Daha \u00f6nce defalarca ya\u015fand\u0131\u011f\u0131 \u00fczere; milyonlarca \u00e7al\u0131\u015fan\u0131 ilgilendiren konunun do\u011frudan muhatab\u0131 olan sendikalar s\u00fcrecin d\u0131\u015f\u0131nda b\u0131rak\u0131lm\u0131\u015f, hi\u00e7bir \u015fekilde g\u00f6r\u00fc\u015flerine ba\u015fvurulmam\u0131\u015ft\u0131r. Kapal\u0131 kap\u0131lar ard\u0131nda haz\u0131rlanan, as\u0131l hedefi ta\u015feron \u00e7al\u0131\u015fman\u0131n yasalla\u015ft\u0131r\u0131larak kapsam\u0131n\u0131n daha da geni\u015fletilmesi olan tasar\u0131ya eklenen k\u0131smi olumlu d\u00fczenlemeler vitrine \u00e7\u0131kar\u0131lmakta, kamuoyuna \u201cm\u00fcjde\u201d olarak sunulmaktad\u0131r.<br \/>Oysa ortada \u00e7al\u0131\u015fanlar, emek\u00e7iler a\u00e7\u0131s\u0131ndan bir \u2018m\u00fcjde\u2019 yoktur. Ta\u015feron yasa tasar\u0131s\u0131 ile gelece\u011fi sat\u0131n al\u0131nmak istenen \u00e7al\u0131\u015fanlara \u2018m\u00fcjde\u2019 olarak sunulan \u015fey zehri zorluk \u00e7\u0131karmadan yutmalar\u0131n\u0131 kolayla\u015ft\u0131rmak i\u00e7in \u00fczerine bir ka\u015f\u0131k bal s\u00fcrmekten ibarettir. \u0130\u015fte bunun i\u00e7in Maden i\u015f\u00e7ilerinin \u00e7al\u0131\u015fma s\u00fcrelerinin g\u00fcnde alt\u0131 saate, emeklilik ya\u015f\u0131n\u0131n 50 ye indirilmesi, y\u0131ll\u0131k izinlerinin d\u00f6rt g\u00fcn art\u0131r\u0131lmas\u0131 gibi k\u0131smi olumlu d\u00fczenlemeler i\u00e7eren \u2018Maden Yasa Tasar\u0131s\u0131\u2019 ve \u00e7e\u015fitli primlerin ve idari para cezalar\u0131n\u0131n yeniden yap\u0131land\u0131r\u0131lmas\u0131n\u0131n \u201caf\u201d olarak yans\u0131t\u0131ld\u0131\u011f\u0131 yasa tasar\u0131s\u0131 \u201cTa\u015feron Yasa Tasar\u0131s\u0131\u201d ile birle\u015ftirilmektedir. <br \/>\u00c7al\u0131\u015fma Hayat\u0131n\u0131 Bir B\u00fct\u00fcn Olarak Ta\u015feronla\u015ft\u0131rmay\u0131 Hedefleyen Yasa Tasar\u0131s\u0131n\u0131n Temel D\u00fczenlemelerini K\u0131saca \u00d6zetleyecek Olursak:<\/p>\n<p>\uf0d8 Tasar\u0131, kamu idaresini hileli ta\u015feronluktan kaynakl\u0131 y\u00fcklerden kurtarman\u0131n, ta\u015feron uygulamas\u0131n\u0131 yayg\u0131nla\u015ft\u0131rman\u0131n \u2018hukuki\u2019 k\u0131l\u0131f\u0131d\u0131r. <br \/>Bilindi\u011fi \u00fczere ta\u015feronluk (alt i\u015fverenlik) 4857 say\u0131l\u0131 \u0130\u015f Yasa\u2019s\u0131n\u0131n 2. Maddesinde d\u00fczenlenmi\u015ftir. Buna g\u00f6re alt i\u015fverenli\u011fin (ta\u015feron) yard\u0131mc\u0131 hizmetlerde olmas\u0131 esast\u0131r. As\u0131l i\u015fte ta\u015feron \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 konusunda ise \u00f6nemli k\u0131s\u0131tlamalar s\u00f6z konusudur. As\u0131l i\u015fin t\u00fcm\u00fc alt i\u015fverene devredilemeyece\u011fi gibi devredilecek k\u0131s\u0131m i\u00e7in de \u00fc\u00e7 ko\u015fulun birlikte sa\u011flanmas\u0131 gereklidir. As\u0131l i\u015fin bir b\u00f6l\u00fcm\u00fcnde alt i\u015fveren \u00e7al\u0131\u015ft\u0131r\u0131labilmesi i\u00e7in \u201ci\u015fletmenin ve i\u015fin gere\u011fi ile teknolojik nedenle uzmanl\u0131k gerektiren i\u015fler\u201d gibi \u00fc\u00e7 ko\u015fulun bir arada var olmas\u0131 gerekmektedir.<\/p>\n<p>Bu \u00fc\u00e7 ko\u015ful ayn\u0131 anda yok ise yarg\u0131 ta\u015feron i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rmay\u0131 muvazaa (hile) olarak kabul etmekte ve bu durumdaki \u00e7al\u0131\u015fan\u0131 ba\u015f\u0131ndan itibaren as\u0131l i\u015fverenin \u00e7al\u0131\u015fan\u0131 saymaktad\u0131r. Yani yasada belirtilen \u00fc\u00e7 ko\u015ful bir arada olmadan, as\u0131l i\u015f, ta\u015ferona verilirse bu durumda, \u201cmuvazaa\u201d (hile) olgusu ortaya \u00e7\u0131kmaktad\u0131r. Ta\u015feron istihdam\u0131n kritik noktas\u0131 bu tan\u0131mda d\u00fc\u011f\u00fcmlenmektedir. \u00c7\u00fcnk\u00fc \u0130\u015f Yasas\u0131ndaki mevcut d\u00fczenlemeye ve T\u00fcrkiye\u2019nin on d\u00f6rt y\u0131ld\u0131r alt\u0131nda imzas\u0131 bulunan 94 say\u0131l\u0131 ILO s\u00f6zle\u015fmesine g\u00f6re as\u0131l i\u015fverenin i\u015f\u00e7ilerinin alt i\u015fveren taraf\u0131ndan i\u015fe al\u0131narak \u00e7al\u0131\u015ft\u0131rmaya devam edilmesi suretiyle haklar\u0131 k\u0131s\u0131tlanamaz. Bu durumda as\u0131l i\u015fveren-alt i\u015fveren ili\u015fkisi muvazaal\u0131 (hileli) kabul edilir ve alt i\u015fverenin i\u015f\u00e7ileri ba\u015f\u0131ndan itibaren as\u0131l i\u015fverenin i\u015f\u00e7isi say\u0131larak i\u015flem g\u00f6r\u00fcrler.<\/p>\n<p>Bu d\u00fczenleme hileli ta\u015feron \u00e7al\u0131\u015ft\u0131rman\u0131n en ciddi yapt\u0131r\u0131m\u0131d\u0131r. \u0130\u015f\u00e7iler ve sendikalar taraf\u0131ndan a\u00e7\u0131lan say\u0131s\u0131z davada muvazaa tespit edilmi\u015f ve muvazaal\u0131 i\u015flem konusu i\u015f\u00e7iler as\u0131l i\u015fverenin i\u015f\u00e7isi say\u0131lm\u0131\u015ft\u0131r. \u00d6zellikle \u00e7e\u015fitli kamu kurulu\u015flar\u0131nda yap\u0131lan ta\u015feron uygulamalar\u0131n\u0131n hileli oldu\u011fu ve i\u015f\u00e7ilerin ba\u015f\u0131ndan itibaren kamu kurum ve kurulu\u015funun i\u015f\u00e7isi oldu\u011fu y\u00f6n\u00fcnde \u00e7ok say\u0131da y\u00fcksek yarg\u0131 karar\u0131 mevcuttur. Yarg\u0131 son olarak Karayollar\u0131 Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcnde ta\u015feron olarak istihdam edilen alt\u0131 bin i\u015f\u00e7inin kadroya al\u0131nmas\u0131 karar\u0131n\u0131 vermi\u015ftir. Ayr\u0131ca \u2018muvazaal\u0131\u2019 yani hileli olarak ta\u015feron istihdam ve as\u0131l i\u015fveren durumunda olan kamu kurulu\u015fu idareleri bu davalar sonucunda ciddi oranlarda tazminat \u00f6demeye mahk\u00fbm edilmi\u015ftir. Ancak hukuku \u00e7i\u011fnemeyi adeta tarz haline getirmi\u015f olan AKP iktidar\u0131, yarg\u0131 kararlar\u0131na ra\u011fmen hileli ta\u015feron uygulamas\u0131na keyfi bir bi\u00e7imde devam etmi\u015ftir.<\/p>\n<p>Bu nedenle TBMM\u2019ye sunulan tasar\u0131da Kamu \u0130daresini-Devleti bu mali y\u00fckten kurtarma aray\u0131\u015f\u0131na hukuki k\u0131l\u0131f olarak, alt i\u015fverene, i\u015f\u00e7ilerine as\u0131l i\u015fverenin i\u015f\u00e7ilerine \u00f6denen \u2018emsal \u00fccreti\u2019 \u00f6demesi \u015fart\u0131 ile yasadaki ta\u015feron istihdam s\u0131n\u0131rlar\u0131n\u0131 \u201cihlal etme hakk\u0131\u201d tan\u0131nmaktad\u0131r. Bunun ad\u0131 muvazaal\u0131 (hileli) veya yasaya ayk\u0131r\u0131 alt i\u015fveren \u00e7al\u0131\u015ft\u0131rman\u0131n yapt\u0131r\u0131m\u0131n\u0131 ortadan kald\u0131rmak i\u00e7in hukuksuz i\u015fleme yasall\u0131k kazand\u0131rmakt\u0131r.<\/p>\n<p>B\u00f6ylece as\u0131l i\u015fveren sorumluluktan kurtar\u0131l\u0131rken hukuksuzlu\u011fun yapt\u0131r\u0131m\u0131 azalt\u0131larak ta\u015feron ili\u015fkisinin devaml\u0131l\u0131\u011f\u0131 sa\u011flanmaktad\u0131r. Tasar\u0131 bu haliyle yasala\u015f\u0131rsa bug\u00fcne kadar muvazaal\u0131 (hileli) veya yasaya ayk\u0131r\u0131 olarak ta\u015feron firmalar b\u00fcnyesinde \u00e7al\u0131\u015ft\u0131r\u0131lanlar\u0131n ge\u00e7mi\u015fe d\u00f6n\u00fck hak talep etmesinin zorla\u015faca\u011f\u0131 da a\u00e7\u0131kt\u0131r. <br \/>\uf0d8 Mevcut Haklar \u201cYeni Hak\u201d Gibi Sunuluyor!<\/p>\n<p>Ta\u015feron firmalar b\u00fcnyesinde \u00e7al\u0131\u015fanlar\u0131n sendika hakk\u0131ndan, k\u0131dem tazminat\u0131 hakk\u0131na, i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 g\u00fcvenli\u011fi hakk\u0131ndan, \u00fccret g\u00fcvencesi hakk\u0131na kadar temel haklar\u0131 kullanmas\u0131n\u0131n \u00f6n\u00fcnde hi\u00e7bir engel bulunmamaktad\u0131r. Bu haklar\u0131n \u00e7i\u011fnenmesi, yok say\u0131lmas\u0131 durumunda as\u0131l i\u015fverenin alt i\u015fverenle birlikte (m\u00fcteselsil) sorumlu oldu\u011funa ili\u015fkin onlarca yarg\u0131 karar\u0131 vard\u0131r.<\/p>\n<p>Buna ra\u011fmen tasar\u0131da bu temel haklar sanki \u201cyeni haklar\u201d gibi sunulmaktad\u0131r. Yani \u201cdaha ekonomik\u201d oldu\u011fu i\u00e7in ta\u015feron istihdam\u0131 gittik\u00e7e \u015fi\u015firen AKP iktidar\u0131; \u00e7i\u011fnedi\u011fi yasalarda, yarg\u0131 kararlar\u0131nda zaten yer alan haklar\u0131 kendisi ke\u015ffetmi\u015f\u00e7esine cila olarak kullanmaktad\u0131r. <br \/>\uf0d8 Tasar\u0131 ile Kamuda Ta\u015feron \u0130stihdam\u0131n \u00d6n\u00fc A\u00e7\u0131l\u0131yor!<br \/>Bilindi\u011fi \u00fczere kamuda yard\u0131mc\u0131 i\u015flerde ta\u015feron \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Bu d\u00fczenlemeden hareketle kamu kurumlar\u0131n\u0131n \u00e7ok b\u00fcy\u00fck bir b\u00f6l\u00fcm\u00fcnde yard\u0131mc\u0131 i\u015fler olarak kabul edilen yemek, temizlik, g\u00fcvenlik ve ta\u015f\u0131ma gibi i\u015fler alt i\u015fverene devredilmi\u015ftir.<\/p>\n<p>Daha \u00f6nce kamunun kendi kadrolar\u0131 ile y\u00fcr\u00fctt\u00fc\u011f\u00fc i\u015fler yard\u0131mc\u0131 hizmetler tan\u0131mlamas\u0131n\u0131n gittik\u00e7e geni\u015fletilmesi sonucunda ta\u015ferona teslim edilmi\u015ftir. \u00d6yle ki Anayasa\u2019n\u0131n 128. Maddesinde yer alan \u201cDevletin, kamu iktisad\u00ee te\u015febb\u00fcsleri ve di\u011fer kamu t\u00fczelki\u015filerinin genel idare esaslar\u0131na g\u00f6re y\u00fcr\u00fctmekle y\u00fck\u00fcml\u00fc olduklar\u0131 kamu hizmetlerinin gerektirdi\u011fi asl\u00ee ve s\u00fcrekli g\u00f6revler, memurlar ve di\u011fer kamu g\u00f6revlileri eliyle g\u00f6r\u00fcl\u00fcr\u201d d\u00fczenlemesi a\u00e7\u0131k\u00e7a ihlal edilmi\u015ftir. Ba\u015fta sa\u011fl\u0131k ve e\u011fitim hizmetleri olmak \u00fczere kamu hizmetlerinin b\u00fcy\u00fck b\u00f6l\u00fcm\u00fcnde ta\u015feronla\u015fma ve g\u00fcvencesiz istihdam gittik\u00e7e art\u0131r\u0131lm\u0131\u015ft\u0131r. Sa\u011fl\u0131k hizmetlerinde ta\u015feron olarak istihdam edilenlerin say\u0131s\u0131 2002 y\u0131l\u0131nda 11 bin iken bug\u00fcn 160 bini a\u015fm\u0131\u015ft\u0131r. Yard\u0131mc\u0131 hizmetler ad\u0131yla kamuda \u00e7al\u0131\u015ft\u0131r\u0131lmak i\u00e7in al\u0131nan ta\u015feron firma \u00e7al\u0131\u015fanlar\u0131n\u0131n asli kamu hizmetlerinde \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131 da bilinen bir ger\u00e7ektir. Hemen hemen her kamu kurum ve kurulu\u015funda ta\u015feron istihdam temel istihdam bi\u00e7imlerinden birisi haline getirilmi\u015ftir. <br \/>Buna ra\u011fmen \u201cTa\u015feron Yasa Tasar\u0131s\u0131\u201d ile kamuda ta\u015feron istihdam\u0131 devaml\u0131 hale getirecek d\u00fczenlemeler art\u0131r\u0131lmaktad\u0131r. <br \/>Tekrar hat\u0131rlatacak olursak \u0130\u015f Yasas\u0131n\u0131n 2. Maddesine g\u00f6re as\u0131l i\u015f, i\u015fletmenin ve i\u015fin gere\u011fi ile teknolojik nedenlerle uzmanl\u0131k gerektiren i\u015fler d\u0131\u015f\u0131nda b\u00f6l\u00fcnerek alt i\u015fverene verilemez. Tasar\u0131 ile bu ifadede yer alan, ayn\u0131 anda ve birlikte ger\u00e7ekle\u015fmek zorunda olan bu \u00fc\u00e7 ko\u015fulu delmeyi hedefleyen d\u00fczenlemeler \u00f6ng\u00f6r\u00fclmektedir. <br \/>Kamu idaresine ait bir i\u015fyerinde \u201cyeterli nitelikte veya say\u0131da personel olmamas\u0131 durumunda\u201d hizmet al\u0131m\u0131 ihalesine \u00e7\u0131kma hakk\u0131 tan\u0131nmas\u0131 kamuda ta\u015feron istihdam\u0131n \u00f6n\u00fcn\u00fc a\u00e7an d\u00fczenlemelerden biri olarak dikkat \u00e7ekiyor. <br \/>\u00d6te yandan tasar\u0131 ile yap\u0131m i\u015fi olan as\u0131l i\u015flerin de hizmet al\u0131m s\u00f6zle\u015fmesiyle ihaleye \u00e7\u0131kar\u0131lmas\u0131n\u0131n yolu a\u00e7\u0131lmaktad\u0131r. Bu d\u00fczenleme Kamu \u0130hale Kanunu\u2019nda yer alan yap\u0131m i\u015fi-hizmet i\u015fi ayr\u0131m\u0131n\u0131n da ortadan kald\u0131r\u0131lmas\u0131 anlam\u0131na gelmektedir.<br \/>Ayr\u0131ca kamuda yayg\u0131n olan norm kadro uygulamas\u0131 ile yeni kadro a\u00e7\u0131lmad\u0131\u011f\u0131 bilinmektedir. Bu gerek\u00e7eye dayanarak yeterli say\u0131da veya nitelikli personel olmad\u0131\u011f\u0131 gerek\u00e7esiyle hizmet al\u0131m\u0131 yoluna gidilebilecektir. <br \/>\uf0d8 K\u00f6leli\u011fi Yutturmak \u0130\u00e7in Tasar\u0131 \u201cMaden Yasa Tasar\u0131s\u0131\u201d ve \u201cSGK Aff\u0131 Tasar\u0131s\u0131\u201d \u0130le Birle\u015ftiriliyor!<br \/>Temel d\u00fczenlemelerini yukar\u0131da \u00f6zetlemeye \u00e7al\u0131\u015ft\u0131\u011f\u0131m\u0131z yasa tasar\u0131s\u0131n\u0131n ana hedefi emek\u00e7ilerin i\u015f cinayetlerine kurban verilmesinin, d\u00fc\u015f\u00fck \u00fccretlerle g\u00fcvencesiz ve \u00f6rg\u00fcts\u00fcz \u00e7al\u0131\u015fma ko\u015fullar\u0131na itilmesinin k\u0131sacas\u0131 19. y\u00fczy\u0131la \u00f6zg\u00fc \u00e7al\u0131\u015fma ko\u015fullar\u0131na mahk\u00fbm edilmesinin \u201cekonomik yolu\u201d olan ta\u015feron istihdam\u0131n \u00f6n\u00fcndeki engelleri ortadan kald\u0131rmak, bir b\u00fct\u00fcn olarak \u00e7al\u0131\u015fma hayat\u0131n\u0131 ta\u015feronla\u015ft\u0131rmakt\u0131r. Bunun i\u00e7in h\u00fck\u00fcmet yasalara, yarg\u0131 kararlar\u0131na uymak yerine, bu kararlar\u0131 a\u015fmak i\u00e7in mevzuat\u0131 de\u011fi\u015ftirmeyi planlamaktad\u0131r. <br \/>Di\u011fer taraftan AKP, milyonlarca emek\u00e7inin hayat\u0131n\u0131n alt \u00fcst edilmesi pahas\u0131na hayata ge\u00e7irmeyi planlad\u0131\u011f\u0131 sald\u0131r\u0131da daha \u00f6nce defalarca uygulayarak \u201custala\u015ft\u0131\u011f\u0131\u201d y\u00f6nteme bir kez daha ba\u015fvurmaktad\u0131r. <br \/>Buna g\u00f6re ta\u015feron yasa tasar\u0131s\u0131na kar\u015f\u0131 muhalefeti engellemenin yolu \u201cMaden Yasa Tasar\u0131s\u0131\u201d ve ba\u015fta Genel Sa\u011fl\u0131k Sigortas\u0131 primleri olmak \u00fczere \u00e7e\u015fitli prim-vergi bor\u00e7lar\u0131n\u0131n yeniden d\u00fczenlenmesini i\u00e7ermesine ra\u011fmen abart\u0131l\u0131 bir \u015fekilde \u201cAf Yasa Tasar\u0131s\u0131\u201d olarak sunulan tasar\u0131larla birle\u015ftirilmesinde aranmaktad\u0131r. <br \/>Oysa AKP iktidar\u0131, \u201cMaden Yasa Tasar\u0131s\u0131\u201d ile Soma katliam\u0131 sonras\u0131nda i\u015f cinayetleri konusunda toplumda artan hassasiyetten nemalanmay\u0131 hedeflemektedir.<br \/>Maden i\u015f\u00e7ilerinin y\u0131llard\u0131r ya\u015fad\u0131\u011f\u0131 olumsuz \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131 g\u00f6rmezden gelen AKP iktidar\u0131n\u0131n Soma Katliam\u0131n\u0131n sorumlulu\u011funu unutturmak i\u00e7in her yola ba\u015fvurdu\u011fu bilinmektedir. Oysa Soma Katliam\u0131, \u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve G\u00fcveli\u011finden uzak ko\u015fullarda, d\u00fc\u015f\u00fck \u00fccretle, g\u00fcnde 10 saate kadar \u00e7al\u0131\u015ft\u0131r\u0131lan 301 maden i\u015f\u00e7isinin hayat\u0131na mal olan hileli ta\u015feronluk d\u00fczenlemesi \u201cr\u00f6dovans\u201d sisteminin i\u00e7 y\u00fcz\u00fcn\u00fc ortaya \u00e7\u0131karm\u0131\u015ft\u0131r. <br \/>Buna ra\u011fmen \u201cMaden Yasa Tasar\u0131s\u0131\u201dnda \u201cr\u00f6davans sisteminin\u201d, ta\u015feron \u00e7al\u0131\u015fman\u0131n yasaklanmas\u0131na ili\u015fkin hi\u00e7bir d\u00fczenleme yoktur. Bunun yerine yer alt\u0131 i\u015flerinde \u00e7al\u0131\u015fan i\u015f\u00e7ilerin g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcrelerinin 6 saat, haftal\u0131k \u00e7al\u0131\u015fma s\u00fcrelerinin ise 36 saatle s\u0131n\u0131rlanmas\u0131, y\u0131ll\u0131k \u00fccretli izinlerinin d\u00f6rt g\u00fcn art\u0131r\u0131lmas\u0131 d\u00fczenlenmektedir. Ayr\u0131ca \u00e7al\u0131\u015fma s\u00fcreleri zorunlu ve ola\u011fan\u00fcst\u00fc hallerde art\u0131r\u0131labilecektir. Di\u011fer taraftan \u00e7al\u0131\u015fma s\u00fcresinin, ekipmanlar\u0131n haz\u0131rlanmas\u0131, galerilere ini\u015f-\u00e7\u0131k\u0131\u015f gibi normal \u015fartlarda \u00e7al\u0131\u015fma s\u00fcrelerini kapsay\u0131p- kapsamad\u0131\u011f\u0131 belirsizdir. Yani \u00e7al\u0131\u015fma s\u00fcresinden yer alt\u0131nda kal\u0131nan s\u00fcrenin mi yoksa \u00e7al\u0131\u015fmadan say\u0131lan haz\u0131rl\u0131k s\u00fcrelerinin de i\u00e7inde bulundu\u011fu s\u00fcreyi de kapsayan s\u00fcrenin mi kast edildi\u011fi net de\u011fildir. Bu durumun netle\u015ftirilmesi gerekmektedir. \u00c7\u00fcnk\u00fc bilindi\u011fi \u00fczere Soma Katliam\u0131nda g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresi 8 saat olmas\u0131na ra\u011fmen haz\u0131rl\u0131k, galeriye ini\u015f-\u00e7\u0131k\u0131\u015f s\u00fcreleri dahil edilmeyen i\u015f\u00e7ilerin, mesai \u00fccreti \u00f6denmeden, 10 saate kadar \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131 ortaya \u00e7\u0131km\u0131\u015ft\u0131r. <br \/>Maden Yasa Tasar\u0131s\u0131ndaki bir di\u011fer d\u00fczenleme ise Soma Katliam\u0131nda hayat\u0131n\u0131 kaybeden i\u015f\u00e7ilerden geride kalan hak sahiplerine \u00f6l\u00fcm ayl\u0131\u011f\u0131 ba\u011flanmas\u0131d\u0131r. Ancak katliam sonras\u0131nda i\u015f\u00e7ilerin yak\u0131nlar\u0131na bol bol vaatte bulunan AKP iktidar\u0131, \u00f6l\u00fcm ayl\u0131\u011f\u0131n\u0131n kayna\u011f\u0131 olarak d\u00f6rtte biri i\u015f\u00e7ilerin \u00fccretlerinden kesilen \u0130\u015fsizlik Sigortas\u0131 Fonunu g\u00f6stermektedir. <br \/>Bas\u0131nda \u201cen b\u00fcy\u00fck af geliyor\u201d diyerek cilalanan yasa tasar\u0131s\u0131nda ise sigorta primlerinin, idari para cezalar\u0131n\u0131n, baz\u0131 vergilerin yeniden d\u00fczenlenmesi vard\u0131r. Yani af de\u011fil, bor\u00e7lar\u0131n tahsili i\u00e7in yeniden d\u00fczenleme yap\u0131lmaktad\u0131r. D\u00fczenlemeden daha \u00e7ok \u00e7al\u0131\u015fanlar\u0131n\u0131n sigorta primlerini yat\u0131rmayan i\u015fverenler yararlanacakt\u0131r. Tasar\u0131da emek\u00e7ileri ilgilendiren b\u00f6l\u00fcm ise 2012 y\u0131l\u0131nda hayata ge\u00e7irilen Genel Sa\u011fl\u0131k Sigortas\u0131 primlerinin yeniden d\u00fczenlenmesidir. Hat\u0131rlanaca\u011f\u0131 \u00fczere 1 Ocak 2012 y\u0131l\u0131nda ba\u015flayan uygulamaya g\u00f6re, hi\u00e7bir sosyal g\u00fcvenli\u011fi olmayanlar, ye\u015fil kartl\u0131lar, k\u0131smi s\u00fcreli \u00e7al\u0131\u015fanlar (part time \u00e7al\u0131\u015fanlar), \u00f6\u011frenciler ve zorunlu sigortas\u0131 sona erenler Genel Sa\u011fl\u0131k Sigortas\u0131 kapsam\u0131na al\u0131nm\u0131\u015ft\u0131. Bunlardan gelir testi sonucu ayl\u0131k geliri br\u00fct asgari \u00fccretin \u00fc\u00e7te birini ge\u00e7enlerin kademeli olarak ayda 35,46 TL den 212,76 TL ye kadar prim \u00f6demesi d\u00fczenlenmi\u015fti. <br \/>\u00c7al\u0131\u015fma Bakan\u0131\u2019n\u0131n a\u00e7\u0131klamalar\u0131na GSS d\u00fczenlemesi ile ba\u015flayan Gelir testine girmeyen yakla\u015f\u0131k 3 milyon 300 bin civar\u0131nda vatanda\u015f\u0131m\u0131z bulunmaktad\u0131r. Teste girmeyenlere en y\u00fcksek oranda prim (212,76 TL) tahakkuk etti\u011fi i\u00e7in bu vatanda\u015flar\u0131n \u015fu anda prim borcu 7 milyar\u0131 a\u015fm\u0131\u015f durumda. <br \/>\u0130\u015fte \u201c b\u00fcy\u00fck af geliyor\u201d diye m\u00fcjde haberleri yap\u0131lan tasar\u0131da zaten haks\u0131z bir \u015fekilde en y\u00fcksek oranda prim tahakkuk ettirilen bu prim bor\u00e7lar\u0131n\u0131n yeniden yap\u0131land\u0131r\u0131lmas\u0131 var. Buna g\u00f6re bug\u00fcne kadar Gelir Testi yapt\u0131rmayanlara 4 ay i\u00e7inde ba\u015fvurular\u0131 halinde tahakkuk edilecek prim bor\u00e7lar\u0131n\u0131 12 ayda \u00f6deyebilmeleri d\u00fczenlenmektedir. K\u0131sacas\u0131 ortada geni\u015f toplum kesimlerini ilgilendiren bir af yoktur.<br \/>Sonu\u00e7 olarak AKP\u2019nin ta\u015feron istihdam\u0131 ortadan kald\u0131rmak ya da s\u0131n\u0131rlamak gibi bir amac\u0131 hi\u00e7bir d\u00f6nem olmam\u0131\u015ft\u0131r. Her \u015feyi paraya tahvil edenler i\u00e7in i\u015f\u00e7inin, emek\u00e7inin k\u00f6lelik ko\u015fullar\u0131na itilmesi, i\u015f cinayetlerine kurban verilmesi ola\u011fan, s\u0131radan \u015feylerdir. Maddeler) tasar\u0131ndan \u00e7\u0131kar\u0131lmal\u0131d\u0131r.<br \/>\uf0fc En son Soma katliam\u0131nda 301 i\u015f\u00e7imizin ya\u015fam\u0131na mal olan i\u015f cinayetlerinin engellenmesinin bir ad\u0131m\u0131 olarak, 19 y\u0131ld\u0131r imzalanmayan Uluslararas\u0131 \u00c7al\u0131\u015fma \u00d6rg\u00fct\u00fc&#8217;n\u00fcn (ILO) 176 say\u0131l\u0131 Madenlerde G\u00fcvenlik ve Sa\u011fl\u0131k S\u00f6zle\u015fmesi derhal imzalanmal\u0131d\u0131r.<br \/>\uf0fc K\u0131dem tazminat\u0131n\u0131n \u00f6denmesi i\u015fverenin asli sorumlulu\u011fudur.
