Madde kapsam\u0131nda \u00f6ng\u00f6r\u00fclen d\u00fczenlemelerin \u015fuan \u00e7al\u0131\u015fmakta olan uzman-m\u00fcfetti\u015f ve denet\u00e7i, yard\u0131mc\u0131lar\u0131 hakk\u0131nda da uygulanacak.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 10pt;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 10pt;\"><strong><span style=\"line-height: 115%;\">MADDE 5:<\/span><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; line-height: 115%; font-family: 'trebuchet ms', geneva;\">Bu madde de en \u00f6nemli husus 6004 say\u0131l\u0131 yasan\u0131n 13. Memur istihdam\u0131 yerine maliyeti azaltmak i\u00e7in \u00f6\u011frenci eme\u011fi s\u00f6m\u00fcr\u00fcs\u00fc.<\/span><\/p>\n<p style=\"margin-bottom: 7.5pt; text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 10pt;\"><strong><span style=\"color: #444444;\">MADDE 7:<\/span><\/strong><\/span><\/p>\n<p style=\"line-height: normal; text-align: justify;\"><span style=\"font-size: 10pt; font-family: 'trebuchet ms', geneva;\">28 \u015eubat 1997 tarihinden sonra verilen disiplin cezalar\u0131 nedeniyle memurluktan \u00e7\u0131kar\u0131lanlardan aradan ge\u00e7en s\u00fcrede memur olma \u015fartlar\u0131n\u0131 ta\u015f\u0131yanlar yeniden g\u00f6reve atamas\u0131 yap\u0131lacak. Bu atamalarda b\u00fct\u00e7edeki kadro k\u0131s\u0131tlar\u0131 uygulanmayacak. Yani y\u0131llard\u0131r beklenen disiplin aff\u0131ndan sadece \u201c28 \u015fubat ma\u011fdurlar\u0131\u201d n\u0131n yararlanmas\u0131 hedefleniyor. <\/span><\/p>\n<p style=\"line-height: normal; text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 10pt;\"><strong>MADDE 8: <\/strong>\u00dcst d\u00fczey y\u00f6neticiler ve kariyer meslek mensuplar\u0131 (uzman, uzman yard\u0131mc\u0131s\u0131, denet\u00e7i gibi) hakk\u0131nda yap\u0131lmas\u0131 planlanan de\u011fi\u015fikliklerin kurum, te\u015fkilat yasalar\u0131 ile uyumlu hale getirilmesi a\u011f\u0131rl\u0131kl\u0131 bir madde. <\/span><\/p>\n<p style=\"line-height: normal; text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 10pt;\"><strong>Bunun d\u0131\u015f\u0131nda bu madde de \u00f6ne \u00e7\u0131kanlar:<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; font-family: 'trebuchet ms', geneva;\">\u00a0<strong>1-Fazla mesai \u00f6demesi Anayasa Mahkemesi karar\u0131na ra\u011fmen ortadan kald\u0131r\u0131l\u0131yor:<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 10pt;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; font-family: 'trebuchet ms', geneva;\">Hat\u0131rlanaca\u011f\u0131 \u00fczere 2 Kas\u0131m 2011 tarihili Resmi Gazetede yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe giren 666 Say\u0131l\u0131 KHK ile baz\u0131 kurumlar\u0131n fazla \u00e7al\u0131\u015fma \u00fccreti \u00f6demelerinin 31 Aral\u0131k 2012\u2032ye kadar devam etmesi ancak 1 Ocak 2013 tarihi itibariyle sonland\u0131r\u0131lmas\u0131n\u0131 d\u00fczenliyordu. Bu s\u00fcre baz\u0131 kurumlar i\u00e7in ise 31 Aral\u0131k 2014\u2019te sona eriyordu. Hatta Orman Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc merkez te\u015fkilat\u0131 personeli i\u00e7in \u00f6ng\u00f6r\u00fclen fazla \u00e7al\u0131\u015fma \u00fccreti 31Aral\u0131k 2012\u2019e kadar olan s\u00fcre i\u00e7in yar\u0131ya d\u00fc\u015f\u00fcr\u00fclm\u00fc\u015ft\u00fc.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; font-family: 'trebuchet ms', geneva;\">Anayasa mahkemesi 666 say\u0131l\u0131 KHK\u2019n\u0131n baz\u0131 maddelerinin iptaline ili\u015fkin ba\u015fvuruyu de\u011ferlendirerek bir karar ald\u0131. Bu karara g\u00f6re 666\u00a0 KHK\u2019n\u0131n 15. Maddesinde d\u00fczenlenen fazla mesai ile ilgili\u00a0 h\u00fckm\u00fcn\u00fc iptal etti. Yine hat\u0131rlanaca\u011f\u0131 \u00fczere Anayasa Mahkemesinin 666 KHK\u2019n\u0131n iptal etti\u011fi d\u00fczenlemelerinin bir k\u0131sm\u0131 karar\u0131n Resmi Gazetede yay\u0131mland\u0131\u011f\u0131 tarihte, iptal edilen d\u00fczenlemelerin \u00f6nemli bir b\u00f6l\u00fcm\u00fc ise mahkeme karar\u0131n\u0131n Resmi Gazetede yay\u0131mland\u0131\u011f\u0131 tarihten dokuz ay sonra y\u00fcr\u00fcrl\u00fc\u011fe girecekti.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 10pt;\">TBMM\u2019ye sunulan bu torba yasa ile Anayasa Mahkemesi karar\u0131 bo\u015fa \u00e7\u0131kar\u0131l\u0131yor ve fazla mesai \u00fccreti yeniden iptal ediliyor. F<span style=\"color: black;\">azla mesai \u00fccretlerinin kesilmesi nedeniyle kamu emek\u00e7ilerinin \u00f6nemli bir b\u00f6l\u00fcm\u00fcn\u00fcn \u00fccretlerinde b\u00fcy\u00fck d\u00fc\u015f\u00fc\u015fler ya\u015fanmaya devam edecek. <\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 10pt;\"><strong>\u00d6SYM \u2018N\u0130N YAPTI\u011eI SINAVAR B\u0130LG\u0130 ED\u0130NME HAKKI\u2019NIN KAPSAMI DI\u015eINA \u00c7IKARILIYOR:<\/strong><\/span><\/p>\n<p style=\"line-height: normal; text-align: justify;\"><span style=\"font-size: 10pt; font-family: 'trebuchet ms', geneva; color: black;\">Tasar\u0131da en \u00f6nemli de\u011fi\u015fikliklerden birisi de Bili Edinme Hakk\u0131 Kanunun istisna d\u00fczenlemesine ili\u015fkin. Bu mad deye yap\u0131lan ekle \u00d6SYM\u2019nin yapt\u0131\u011f\u0131 s\u0131navlarda sorulan sorular ve cevaplar bilgi edinme hakk\u0131n\u0131n kapsam\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131l\u0131yor.<\/span><\/p>\n<p style=\"line-height: normal; text-align: justify;\"><span style=\"font-size: 10pt; font-family: 'trebuchet ms', geneva; color: black;\">Bunun anlam\u0131 \u00d6SYM\u2019nin yapt\u0131\u011f\u0131 herhangi bir s\u0131navda (\u00f6rne\u011fin kamu kurum kurulu\u015flar\u0131na al\u0131nmada aranan KPSS) bekledi\u011fi puan\u0131 alamayanlar\u0131n bilgi alma hakk\u0131 art\u0131k olmayacak. Yani itiraz edemeyecek.\u00a0 B\u00f6ylece \u00f6zellikle son y\u0131llarda yap\u0131lan s\u0131navlarda ya\u015fanan kopya-sorular\u0131n d\u0131\u015far\u0131 s\u0131zd\u0131r\u0131lmas\u0131 olaylar\u0131 sonras\u0131 s\u0131k\u0131\u015fan \u00d6SYM tam koruma alt\u0131na al\u0131nacak.<\/span><\/p>\n<p style=\"line-height: normal; text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 10pt;\"><strong>Sonu\u00e7:<\/strong><\/span><\/p>\n<p style=\"line-height: normal; text-align: justify;\"><span style=\"font-size: 10pt; font-family: 'trebuchet ms', geneva; color: black;\">\u00a0Y\u00f6netici kadrolar\u0131na atanabilmek i\u00e7in belirli bir meslek grubu, kariyer meslek mensubu ya da kurum meslek personeli olma, belirlenen hizmet s\u0131n\u0131flar\u0131na ya da h\u00e2kimlik ve savc\u0131l\u0131k mesleklerine ili\u015fkin kadrolarda bulunma gibi \u00f6zel \u015fartlar\u0131n kald\u0131r\u0131l\u0131yor.<\/span><\/p>\n<p style=\"line-height: normal; text-align: justify;\"><span style=\"font-size: 10pt; font-family: 'trebuchet ms', geneva; color: black;\">Neredeyse hi\u00e7bir nitelik aramadan t\u00fcm yanda\u015flar\u0131n (kamu \u2013\u00f6zel ayr\u0131m\u0131 g\u00f6zetmeksizin)\u00a0 \u00a0\u00fcst d\u00fczey y\u00f6netici olabilmesinin yolunun a\u00e7\u0131lmas\u0131 ise kamuda kariyer ve liyakat ilkelerini yok edilecek. Y\u0131llarca kamuda g\u00f6rev yapm\u0131\u015f olan kamu emek\u00e7ilerinin y\u00fckselmelerinin \u00f6n\u00fc tamamen t\u0131kanacak. Kamu istihdam mant\u0131\u011f\u0131n\u0131 tamamen tahrip eden d\u00fczenleme ile kamu emek\u00e7isi al\u0131m\u0131ndaki kurallar tamamen ihlal edilecektir.
