni ile cezaland\u0131r\u0131lamaz, r\u0131zalar\u0131 d\u0131\u015f\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131 birim, k\u0131s\u0131m ya da i\u015fyeri de\u011fi\u015ftirilemez, meslekleri ile ilgili olmayan bir g\u00f6rev verilemez ya da ba\u015fka bir i\u015fyerine ge\u00e7ici veya daimi olarak g\u00f6revlendirilemezler.<\/p>\n<p style=\"text-align: justify;\">b) Profesyonel sendika y\u00f6neticili\u011fi sona eren merkez ve \u015fube y\u00f6neticileri, y\u00f6neticilik g\u00f6revinin sona ermesinden itibaren bir ay i\u00e7erisinde eski g\u00f6rev yerine ba\u015flat\u0131l\u0131r. Bu haktan sendikal g\u00f6revlerinden dolay\u0131 h\u00fck\u00fcm giymi\u015f olan y\u00f6neticiler de yararlan\u0131r.<\/p>\n<p style=\"text-align: justify;\">MADDE 16- Sendika, \u00f6zel yasas\u0131 olan kurumlar dahil b\u00fct\u00fcn disiplin ve y\u00fcksek disiplin kurullar\u0131nda sendika temsilcisi ve sendikan\u0131n iste\u011fi halinde avukat bulundurur.10<\/p>\n<p style=\"text-align: justify;\">2- B\u00d6L\u00dcM<\/p>\n<p style=\"text-align: justify;\">MAL\u0130HAKLAR<\/p>\n<p style=\"text-align: justify;\">MADDE 17- 25 y\u0131l ile s\u0131n\u0131rland\u0131r\u0131lan k\u0131dem ayl\u0131k s\u0131n\u0131r\u0131 kald\u0131r\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">Her y\u0131l i\u00e7in 20 puan olarak belirlenen rakam 150 puana \u00e7\u0131kar\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">MADDE 18- Emekli sand\u0131\u011f\u0131 kanununun 70. Maddesinde yer alan &#8220;yol gibi a\u00e7\u0131k \u00e7al\u0131\u015fma mahallerinde&#8221; ifadesinden sonra gelecek \u015fekilde &#8220;ara\u015ft\u0131rma ya da inceleme yapmak ve gezici k\u00fct\u00fcphane hizmeti vermek ifadesi getirilir.<\/p>\n<p style=\"text-align: justify;\">MADDE 46- K\u00fct\u00fcphanecilere, depolarda \u00e7al\u0131\u015fan di\u011fer personele, m\u00fczeler ve laboratuarlar\u0131nda \u00e7al\u0131\u015fan personele, sanat kurumlar\u0131ndaki at\u00f6lyelerde \u00e7al\u0131\u015fan personele 575 puan i\u015f riski zamm\u0131 verilir.<\/p>\n<p style=\"text-align: justify;\">MADDE 47- K\u00fct\u00fcphaneler ve M\u00fczelerde haftal\u0131k 40 saati ge\u00e7en \u00e7al\u0131\u015fma saatleri fazla mesai ile \u00fccretlendirilir.<\/p>\n<p style=\"text-align: justify;\">MADDE 48- Hukuken \u00f6denmesi zorunlu g\u00f6r\u00fclen yolluk ve harc\u0131rahlar ilgili personele \u00f6denir.<\/p>\n<p style=\"text-align: justify;\">MADDE 49- ikamet adresine uzak olan 4\/C&#8217;li personele, g\u00f6rev yerlerinin 6245 say\u0131l\u0131 kanunda tan\u0131mland\u0131\u011f\u0131 \u015fekilde memuriyet mahallinin d\u0131\u015f\u0131nda Madde (E) bendinin; Mill\u00ee Savunma Bakanl\u0131\u011f\u0131nca belirlenecek esaslar \u00e7er\u00e7evesinde; Devlet Opera ve Balesi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc ile G\u00fczel Sanatlar Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn teklifi \u00fczerine, Baletlerin ve Devlet Halk Danslar\u0131<\/p>\n<p style=\"text-align: justify;\">Toplulu\u011fu Erkek dans\u00e7\u0131lar\u0131n\u0131n, 38 ya\u015f\u0131n\u0131 doldurduklar\u0131 y\u0131l\u0131n sonuna kadar, askere celp ve sevkleri tehir edilir.20<\/p>\n<p style=\"text-align: justify;\">3- B\u00d6L\u00dcM<\/p>\n<p style=\"text-align: justify;\">SOSYAL HAKLAR<\/p>\n<p style=\"text-align: justify;\">MADDE 78 &#8211; YASAL \u0130Z\u0130NLER VE TAT\u0130LLER<\/p>\n<p style=\"text-align: justify;\">a) H\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015f izinler: Evlilik, do\u011fum, \u00f6l\u00fcm ve s\u00fct izinleri yasada var olan \u015fekli ile hi\u00e7bir uyar\u0131ya gerek kalmaks\u0131z\u0131n uygulan\u0131r.<\/p>\n<p style=\"text-align: justify;\">b) E\u011fitim izni: \u00c7al\u0131\u015fan\u0131n bir \u00fcst \u00f6\u011frenim kurumuna devam etmesi halinde lisans, y\u00fcksek lisans ve doktora i\u00e7in s\u00fcreleri kadar<\/p>\n<p style=\"text-align: justify;\">\u00fccretsiz izin verilir. \u0130ste\u011fi halinde \u00f6\u011frenim g\u00f6rd\u00fc\u011f\u00fc \u0130l&#8217;e (\u00d6zel yasalar\u0131 olan kurumlarda \u00e7al\u0131\u015fanlar dahil) atamas\u0131 yap\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">c) Y\u0131ll\u0131k izinler: \u00c7al\u0131\u015fanlar\u0131n kulland\u0131\u011f\u0131 y\u0131ll\u0131k izinler i\u015f g\u00fcn\u00fc esas al\u0131narak verilir.<\/p>\n<p style=\"text-align: justify;\">d) \u0130l d\u0131\u015f\u0131na \u00e7\u0131kma izni: Sanat kurumlar\u0131nda programda \u00e7al\u0131\u015fmas\u0131 olmayan idari s\u00f6zle\u015fmeli personele il d\u0131\u015f\u0131na \u00e7\u0131kma izni verilir.<\/p>\n<p style=\"text-align: justify;\">e) Do\u011fal Afet \u0130zni: Do\u011fal afet durumlar\u0131nda kamu \u00e7al\u0131\u015fanlar\u0131, sendikalar\u0131n ve m\u00fclki amirlerin birlikte belirleyece\u011fi y\u00f6ntemle ve s\u00fcrede \u00fccretli izinli say\u0131l\u0131rlar.<\/p>\n<p style=\"text-align: justify;\">f) Tatiller:<\/p>\n<p style=\"text-align: justify;\">\u2022 1 May\u0131s: \u00d6zel yasalar\u0131 bulunan sanat kurumlar\u0131nda, idari<\/p>\n<p style=\"text-align: justify;\">s\u00f6zle\u015fmeli personel 1May\u0131s Emek ve Dayan\u0131\u015fma G\u00fcn\u00fcnde \u00fccretli izinli say\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u2022 8Mart:D\u00fcnya Emek\u00e7i Kad\u0131nlar G\u00fcn\u00fcnde kad\u0131n \u00e7al\u0131\u015fanlar \u00fccretli izinli say\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">MADDE 79- KURUM OLANAKLARINDAN FAYDALANMA<\/p>\n<p style=\"text-align: justify;\">a) \u0130\u015fverenin lojman, kamp, kre\u015f ve benzeri her t\u00fcrl\u00fc sosyal tesislerinden \u00e7al\u0131\u015fanlar, e\u015f ve \u00e7ocuklar\u0131 \u00fccretsiz olarak yararlan\u0131r.<\/p>\n<p style=\"text-align: justify;\">b) K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131na ba\u011fl\u0131 sanat kurumlar\u0131n\u0131n sahneledi\u011fi eserlerden \u00e7al\u0131\u015fanlar, e\u015f ve \u00e7ocuklar\u0131 indirimli yararlan\u0131r.<\/p>\n<p style=\"text-align: justify;\">c) K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131 denetiminde olan belgeli turizm tesislerinde, \u00e7al\u0131\u015fanlar\u0131na indirimli hizmet verilmesini sa\u011flar.<\/p>\n<p style=\"text-align: justify;\">d) \u0130\u015fveren, \u00e7al\u0131\u015fan\u0131n ihtiyac\u0131 halinde hastalanma, cenaze vb. durumlarda kurumun ara\u00e7lar\u0131ndan \u00fccretsiz yararland\u0131r\u0131r.<\/p>\n<p style=\"text-align: justify;\">e) B\u00fcy\u00fck \u015fehirlerde misafirhaneler a\u00e7\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">MADDE 80-ULA\u015eIM:<\/p>\n<p style=\"text-align: justify;\">a) \u0130\u015fveren merkez ve ta\u015fra te\u015fkilat\u0131nda \u00e7al\u0131\u015fanlar\u0131n\u0131n ula\u015f\u0131m\u0131n\u0131 sa\u011flamak amac\u0131yla servis arac\u0131n\u0131 hizmete koyar. T\u00fcm \u00e7al\u0131\u015fanlar bu hizmetten \u00fccretsiz olarak faydalan\u0131r. G\u00fczerg\u00e2h sendika temsilcisi ile ortak belirlenir. Sanat kurumlar\u0131nda \u00e7al\u0131\u015fan personelin, \u00e7al\u0131\u015fma saatlerine uygun servis verilir.<\/p>\n<p style=\"text-align: justify;\">b) \u0130\u015fveren, mesai saatleri d\u0131\u015f\u0131nda ve resmi tatillerde g\u00f6reve \u00e7a\u011f\u0131rd\u0131\u011f\u0131 personele ara\u00e7 tahsis eder.<\/p>\n<p style=\"text-align: justify;\">c) Yukar\u0131da belirtilen hususlar\u0131n i\u015fverence yerine getirilememesi halinde i\u015fveren yerel y\u00f6netimlerin toplu ta\u015f\u0131ma ara\u00e7lar\u0131ndan yararlanmas\u0131n\u0131 sa\u011flar. Bunun da ger\u00e7ekle\u015ftirilememesi durumunda, \u00e7al\u0131\u015fma g\u00fcn say\u0131s\u0131 dikkate al\u0131narak, gidi\u015f-d\u00f6n\u00fc\u015f olmak \u00fczere hesaplanacak tutarda yol \u00fccretini \u00e7al\u0131\u015fanlara nakden \u00f6der.<\/p>\n<p style=\"text-align: justify;\">MADDE 81-KRE\u015e:<\/p>\n<p style=\"text-align: justify;\">a) En az 50 \u00e7al\u0131\u015fan\u0131 olan i\u015fyerleri ile 50&#8217;den az \u00e7al\u0131\u015fan\u0131 olan birbirine yak\u0131n i\u015fyerleri birle\u015ftirilerek kre\u015f a\u00e7\u0131l\u0131r ve bu hizmetten t\u00fcm \u00e7al\u0131\u015fanlar\u0131n \u00e7ocuklar\u0131 \u00fccretsiz yararland\u0131r\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">b) Sanat kurumlar\u0131nda \u00e7al\u0131\u015fan s\u00f6zle\u015fmeli personelin \u00e7al\u0131\u015fma saatlerine uygun esneklikte \u00e7ocuk bak\u0131m evleri olu\u015fturulur.<\/p>\n<p style=\"text-align: justify;\">MADDE 82- YEMEK YARDIMI<\/p>\n<p style=\"text-align: justify;\">a) Yemekler ve yemekhane i\u015fveren ve sendikan\u0131n e\u015fit say\u0131da belirleyece\u011fi ki\u015filerden olu\u015fan bir komisyon taraf\u0131ndan 22denetlenir. Komisyon toplu s\u00f6zle\u015fmenin imzalanmas\u0131ndan sonraki 30 (otuz) g\u00fcn i\u00e7erisinde olu\u015fturulur. Komisyon ayl\u0131k olarak i\u015fverene ve sendikaya rapor verir.<\/p>\n<p style=\"text-align: justify;\">b) 50 \u00e7al\u0131\u015fan\u0131n alt\u0131nda kalan ve yemekhane olmayan birimlerde, yemek \u00f6deneklerinin en yak\u0131n\u0131ndaki kamu kurumuna aktar\u0131larak \u00e7al\u0131\u015fanlar\u0131n yemek hizmetinden yararlanmas\u0131 sa\u011flan\u0131r. Ger\u00e7ekle\u015ftirilememesi halinde yemek firmalar\u0131ndan hizmet al\u0131m\u0131 yap\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">c) Sanat kurumlar\u0131ndaki t\u00fcm s\u00f6zle\u015fmeli personel 657 Say\u0131l\u0131<\/p>\n<p style=\"text-align: justify;\">Kanun&#8217;a tabi personel gibi yemek hizmetinden yararland\u0131r\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">d) 657 4\/A kapsam\u0131 d\u0131\u015f\u0131ndaki kamu g\u00f6revlilerine de yemek ia\u015fe bedelinden yararland\u0131r\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">MADDE 83-G\u0130Y\u0130M YARDIMI<\/p>\n<p style=\"text-align: justify;\">a) Merkez Laboratuvar\u0131 ve Anadolu Medeniyetleri M\u00fczesinde bulunan Laboratuvarlarda \u00e7al\u0131\u015fan personele giyim yard\u0131m\u0131 yap\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">b) Giyim yard\u0131m\u0131 bedelleri %30 oran\u0131nda artt\u0131r\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">c) Devlet Opera ve Balesi Orkestra sanat\u00e7\u0131lar\u0131na her y\u0131l eyl\u00fcl ay\u0131nda siyah smokin &#8211; siyah tuvalet ve siyah ayakkab\u0131 verilir.<\/p>\n<p style=\"text-align: justify;\">MADDE 84- MESLEKHASTALIKLARI, \u0130\u015e KAZASI VE \u0130\u015e<\/p>\n<p style=\"text-align: justify;\">G\u00dcVENL\u0130\u011e\u0130<\/p>\n<p style=\"text-align: justify;\">a) Bakanl\u0131k b\u00fcnyesinde, konfederasyon ve sendikalar\u0131n yan\u0131 s\u0131ra konuyla ilgili meslek \u00f6rg\u00fctlerinin ve i\u015fveren temsilcilerinin e\u015fit kat\u0131l\u0131m\u0131yla \u0130\u015f Kazas\u0131 ve Meslek Hastal\u0131\u011f\u0131 Kurulu olu\u015fturulur.<\/p>\n<p style=\"text-align: justify;\">b) Bu kurul taraf\u0131ndan i\u015f kazalar\u0131 ve i\u015f g\u00fcvenli\u011fi ile ilgi konular\u0131 tespit etmek amac\u0131yla Meslek Hastal\u0131klar\u0131, \u0130\u015f Kazas\u0131 ve \u0130\u015f G\u00fcvenli\u011fi T\u00fcz\u00fc\u011f\u00fc olu\u015fturulur. Bu konuda uluslar aras\u0131 standartlara riayet edilir.<\/p>\n<p style=\"text-align: justify;\">c) \u0130\u015fyerlerinde i\u015f g\u00fcvenli\u011fi ile ilgili \u00f6nlemlerin al\u0131nmas\u0131 amac\u0131yla i\u015fveren vekili ve sendika temsilcilerinin e\u015fit kat\u0131l\u0131m\u0131yla &#8220;i\u015f g\u00fcvenli\u011fi kurullar\u0131&#8221; olu\u015fturulur.<\/p>\n<p style=\"text-align: justify;\">d) \u0130\u015f nedeniyle meydana gelen hasar ve zararlar i\u015fveren taraf\u0131ndan kar\u015f\u0131lan\u0131r.<\/p>\n<p style=\"text-align: justify;\">e) \u0130\u015f Kazas\u0131 veya meslek hastal\u0131\u011f\u0131 nedeniyle \u00f6len kamu \u00e7al\u0131\u015fan\u0131n\u0131n<\/p>\n<p style=\"text-align: justify;\">i\u015fsiz e\u015fi veya \u00e7ocu\u011fu veya karde\u015fi ilgili kamu kurumu taraf\u0131ndan i\u015fe al\u0131n\u0131r.<\/p>\n<p style=\"text-align: justify;\">f) Zararl\u0131 kimyasallara maruz kalan \u00e7al\u0131\u015fanlar y\u0131lda bir kez zorunlu sa\u011fl\u0131k taramas\u0131ndan ge\u00e7irilir.<\/p>\n<p style=\"text-align: justify;\">g) Bakanl\u0131k b\u00fcnyesinde olan laboratuarlar, m\u00fczeler, k\u00fct\u00fcphaneler ve sanat kurumlar\u0131nda s\u00fcrekli radyoaktif, zehirli ve tehlikeli maddelerle \u00e7al\u0131\u015f\u0131lan birimlerde gerekli tedbirleri al\u0131r.<\/p>\n<p style=\"text-align: justify;\">h) M\u00fcze ve \u00d6ren yerlerinin gerekli g\u00fcvenlik donan\u0131mlar\u0131 sa\u011flan\u0131r.<\/p>\n<p style=\"text-align: justify;\">i) T\u00fcm sahnelerde, oyun saatlerinde sa\u011fl\u0131k g\u00f6revlisi bulundurulur.<\/p>\n<p style=\"text-align: justify;\">j) Devlet Tiyatrolar\u0131 ve Devlet Opera ve Balesine ait at\u00f6lyelerin<\/p>\n<p style=\"text-align: justify;\">\u015fehre olan uzakl\u0131\u011f\u0131 nedeniyle sa\u011fl\u0131k g\u00f6revlisi s\u00fcrekli haz\u0131r bulundurulur.<\/p>\n<p style=\"text-align: justify;\">k) Devlet Halk Danslar\u0131 Toplulu\u011funda mas\u00f6r kadrosu ihdas edilir.<\/p>\n<p style=\"text-align: justify;\">l) \u0130\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi mevzuat\u0131na g\u00fcr\u00fclt\u00fc ve y\u00fck ta\u015f\u0131ma y\u00f6netmelikleri eklenir.<\/p>\n<p style=\"text-align: justify;\">m)Sanat kurumlar\u0131nda &#8220;a\u011f\u0131r i\u015f yapamaz&#8221; heyet raporu alan<\/p>\n<p style=\"text-align: justify;\">personel uygun bir birime verilir ve a\u011f\u0131r i\u015f verilemez.<\/p>\n<p style=\"text-align: justify;\">MADDE 85- Kamu g\u00f6revlilerinin \u00e7al\u0131\u015fma alanlar\u0131nda kameralarla izlenmesi uygulamas\u0131na son verilir.<\/p>\n<p style=\"text-align: justify;\">MADDE 86- Engelli personelin \u00e7al\u0131\u015fma ortam ve \u015fartlar\u0131 uluslar aras\u0131 kriterlere uygun olarak d\u00fczenlenir.<\/p>\n<p style=\"text-align: justify;\">MADDE 87- Fazla Mesai:<\/p>\n<p style=\"text-align: justify;\">a) Devlet Tiyatrolar\u0131 Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcnde, saat 24.00&#8217;ten sonra prova yap\u0131lamaz, 24.00&#8217;ten sonra prova yap\u0131l\u0131rsa 1 g\u00fcnl\u00fck mesai \u00fccreti \u00f6denir.<\/p>\n<p style=\"text-align: justify;\">b) Sanat kurumlar\u0131n\u0131n sahnelerinin \u00f6zel kurumlara tahsis edilmesi halinde, Salon tahsisinde g\u00f6revlendirilen personele e\u015fit \u00f6denmek \u00fczere 2012 y\u0131l\u0131 i\u00e7in 75 TL, 2013 y\u0131l\u0131 i\u00e7in 100 TL \u00f6denir.<\/p>\n<p style=\"text-align: justify;\">c) Devlet Opera ve Balesi ile Devlet Tiyatrolar\u0131 Genel M\u00fcd\u00fcrl\u00fcklerinde \u00e7al\u0131\u015fan \u0130dari s\u00f6zle\u015fmeli personele haftal\u0131k izinleri verilir, izin ertelenirse 1 g\u00fcnl\u00fck mesai \u00fccreti verilir.<\/p>\n<p style=\"text-align: justify;\">d) Sanat kurumlar\u0131n\u0131n turnelerinde, 450 kmden uzak yerlere karayoluyla gidilmesi halinde, gidilen g\u00fcn \u00e7al\u0131\u015fma yap\u0131lmaz, \u00e7al\u0131\u015fma gerekliyse bir g\u00fcn \u00f6nceden gidilir.<\/p>\n<p style=\"text-align: justify;\">e) Sanat kurumlar\u0131nda, turne d\u00f6n\u00fc\u015f\u00fcnde ayn\u0131 g\u00fcn turne g\u00f6revlilerine i\u015f yapt\u0131r\u0131lamaz, yapt\u0131r\u0131l\u0131rsa 1 g\u00fcnl\u00fck mesai \u00fccreti \u00f6denir.<\/p>\n<p style=\"text-align: justify;\">MADDE 88- Y\u00fcr\u00fcrl\u00fck ve imza;<\/p>\n<p style=\"text-align: justify;\">a) 88 esas maddeden olu\u015fan ve&#8230;.. \/ &#8230;. \/ 201 tarihinde, taraflarca<\/p>\n<p style=\"text-align: justify;\">4 suret olarak imzalanan bu Toplu \u0130\u015f S\u00f6zle\u015fmesi &#8230;.. \/ &#8230;. \/ 201&#8230;. tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girer ve &#8230;.. \/ &#8230;. \/ 201&#8230;
