Art\u0131k abuk gerek\u00e7eleri, keyfi ceza ve soru\u015fturmalar\u0131 \u00e7\u00f6pe ats\u0131nlar.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; line-height: 13.5pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">AYM bireysel ba\u015fvuru kapsam\u0131nda kamu g\u00f6revlilerinin grev hakk\u0131 ile ilgili son derece ya\u015famsal bir karar verdi. Kamu g\u00f6revlilerinin grevi de i\u00e7eren toplu eylem hakk\u0131 yeni bir g\u00fcvenceye daha kavu\u015ftu.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; line-height: 13.5pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">AYM, E\u011fitim Sen \u00fcyesi bir \u00f6\u011fretmenin, sendika y\u00f6netim kurulu taraf\u0131ndan 4+4+4 olarak bilinen e\u011fitime ili\u015fkin yasal d\u00fczenlemeleri protesto etmek amac\u0131yla 28-29 Mart 2012 tarihlerinde \u00fclke \u00e7ap\u0131nda \u201cuyar\u0131 grevi\u201d yap\u0131lmas\u0131na d\u00f6n\u00fck karar\u0131na uyarak greve gitti\u011fi i\u00e7in uyarma cezas\u0131 ile cezaland\u0131r\u0131lmas\u0131n\u0131 Anayasan\u0131n 51. maddesindeki grev hakk\u0131n\u0131n ihlali sayd\u0131. AYM \u0130kinci B\u00f6l\u00fcm\u00fcn\u00fcn 18\/9\/2014 tarihinde verdi\u011fi 2013\/8463 ba\u015fvuru numaral\u0131 karar\u0131 4 Aral\u0131k 2014 tarihli Resmi Gazete\u2019de yay\u0131mland\u0131.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; line-height: 13.5pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">Daha \u00f6nce Dan\u0131\u015ftay taraf\u0131ndan benzer kararlar verilmi\u015f olmas\u0131na ve bu konuda idari yarg\u0131 i\u00e7tihad\u0131 olu\u015fmas\u0131na ra\u011fmen bu karar AYM d\u00fczeyinde verilen ilk karar olma niteli\u011fini ta\u015f\u0131yor. AYM, Devlet Memurlar\u0131 Yasas\u0131\u2019nda yer alan grev yasa\u011f\u0131n\u0131 kad\u00fck saym\u0131\u015f ve Anayasan\u0131n 51. Maddesindeki sendika hakk\u0131n\u0131 ILO S\u00f6zle\u015fmeleri, \u0130nsan Haklar\u0131 Avrupa Mahkemesi kararlar\u0131 ve Avrupa Sosyal \u015eart\u0131 \u00e7er\u00e7evesinde \u00f6zg\u00fcrl\u00fck\u00e7\u00fc bir bi\u00e7imde yorumlam\u0131\u015ft\u0131r.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; line-height: 13.5pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">AYM karar\u0131nda \u015f\u00f6yle demektedir: \u201cAnayasa\u2019n\u0131n 51-54. Maddelerinde d\u00fczenlenen sendikal hak ve \u00f6zg\u00fcrl\u00fckler, benzer g\u00fcvenceler getiren ba\u015fka \u00d6rg\u00fctlenme \u00d6zg\u00fcrl\u00fc\u011f\u00fc ile \u00d6rg\u00fctlenme ve Toplu Pazarl\u0131k Hakk\u0131 S\u00f6zle\u015fmesi olmak \u00fczere ilgili Uluslararas\u0131 \u00c7al\u0131\u015fma \u00d6rg\u00fct\u00fc (ILO) s\u00f6zle\u015fmeleri ve Avrupa Sosyal \u015eart\u0131 ile tamamlanmaktad\u0131r. Anayasan\u0131n 51-54. maddelerinde d\u00fczenlenen sendikal hak ve \u00f6zg\u00fcrl\u00fcklerin kapsam\u0131 yorumlan\u0131rken bu belgelerde yer alan ve ilgili organlar taraf\u0131ndan yorumlanan g\u00fcvencelerin de g\u00f6z \u00f6n\u00fcne al\u0131nmas\u0131 gerekir.\u201d<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; line-height: 13.5pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">AYM\u2019nin bu yorumu sendikal hak ve \u00f6zg\u00fcrl\u00fckler i\u00e7in \u00f6nemli bir a\u00e7\u0131l\u0131m getirmekte ve bu haklar\u0131n uluslararas\u0131 insan haklar\u0131 s\u00f6zle\u015fmeleri ile birlikte ele al\u0131nmas\u0131 gere\u011finin alt\u0131n\u0131 \u00e7izmektedir. AYM\u2019nin bu yorumu herkes i\u00e7in ba\u011flay\u0131c\u0131d\u0131r.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; line-height: 13.5pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">AYM karar\u0131nda, demokratik bir toplumda ordu, emniyet ve ba\u015fka baz\u0131 sekt\u00f6rlerde sendikal faaliyete s\u0131n\u0131rlar getirilmesinin m\u00fcmk\u00fcn oldu\u011funu ancak ba\u015fvurucunun bir devlet okulunda \u00f6\u011fretmen oldu\u011fu g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda memurlar\u0131n bu haktan t\u00fcm\u00fcyle mahrum b\u0131rak\u0131lamayacaklar\u0131n\u0131 belirtmektedir.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; line-height: 13.5pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">Mahkeme karar\u0131nda \u201cverilen uyarma cezas\u0131 hafif olsa da ba\u015fvurucu gibi sendikaya \u00fcye ki\u015fileri, \u00e7\u0131karlar\u0131n\u0131 savunmak amac\u0131yla yap\u0131lan me\u015fru grev veya eylem g\u00fcnlerine kat\u0131lmaktan vazge\u00e7irecek niteli\u011fe sahiptir\u201d g\u00f6r\u00fc\u015f\u00fcne yer verilmi\u015ftir. Mahkeme, hafif olsa da uyarma cezas\u0131n\u0131n \u201cdemokratik bir toplumda gerekli olmad\u0131\u011f\u0131\u201d sonucu varm\u0131\u015f ve bu cezayla Anayasa\u2019n\u0131n 51. Maddesi\u2019nde g\u00fcvence alt\u0131na al\u0131nan sendika hakk\u0131n\u0131n ihlal edildi\u011fine karar vermi\u015ftir.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; line-height: 13.5pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">AYM\u2019nin verdi\u011fi karar ilkesel ve emsal niteliktedir ve benzer ihlaller i\u00e7in de ge\u00e7erlidir. Bu nedenle grev hakk\u0131n\u0131n kullan\u0131m\u0131 nedeniyle a\u00e7\u0131lan benzer soru\u015fturmalar\u0131n durdurulmas\u0131 ve verilen idari cezalar\u0131n kald\u0131r\u0131lmas\u0131 gereklidir.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; line-height: 13.5pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">Bilindi\u011fi gibi k\u0131sa bir s\u00fcre \u00f6nce AYM, 6356 say\u0131l\u0131 yasadaki grev yasaklar\u0131ndan baz\u0131lar\u0131 (bankac\u0131l\u0131k ve \u015fehiri\u00e7i ula\u015f\u0131m) iptal ederek \u00f6nemli bir ad\u0131m atm\u0131\u015ft\u0131. Bu yeni karar\u0131 ile grev hakk\u0131n\u0131 sendika hakk\u0131n\u0131n ayr\u0131lmaz bir par\u00e7as\u0131 olarak de\u011ferlendirmi\u015ftir.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; line-height: 13.5pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">AYM karar\u0131 sonras\u0131nda bo\u015f ve bilgisiz tart\u0131\u015fmalar ile hukuksuz uygulamalar bitmelidir. Kamu g\u00f6revlisinin grev hakk\u0131 en \u00fcst d\u00fczeyde tescil edilmi\u015ftir. Kamu g\u00f6revlileri grev hakk\u0131n\u0131 kullan\u0131rken art\u0131k yeni bir g\u00fcvenceye daha sahiptir.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; line-height: 13.5pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">AYM bu karar\u0131yla, bir yasa haz\u0131rl\u0131\u011f\u0131na ve bir h\u00fck\u00fcmet politikas\u0131na kar\u015f\u0131 bir kamu g\u00f6revlileri sendikas\u0131n\u0131n alm\u0131\u015f oldu\u011fu grev karar\u0131n\u0131 hukuka uygun bulmu\u015f ve b\u00f6ylece sendika ve grev hakk\u0131n\u0131 geni\u015f yorumlam\u0131\u015ft\u0131r.
