D\u00fcnya kapitalizmine uyum amac\u0131yla kabul edilen 24 Ocak 1980 kararlar\u0131n\u0131n ge\u00e7ti\u011fimiz otuz k\u00fcsur y\u0131lda ya\u015fanan d\u00f6n\u00fc\u015f\u00fcm s\u00fcrecinden ba\u011f\u0131ms\u0131z ele al\u0131nmas\u0131 m\u00fcmk\u00fcn de\u011fildir. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">24 Ocak 1980 kararlar\u0131ndan bug\u00fcne ad\u0131m ad\u0131m hayata ge\u00e7irilen kamunun yeniden yap\u0131land\u0131r\u0131lmas\u0131 uygulamalar\u0131n\u0131n ana hedefi, kamu hizmetleri alan\u0131n\u0131n sermayenin d\u00f6nemsel ihtiya\u00e7lar\u0131 do\u011frultusunda yeniden bi\u00e7imlendirilmesi olmu\u015ftur. Ancak T\u00fcrkiye\u2019de, kamunun d\u00f6n\u00fc\u015f\u00fcm\u00fc alan\u0131nda bug\u00fcne kadar yap\u0131lanlar hi\u00e7bir zaman yeterli g\u00f6r\u00fclmemi\u015ftir. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">24 Ocak 1980 kararlar\u0131 ile 10 y\u0131ld\u0131r iktidarda olan AKP\u2019nin \u201c2013 h\u00fck\u00fcmet program\u0131\u201d ve \u201c2023 vizyonu\u201d aras\u0131ndaki s\u00f6ylem ve hedefler a\u00e7\u0131s\u0131ndan \u00f6nemli benzerlikler bulunmaktad\u0131r. 24 Ocak kararlar\u0131n\u0131n uygulanmas\u0131na, hem \u00fclke i\u00e7indeki ekonomik ve siyasi kriz, hem de d\u0131\u015f d\u00fcnyada (\u00f6zellikle ABD ve \u0130ngiltere\u2019de) uygulanan ve ad\u0131na \u201cyeni liberalizm\u201d denilen politikalar belirleyici olmu\u015ftur. D\u00f6nemin temel s\u00f6ylemi, \u201cRekabete a\u00e7\u0131k bir ekonomik yap\u0131, her alanda etkinlik ve verimlilik art\u0131\u015f\u0131, sermaye te\u015fvikleri ve d\u0131\u015f ticaretin art\u0131r\u0131lmas\u0131 \u00fczerinden kalk\u0131nman\u0131n sa\u011flanmas\u0131\u201d \u015feklindedir.<\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">AKP\u2019nin 10 y\u0131ll\u0131k iktidar prati\u011fini dikkatli bir \u015fekilde takip eden herkes, h\u00fck\u00fcmetin sa\u011fl\u0131kta d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131ndan, e\u011fitimde uygulanan 4+4+4 dayatmas\u0131na, Ulusal \u0130stihdam Stratejisinden, kamu personel rejiminde yap\u0131lmak istenen de\u011fi\u015fikliklere kadar \u00e7e\u015fitli alanlarda haz\u0131rlanan temel metinler ve s\u00f6ylemlerde benzer ifadelerin \u00f6zellikle vurguland\u0131\u011f\u0131n\u0131 rahatl\u0131kla g\u00f6rebilir.<\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">24 Ocak kararlar\u0131yla hedeflenenlerin b\u00fcy\u00fck b\u00f6l\u00fcm\u00fc, asl\u0131nda son 10 y\u0131l i\u00e7inde b\u00fcy\u00fck \u00f6l\u00e7\u00fcde hayata ge\u00e7irilmi\u015ftir. Hatta o zaman hayal bile edilemeyecek d\u00fczeyde d\u0131\u015f bor\u00e7lanma, \u00f6zelle\u015ftirmeler, kamu hizmetlerinin piyasaya a\u00e7\u0131lmas\u0131, esnek ve g\u00fcvencesiz \u00e7al\u0131\u015fman\u0131n yayg\u0131nla\u015fmas\u0131 gibi hedeflere ula\u015f\u0131lm\u0131\u015ft\u0131r B\u00fct\u00fcn bunlara ek olarak, i\u015f\u00e7i ve emek\u00e7ilerin en temel haklar\u0131, yasal d\u00fczenlemeler ve fiili uygulamalarla birer birer ellerinden al\u0131nm\u0131\u015ft\u0131r. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">\u00d6zelle\u015ftirmeler, kamu hizmetlerinin piyasala\u015ft\u0131r\u0131lmas\u0131, \u00e7al\u0131\u015fma yasalar\u0131n\u0131n \u00fcretim s\u00fcrecinde ya\u015fanan esnekle\u015fmeye uygun \u015fekilde yeniden d\u00fczenlenmesi gibi ad\u0131mlar, 1990\u2019l\u0131 y\u0131llardan itibaren \u00fclkenin ana g\u00fcndemini olu\u015fturmu\u015f ve son y\u0131llarda bu anlamda \u00f6nemli ad\u0131mlar at\u0131lm\u0131\u015ft\u0131r. Kamuya ait i\u015fletmelerin, \u00f6zel sekt\u00f6r eliyle daha iyi \u00e7al\u0131\u015faca\u011f\u0131 ve kar edece\u011fi iddia edilerek kamu hizmetlerinin ticarile\u015ftirilmesi ve \u00f6zelle\u015ftirilmesi s\u00fcreci h\u0131zland\u0131r\u0131lm\u0131\u015ft\u0131r. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">T\u00fcrkiye\u2019de \u00f6zelle\u015ftirmelerin ve \u00f6zelle\u015ftirme sonucunda ortaya \u00e7\u0131kan ekonomik ve sosyal sorunlar\u0131n en yo\u011fun ya\u015fand\u0131\u011f\u0131 d\u00f6nem, AKP\u2019nin tek ba\u015f\u0131na iktidar oldu\u011fu 2002 sonras\u0131 d\u00f6nem olmu\u015ftur. 1986 y\u0131l\u0131ndan bu yana aradan ge\u00e7en 26 y\u0131lda, 45 milyar dolarl\u0131k \u00f6zelle\u015ftirme yap\u0131lm\u0131\u015ft\u0131r. Bu rakam\u0131n 38 milyar dolar\u0131 (y\u00fczde 85\u2019i) son 10 y\u0131l i\u00e7inde, AKP iktidar\u0131 d\u00f6neminde ger\u00e7ekle\u015fmi\u015ftir. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\"><strong>Kamu hizmetlerinin \u00f6zelle\u015ftirilmesi<\/strong><\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\">\u00a0<\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">1990\u2019l\u0131 y\u0131llar\u0131n ba\u015f\u0131ndan itibaren \u201ckamu\u201d kavram\u0131na ad\u0131n\u0131 veren \u201chalk\u201d (public) anlay\u0131\u015f\u0131ndan h\u0131zla uzakla\u015f\u0131larak, tamamen \u201cpiyasa\u201d ve \u201ckar\u201d odakl\u0131 yeni bir \u201ckamu\u201d anlay\u0131\u015f\u0131 olu\u015fturulmaya \u00e7al\u0131\u015f\u0131l\u0131yor. 1990 sonras\u0131nda kamu y\u00f6netimi alan\u0131nda devletin rol\u00fc \u00fczerine y\u00fcr\u00fcyen tart\u0131\u015fma sadece devletin ekonomiden \u00e7ekilmesi ile s\u0131n\u0131rl\u0131 kalmayarak, yeni g\u00f6revleri kurumsal yap\u0131s\u0131 da giderek \u00f6nem kazand\u0131. Devletin kamu hizmetlerinin sunumu s\u00fcrecinde k\u00fc\u00e7\u00fclt\u00fcl\u00fcrken, farkl\u0131 bir rol \u00fcstlenmesi, giri\u015fimcilik ruhu ile harekete ge\u00e7erek, \u201cpiyasa ile uyumlu\u201d ve \u201cm\u00fc\u015fteri odakl\u0131\u201d olmas\u0131 i\u00e7in ad\u0131mlar at\u0131ld\u0131. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Kamunun ve kamu hizmetlerinin \u00f6nce ticarile\u015ftirilmesi sonra \u00f6zelle\u015ftirilmesi s\u00fcrecinde, kamusal alan\u0131n b\u00fct\u00fcn\u00fcyle (hem halka y\u00f6nelik kamu hizmetleri, hem de bu hizmetlerin sunumunda rol alan kamu emek\u00e7ileri a\u00e7\u0131s\u0131ndan) \u2018piyasa ili\u015fkileri\u2019 i\u00e7ine \u00e7ekilmesi y\u00f6n\u00fcndeki giri\u015fim ve uygulamalar t\u00fcm h\u0131z\u0131yla s\u00fcr\u00fcyor. 1990\u2019l\u0131 y\u0131llarda kamuya ait i\u015fletmelerin, fabrikalar\u0131n \u00f6zelle\u015ftirilmesiyle ba\u015flayan s\u00fcre\u00e7, bug\u00fcn e\u011fitim ve sa\u011fl\u0131k ba\u015fta olmak \u00fczere ula\u015f\u0131mdan haberle\u015fmeye, belediye hizmetlerinden k\u00fclt\u00fcr ve sanata kadar hemen hemen t\u00fcm alanlardaki kamu hizmetlerini kapsar hale gelmi\u015f durumda. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">1995 y\u0131l\u0131nda D\u00fcnya Ticaret \u00d6rg\u00fct\u00fc \u00f6nc\u00fcl\u00fc\u011f\u00fcnde imzalanan <em>Hizmet Ticareti Genel Anla\u015fmas\u0131<\/em> (GATS) ile belli ba\u015fl\u0131 \u00fclkeler hizmet sekt\u00f6rlerini yerli ve uluslararas\u0131 piyasaya a\u00e7may\u0131 ama\u00e7lad\u0131. Bu \u015fekilde tek tek \u00fclkelerde piyasa ili\u015fkilerinden g\u00f6rece daha \u00f6zerk ve korunakl\u0131 bir konumda olan kamu hizmeti alanlar\u0131n\u0131 ticarile\u015ftirerek \u00e7\u00f6zmek, ard\u0131ndan kamu hizmetlerini piyasa ili\u015fkileri i\u00e7ine \u00e7ekerek tasfiye etmek hedeflendi.\u00a0 <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">T\u00fcrkiye\u2019nin de imzas\u0131n\u0131n bulundu\u011fu GATS anla\u015fmas\u0131na g\u00f6re her \u015feyin serbest piyasada dola\u015f\u0131ma tabi oldu\u011fu bir d\u00fcnyada kamu hizmetlerinin de \u201czincirlerinden kurutulmas\u0131\u201d piyasaya a\u00e7\u0131lmas\u0131 gerekti\u011fi savunuldu. Bu t\u00fcr bir yap\u0131lanman\u0131n, krizlerle bo\u011fu\u015fan ekonomilerin nefes almas\u0131 ve daha \u201crekabet\u00e7i\u201d bir nitelik kazanabilmesi i\u00e7in zorunlu oldu\u011fu iddia edildi. Buna gerek\u00e7e olarak da, kamu hizmetlerinin \u00f6zel sekt\u00f6r\u00fcn rekabet g\u00fcc\u00fcn\u00fc s\u0131n\u0131rlad\u0131\u011f\u0131, sermaye aleyhine \u201chaks\u0131z rekabet\u201d yaratt\u0131\u011f\u0131 iddia edildi. Bu \u201chaks\u0131zl\u0131\u011f\u0131\u201d gidermek i\u00e7in kamu hizmetleri dahil her \u015feyin piyasa kurallar\u0131na g\u00f6re \u00fcretildi\u011fi, piyasan\u0131n \u201cdo\u011fal dengesi\u201dne g\u00fcvenilmesi gerekti\u011fi propaganda edildi. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">GATS anla\u015fmas\u0131 ile ba\u015fta sa\u011fl\u0131k ve e\u011fitim hizmetleri olmak \u00fczere, ge\u00e7mi\u015fte s\u0131n\u0131f m\u00fccadelesi ile kazan\u0131lan t\u00fcm temel kazan\u0131mlar, anla\u015fmaya imza atan \u00fclkelerde ciddi tehditlerle kar\u015f\u0131 kar\u015f\u0131ya kald\u0131.\u00a0 T\u00fcm d\u00fcnyada \u00f6zelle\u015ftirme ve kamu alan\u0131n\u0131n tasfiyesi olarak ya\u015fanan sald\u0131r\u0131lar, sadece kamu hizmetlerine ve emek\u00e7ilerine y\u00f6nelik olarak de\u011fil, bu hizmetten yararlanan en geni\u015f halk kesimlerine zarar verecek kadar kapsaml\u0131 bir i\u00e7erikte hayata ge\u00e7irilmeye ba\u015fland\u0131. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">T\u00fcrkiye, GATS antla\u015fmas\u0131 ile \u015fu kamu hizmet alanlar\u0131nda piyasaya a\u00e7ma taahh\u00fctlerinde bulunuldu; sa\u011fl\u0131k ve sosyal hizmetler (t\u00fcm hastane hizmetleri), e\u011fitim hizmetleri (ilk, orta ve di\u011fer \u00f6\u011fretim hizmetleri ile y\u00fcksek \u00f6\u011frenim hizmetleri); Mesleki hizmetler (uzmanl\u0131k gerektiren hizmetler, bilgisayar ve ilgili hizmetler, di\u011fer mesleki hizmetler); haberle\u015fme hizmetleri (posta hizmetleri, kurye hizmetleri, telekom\u00fcnikasyon hizmetleri; m\u00fcteahhitlik ve ilgili m\u00fchendislik-mimarl\u0131k hizmetleri; \u00e7evre hizmetleri (kanalizasyon hizmetleri, \u00e7\u00f6plerin kald\u0131r\u0131lmas\u0131 hizmetleri), mali hizmetler (sigortac\u0131l\u0131k ve sigortac\u0131l\u0131k ile ilgili hizmetler, bankac\u0131l\u0131k ve di\u011fer mali hizmetler); turizm ve seyahat ile ilgili hizmetler (oteller ve lokantalar, seyahat acenteleri ve tur operat\u00f6r\u00fc hizmetleri); ula\u015ft\u0131rma hizmetleri (deniz, hava, demiryolu ve kara ta\u015f\u0131mac\u0131l\u0131\u011f\u0131 hizmetleri).<\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">GATS anla\u015fmas\u0131 imzaland\u0131ktan sonra herhangi bir \u00fclke verdi\u011fi s\u00f6zden ka\u00e7acak ya da yat\u0131r\u0131mc\u0131lar\u0131n be\u011fenmedi\u011fi uygulamalara giri\u015fecek olursa, hizmet yat\u0131r\u0131mc\u0131lar\u0131na D\u00fcnya Ticaret \u00d6rg\u00fct\u00fc\u2019n\u00fcn Tahkim Kurulu\u2019na gitme hakk\u0131 tan\u0131nd\u0131. Bir d\u00f6nem t\u00fcm d\u00fcnya ve T\u00fcrkiye kamuoyunu me\u015fgul eden \u201culuslararas\u0131 tahkim\u201d uygulamas\u0131 ilk kez bu d\u00f6nemde g\u00fcndeme geldi. Anla\u015fmada, yat\u0131r\u0131mc\u0131lar\u0131n olas\u0131 k\u00e2r kay\u0131plar\u0131n\u0131n bile ev sahibi \u00fclke taraf\u0131ndan kar\u015f\u0131lanmas\u0131 karar alt\u0131na al\u0131narak, t\u00fcm ko\u015fullar b\u00fcy\u00fck \u00f6l\u00e7\u00fcde tekellerin istedi\u011fi \u015fartlarda belirlendi.\u00a0 <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">GATS\u2019\u0131n sermayenin ihtiya\u00e7lar\u0131 do\u011frultusunda d\u00fcnya \u00e7ap\u0131nda getirdi\u011fi kapsaml\u0131 kurallar ile anla\u015fma g\u00f6r\u00fc\u015fmeleri b\u00fcy\u00fck bir gizlilik i\u00e7inde s\u00fcrd\u00fcr\u00fcl\u00fcrken, bu bilgilerin d\u0131\u015far\u0131ya s\u0131zmas\u0131 sonucu d\u00fcnya \u00e7ap\u0131nda ve T\u00fcrkiye\u2019de sendikalar\u0131n \u00f6nc\u00fcl\u00fc\u011f\u00fcnde b\u00fcy\u00fck tepkiler olu\u015ftu. MAI anla\u015fmas\u0131 d\u00f6neminde g\u00f6sterilen yayg\u0131n ve kitlesel tepkiler nedeniyle \u00e7ok tarafl\u0131 yat\u0131r\u0131m anla\u015fmas\u0131 anlam\u0131na gelen MAI imzalanamazken, 1995\u2019te D\u00fcnya Ticaret \u00d6rg\u00fct\u00fc\u2019ne \u00fcye \u00fclkelerin imzalad\u0131\u011f\u0131 GATS, ilk \u00e7ok tarafl\u0131 yat\u0131r\u0131m anla\u015fmas\u0131 olarak imzalan\u0131p tarihe ge\u00e7ti.\u00a0\u00a0 <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Kamu hizmetlerinin, i\u00e7eri\u011fi ve niteliklerini bir kenara b\u0131rak\u0131larak b\u00fct\u00fcn\u00fcyle piyasa ili\u015fkileri i\u00e7ine itilmesi, ba\u015fka bir ifade ile kamu hizmetleri alan\u0131n\u0131n daralt\u0131lmas\u0131, g\u00fcn\u00fcm\u00fcz kapitalizminin \u00f6ncelikli hedefi olarak ortaya \u00e7\u0131k\u0131yor. Piyasaya terk edilmesi \u00f6ng\u00f6r\u00fclen alanlar\u0131n e\u011fitim, sa\u011fl\u0131k gibi toplumun t\u00fcm kesimlerini etkileyecek alanlar olmas\u0131 konunun \u00f6nemini daha da artt\u0131r\u0131yor. \u00c7\u00fcnk\u00fc piyasa i\u00e7in \u00f6nemli olan talebin y\u00fcksek olmas\u0131d\u0131r. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Kamu hizmetleri nitelikleri gere\u011fi, kendili\u011finden y\u00fcksek bir talep potansiyeli ve \u201cekonomik de\u011fer\u201d ta\u015f\u0131d\u0131\u011f\u0131ndan krizle bo\u011fu\u015fan sermaye a\u00e7\u0131s\u0131ndan bulunmaz bir nimet olarak kabul ediliyor. Y\u00fcksek talep ise ister istemez, \u015firketlerin, ulusal\/uluslararas\u0131 tekellerin i\u015ftah\u0131n\u0131 kabartan, onlar\u0131 kamu hizmetleri alanlar\u0131na y\u00f6nlendiren temel fakt\u00f6r olarak dikkat \u00e7ekiyor. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Kamu hizmetlerinin piyasa ili\u015fkileri i\u00e7ine \u00e7ekilerek ticarile\u015ftirilmesi ile bu hizmetlerin, hizmeti talep edenlere ekonomik g\u00fc\u00e7leri do\u011frultusunda sunulmas\u0131n\u0131 beraberinde getirecek. Ba\u015fka bir ifadeyle gelir d\u00fczeyi d\u00fc\u015f\u00fck olan yoksullar daha niteliksiz hizmet alacak ya da hi\u00e7 kamu hizmeti alamayacaklar. Gelir d\u00fczeyi iyi durumda olanlar ise, muhtemelen ekonomik olanaklar\u0131 ile paralel olarak daha nitelikli hizmet alacaklar. Piyasa ekonomisinde temel d\u00fc\u015f\u00fcnce daha fazla k\u00e2r elde etmektir. Daha fazla k\u00e2r elde etmenin temel ko\u015fulu rekabette \u00fcst\u00fcnl\u00fck sa\u011flamak, bunun i\u00e7in daha \u00e7ok \u201cm\u00fc\u015fteri\u201d yaratmakt\u0131r. Bunun sonucunda \u00f6zellikle GATS ile \u00f6zelle\u015ftirilmesi taahh\u00fct edilen alanlarda ya\u015fanan ticarile\u015ftirme uygulamalar\u0131, kamu hizmetleri i\u00e7in halk\u0131n cebinden daha fazla \u00f6deme yapmas\u0131n\u0131 beraberinde getirmi\u015ftir. Kamuya y\u00f6nelik kapsaml\u0131 sald\u0131r\u0131n\u0131n son aya\u011f\u0131 olan kamu personel sisteminin k\u00f6kten de\u011fi\u015ftirilmesi, bu nedenle sadece kamu emek\u00e7ilerini de\u011fil, kamu hizmetinden yararlanan milyonlarca yurtta\u015f\u0131 da do\u011frudan ilgilendirmektedir.\u00a0\u00a0 <\/span><\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Kamu personel rejiminde ya\u015fanan d\u00f6n\u00fc\u015f\u00fcm, ana hedefinde g\u00fcvencesizle\u015ftirme olan ve i\u015fg\u00fcc\u00fcn\u00fc koruyucu herhangi bir d\u00fczenlemenin olmad\u0131\u011f\u0131 yeni bir istihdam bi\u00e7imi olu\u015fturmay\u0131 ama\u00e7l\u0131yor. Olu\u015fturulmak istenen yeni personel sistemi ile kamu istihdam\u0131n\u0131n g\u00fcn\u00fcm\u00fcz kapitalizmine uyumlu bir i\u00e7erikte \u201cyeniden yap\u0131land\u0131r\u0131lmas\u0131\u201d ve kamu emek\u00e7ilerinin b\u00fcy\u00fck b\u00f6l\u00fcm\u00fcn\u00fcn herhangi bir yasal ya da anayasal g\u00fcvence olmaks\u0131z\u0131n daha \u201cesnek\u201d ve tamamen \u201cg\u00fcvencesiz\u201d istihdam edilmesi hedefleniyor. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Ba\u015fbakan dahil, AKP H\u00fck\u00fcmetinin \u00e7e\u015fitli kademelerdeki temsilcileri, siyasi iktidarla birlikte de\u011fi\u015fen bir y\u00f6netim yap\u0131s\u0131 olu\u015fturmak istedi\u011fini bir s\u00fcredir s\u00fcrekli vurguluyorlar. Hatta bu s\u00fcre\u00e7te h\u00fck\u00fcmetin yapmak istedi\u011fi de\u011fi\u015fikliklere b\u00fcrokrasinin ve idari yarg\u0131n\u0131n diren\u00e7 g\u00f6sterdi\u011fini iddia ediyorlar. Bug\u00fcne kadar yap\u0131lan ve \u00e7o\u011funlukla ba\u015fka yasal d\u00fczenlemeler ile birlikte hayata ge\u00e7irilen de\u011fi\u015fiklikler, kamu personel sisteminde esnekle\u015fme, kurals\u0131zla\u015ft\u0131rma ve g\u00fcvencesiz \u00e7al\u0131\u015fma uygulamalar\u0131n\u0131 yayg\u0131nla\u015ft\u0131rman\u0131n somut zeminini olu\u015fturdu. \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">13 \u015eubat 2011 tarihinde TBMM\u2019de kabul edilen 6111 say\u0131l\u0131 Torba Yasa ile \u00e7ok say\u0131da kanunla birlikte 657 Say\u0131l\u0131 DMK\u2019da da \u00f6nemli de\u011fi\u015fiklikler yap\u0131ld\u0131. Kamu emek\u00e7ilerinin i\u015f g\u00fcvencesinin nas\u0131l kald\u0131r\u0131laca\u011f\u0131n\u0131n tart\u0131\u015f\u0131ld\u0131\u011f\u0131 bug\u00fcnlerde, 6111 say\u0131l\u0131 kanunda yap\u0131lan ve t\u00fcm kamu emek\u00e7ilerini yak\u0131ndan ilgilendiren yasal de\u011fi\u015fiklikleri bir kez daha hat\u0131rlamak ya da hat\u0131rlatmak gerekiyor. F\u0131kra): <\/span><em>\u201cMemurlar\u0131n y\u00fcr\u00fctt\u00fckleri hizmetin \u00f6zelliklerine g\u00f6re, bu madde uyar\u0131nca tespit edilen \u00e7al\u0131\u015fma saat ve s\u00fcreleri ile g\u00f6rev yerlerine ba\u011fl\u0131 olmaks\u0131z\u0131n \u00e7al\u0131\u015fabilmelerim\u00fcmk\u00fcnd\u00fcr. Her f\u0131rsatta haktan ve \u00f6zg\u00fcrl\u00fckten bahsedenlerin, emek\u00e7ilerin en \u00f6nemli cayd\u0131r\u0131c\u0131 g\u00fcc\u00fc olan grev ve grev benzeri (i\u015f yava\u015flatma ve i\u015fi durdurma vb) eylemlerini memuriyetten \u00e7\u0131kar\u0131lma ile cezaland\u0131rmak istemesi, yanda\u015f olmayan sendikalara y\u00f6nelik bir g\u00f6zda\u011f\u0131 olarak de\u011ferlendirilebilir. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Kamu emek\u00e7ilerinin son y\u0131llarda geni\u015f bir kat\u0131l\u0131mla ger\u00e7ekle\u015ftirdi\u011fi 25 Kas\u0131m uyar\u0131 grevi ve ge\u00e7ti\u011fimiz y\u0131l yap\u0131lan 23 May\u0131s grevi \u00fczerinden bu madde dayanak g\u00f6sterilerek, greve kat\u0131lan kamu emek\u00e7ilerinin b\u0131rakal\u0131m \u201cmemuriyetten \u00e7\u0131kar\u0131lmay\u0131\u201d, haklar\u0131nda soru\u015fturma bile a\u00e7\u0131lmam\u0131\u015f olmas\u0131n\u0131 bu maddenin fiilen ge\u00e7ersiz olmas\u0131 olarak de\u011ferlendirmek m\u00fcmk\u00fcnd\u00fcr. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">AKP h\u00fck\u00fcmetinin kendisine yak\u0131n, m\u00fczakereci sendikalar\u0131 g\u00fc\u00e7lendirmek, m\u00fccadeleci sendikalar\u0131 etkisiz hale getirmek i\u00e7in en temel sendikal eylemleri bile \u201cmemuriyetten \u00e7\u0131kar\u0131lma\u201d sebebi saymas\u0131, kamu emek\u00e7ilerine y\u00f6nelik i\u00e7i bo\u015f bir tehdit olmaktan ileri gitmemektedir. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\"><strong><em><span style=\"color: black;\">\u00d6d\u00fcn\u00e7 memurluk!<\/span><\/em><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\">\u00a0<\/span><\/p>\n<p style=\"text-indent: 14.7pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">657 Say\u0131l\u0131 DMK EK Madde 8 (2. F\u0131kra): \u201c(\u2026) <em>memurlar, kamu yarar\u0131 ve hizmet gerekleri sebebiyle ihtiya\u00e7 duyulmas\u0131 h\u00e2linde kurumlar\u0131nca, Devlet Personel Ba\u015fkanl\u0131\u011f\u0131n\u0131n uygun g\u00f6r\u00fc\u015f\u00fc al\u0131narak di\u011fer kamu kurum ve kurulu\u015flar\u0131nda alt\u0131 aya kadar ge\u00e7ici s\u00fcreli olarak g\u00f6revlendirilebilir<\/em>.\u201d<\/span><\/p>\n<p style=\"text-indent: 14.7pt; text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 12pt;\"><span style=\"color: black;\">Bu madde 657 say\u0131l\u0131 DMK\u2019da yap\u0131lan en dikkat \u00e7ekici de\u011fi\u015fikliklerden birisidir. S\u00f6z konusu madde, 4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun <\/span>7 nci maddesi ile d\u00fczenlenen <span style=\"color: black;\">\u201c\u00f6d\u00fcn\u00e7 i\u015f\u00e7ilik\u201d uygulamas\u0131 ile <\/span>b\u00fcy\u00fck benzerlik ta\u015f\u0131maktad\u0131r. \u0130\u015f Kanununa g\u00f6re i\u015fveren, yaz\u0131l\u0131 r\u0131zas\u0131n\u0131 almak \u00fczere bir i\u015f\u00e7iyi; ayn\u0131 \u015firketler toplulu\u011funa ba\u011fl\u0131 ba\u015fka bir i\u015fyerinde veya yapmakta oldu\u011fu i\u015fe benzer i\u015flerde \u00e7al\u0131\u015ft\u0131rabilir. Bu durumda mevcut i\u015f s\u00f6zle\u015fmesi devam etmekle beraber, i\u015f\u00e7i bu s\u00f6zle\u015fmeye g\u00f6re \u00fcstlendi\u011fi i\u015fin g\u00f6r\u00fclmesini, ge\u00e7ici i\u015f ili\u015fkisi kurulan i\u015fverene kar\u015f\u0131 yerine getirmekle y\u00fck\u00fcml\u00fcd\u00fcr. Ge\u00e7ici i\u015f ili\u015fkisi, t\u0131pk\u0131 ilgili maddede belirtildi\u011fi gibi, alt\u0131 ay\u0131 ge\u00e7emez ve yaz\u0131l\u0131 olarak yap\u0131l\u0131r, gerekti\u011finde en fazla iki defa yenilenebilir. Kamu personel rejimindeki t\u00fcm de\u011fi\u015fikliklerin \u00f6zel sekt\u00f6rdeki \u00e7al\u0131\u015fma ili\u015fkilerine benzer bir i\u00e7erikte d\u00fczenlenmek istendi\u011fi a\u00e7\u0131k\u00e7a g\u00f6r\u00fclmektedir. <\/span><\/p>\n<p style=\"text-indent: 14.7pt; text-align: justify;\"><span style=\"font-size: 12pt; color: black; font-family: 'trebuchet ms', geneva;\">Bu d\u00fczenlemenin nelere yol a\u00e7aca\u011f\u0131na daha somut bir \u00f6rnek vermek gerekirse; 2010 y\u0131l\u0131nda Kayseri\u2019nin Sar\u0131z il\u00e7esi kaymakam\u0131, cezaevinde kad\u0131n gardiyan olmad\u0131\u011f\u0131 i\u00e7in \u0130l\u00e7e Milli E\u011fitim M\u00fcd\u00fcrl\u00fc\u011f\u00fcnden kad\u0131n \u00f6\u011fretmenlerin cezaevinde kad\u0131n mahkumlar\u0131n \u00fczerini aramas\u0131 i\u00e7in g\u00f6revlendirilmesini istemi\u015ftir. O zaman bu uygulama yasal de\u011filken, 6111 Say\u0131l\u0131 Torba Yasa ile getirilen yukar\u0131daki d\u00fczenleme sonras\u0131nda art\u0131k kimse \u201cben \u00f6\u011fretmenim, doktorum, b\u00fcro emek\u00e7isiyim benim kazan\u0131lm\u0131\u015f haklar\u0131m var\u201d diyemeyecektir. Bu madde ile \u201cistenmeyen\u201d personelin ba\u015fka kurum ve illere g\u00f6nderilmesinin \u00f6n\u00fcn\u00fc a\u00e7\u0131lm\u0131\u015ft\u0131r. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">6111 Say\u0131l\u0131 Torba Kanun ile yap\u0131lan de\u011fi\u015fiklikler, \u00f6n\u00fcm\u00fczdeki d\u00f6nemde i\u015f g\u00fcvencesinin kald\u0131r\u0131lmas\u0131 odakl\u0131 giri\u015fimlerin ilk ad\u0131mlar\u0131 olmu\u015ftur. \u00d6n\u00fcm\u00fczdeki d\u00f6nemde kamu personel rejiminde yap\u0131lmak istenen di\u011fer de\u011fi\u015fikliklerle birlikte de\u011ferlendirildi\u011finde, t\u00fcm kamu emek\u00e7ilere, t\u0131pk\u0131 i\u015f\u00e7ilerde oldu\u011fu gibi kurals\u0131z, ge\u00e7ici, g\u00fcvencesiz ve k\u00f6lele\u015ftirici \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n dayat\u0131lmak istendi\u011fi a\u00e7\u0131kt\u0131r. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\"><strong style=\"font-family: arial, helvetica, sans-serif; line-height: 1.3em;\">Ne yap\u0131lmal\u0131?<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">\u00a0\u00d6n\u00fcm\u00fczdeki d\u00f6nemde kamu emek\u00e7ilerinin b\u00fcy\u00fck b\u00f6l\u00fcm\u00fcn\u00fcn \u201cs\u00f6zle\u015fmeli\u201d ve i\u015f g\u00fcvencesinden yoksun olarak istihdam edilmeleri, ka\u00e7\u0131n\u0131lmaz olarak iktidar\u0131n d\u00fcnya g\u00f6r\u00fc\u015f\u00fc do\u011frultusunda hareket eden, onun verdi\u011fi y\u00fczdelik zamlara \u201c\u015f\u00fckreden\u201d, iktidar yanda\u015f\u0131 \u201cmakbul\u201d sendikaya \u00fcye olmaya zorlanan, her biri tornadan \u00e7\u0131km\u0131\u015f gibi hareket eden \u201cmakul memur\u201d tipini g\u00fcndeme getirecek. \u00a0<\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Yeni personel rejiminde s\u00f6zle\u015fmeli personelin i\u015f ya\u015fam\u0131ndaki gelece\u011fi, siyasi iktidarlar\u0131n atayacaklar\u0131 \u201cparti memuru\u201d y\u00f6neticilerin iki duda\u011f\u0131 aras\u0131nda olacak. Kamu kurum ve kurulu\u015flar\u0131nda s\u00f6zle\u015fmeli istihdam\u0131n \u00f6zellikle hastaneler, okullar ve di\u011fer pek \u00e7ok kamu kurumunda uygulanmaya ba\u015flamas\u0131 geri d\u00f6n\u00fc\u015f\u00fc zor sorunlar\u0131 beraberinde getirecek. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Kamuda istihdam\u0131n b\u00fcy\u00fck \u00f6l\u00e7\u00fcde \u201cbelirli s\u00fcreli s\u00f6zle\u015fmeli\u201d \u00e7al\u0131\u015fanlardan olu\u015fturulmak istenmesi, bilinen anlam\u0131yla devlet memurlu\u011fu g\u00fcvencesinin \u00e7ok k\u00fc\u00e7\u00fck bir kesim i\u00e7in (asker, polis, savc\u0131, hakim vb) ge\u00e7erli olaca\u011f\u0131n\u0131n ispat\u0131d\u0131r. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu 1965 y\u0131l\u0131nda \u00e7\u0131kar\u0131lm\u0131\u015f ve aradan ge\u00e7en s\u00fcrede, ilgili d\u00f6nemin ihtiya\u00e7lar\u0131na g\u00f6re de\u011fi\u015ftirilmi\u015ftir. Genel olarak bak\u0131ld\u0131\u011f\u0131nda 657 Say\u0131l\u0131 DMK\u2019n\u0131n savunulacak bir yan\u0131n\u0131 bulmak m\u00fcmk\u00fcn de\u011fildir. Bu nedenle kamu emek\u00e7ilerinin i\u015f g\u00fcvencesini savunurken, 657 say\u0131l\u0131 DMK\u2019y\u0131 savunur konuma d\u00fc\u015fmesi yap\u0131lacak en b\u00fcy\u00fck hata olacakt\u0131r. Bu noktada savunulmas\u0131 gereken, devletin yurtta\u015flar\u0131na istihdam sa\u011flama g\u00f6revi oldu\u011fundan hareketle, kamu-\u00f6zel ayr\u0131m\u0131 yapmaks\u0131z\u0131n her yerde istihdam\u0131n g\u00fcvenceli olmas\u0131 ve ta\u015feron \u00e7al\u0131\u015fman\u0131n\/\u00e7al\u0131\u015ft\u0131rman\u0131n yasaklanmas\u0131 olmal\u0131d\u0131r.\u00a0 <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">\u00d6n\u00fcm\u00fczdeki d\u00f6nemde hayata ge\u00e7irilmek istenen esneklik ve g\u00fcvencesizlik temelinde olu\u015fturulacak yeni personel sistemiyle yap\u0131lmak istenenleri sadece \u201cmemurlar\u0131\u201d ilgilendiren basit bir \u201cyasa de\u011fi\u015fikli\u011fi\u201d olarak g\u00f6rmemek gerekir. Kamu emek\u00e7ilerinin son kalesi olarak ifade edebilece\u011fimiz i\u015f g\u00fcvencesinin gasp edilme s\u00fcrecini, sadece kamu hizmetleri sunanlar a\u00e7\u0131s\u0131ndan de\u011fil, bu hizmetlerden yararlananlar a\u00e7\u0131s\u0131ndan da de\u011ferlendirmek ve ortak bir tepki \u00f6rg\u00fctlemek bug\u00fcn her zamankinden daha \u00f6nemli hale gelmi\u015f durumdad\u0131r. <\/span><\/p>\n<p style=\"text-indent: 18pt; text-align: justify;\"><span style=\"font-size: 12pt; font-family: 'trebuchet ms', geneva;\">Bu a\u015famada yap\u0131lmas\u0131 gereken, ge\u00e7mi\u015f y\u0131llarda oldu\u011fu gibi sadece mevcut \u201cmemur stat\u00fcs\u00fcn\u00fcn\u201d savunulmas\u0131 de\u011fil, her t\u00fcrden kurals\u0131z ve g\u00fcvencesiz \u00e7al\u0131\u015fma bi\u00e7imlerine kar\u015f\u0131 i\u015f\u00e7i, memur, s\u00f6zle\u015fmeli, ta\u015feron, \u00fccretli ayr\u0131m\u0131 yapmadan topyekun bir m\u00fccadelenin \u00f6rg\u00fctlenmesidir.
