Bu de\u011fi\u015fim 1980\u2019lerden itibaren a\u00e7\u0131k bir ekonomiye ge\u00e7en, uluslar aras\u0131 toplumun bir par\u00e7as\u0131 haline gelen T\u00fcrkiye i\u00e7in bir zorunluluktur.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">Kamu Personel Y\u00f6netimi anlay\u0131\u015f\u0131ndaki de\u011fi\u015fmenin y\u00f6n\u00fc konusunda ekonomik krizlerin etkisi oldu\u011fu a\u00e7\u0131kt\u0131r. Ekonomik kriz d\u00f6nemlerinde kamu y\u00f6netimi ile siyaset kurumu ili\u015fkisi daha zay\u0131f, teknik y\u00f6n\u00fc daha a\u011f\u0131r basan bir niteliktedir. Bu d\u00f6nemlerde kamuda verimlili\u011fi sa\u011flayacak d\u00fczenleme ve politikalar daha \u00f6nceliklidir. Ekonomik krizlerin atlat\u0131ld\u0131\u011f\u0131, refah sa\u011fland\u0131\u011f\u0131 d\u00f6nemlerde ise siyaset kurumu, kamu y\u00f6netimini kontrol etmeye y\u00f6nelmektedir.<\/span>\u00a0<\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><strong><em><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">K\u0131sacas\u0131 her Kamu y\u00f6netimi kendisiyle uyumlu bir kamu personel rejimi-sistemi yaratmak ister. T\u00fcrkiye\u2019de ya\u015fanan da d\u00fcnya da k\u00fcresel \u00f6l\u00e7ekte ya\u015fanan bu de\u011fi\u015fim\/d\u00f6n\u00fc\u015f\u00fcmden kopuk de\u011fildir.<\/span><\/em><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">T\u00fcrkiye\u2019de hantal b\u00fcrokrasi anlay\u0131\u015f\u0131 nedeniyle devlet kap\u0131s\u0131 ge\u00e7mi\u015fte adeta \u201c\u00e7ile kap\u0131s\u0131na\u201d d\u00f6n\u00fc\u015fm\u00fc\u015ft\u00fcr.\u00a0 Ancak bu konuda son 10 y\u0131lda ge\u00e7mi\u015fe k\u0131yasla \u00e7ok b\u00fcy\u00fck mesafe al\u0131nm\u0131\u015ft\u0131r. Sosyal G\u00fcvenlik reformundan ceza kanunlar\u0131na, bankac\u0131l\u0131k kanunlar\u0131na, bor\u00e7lar kanunlar\u0131na, yerel y\u00f6netimlere ili\u015fkin yasalara kadar her alanda T\u00fcrkiye&#8217;nin mevzuat haf\u0131zas\u0131 g\u00fcncellenmi\u015ftir. Ayr\u0131ca b\u00fcrokrasiyi azaltan, devletin vatanda\u015fa, vatanda\u015f\u0131n devlete, do\u011frudan temas\u0131n\u0131 sa\u011flayan e-devlet, e-re\u00e7ete gibi pek \u00e7ok uygulama hayata ge\u00e7irilmi\u015ftir.<\/span>\u00a0<\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><strong><em><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">Ancak b\u00fct\u00fcn reformlara ra\u011fmen istenen seviyeye gelinmemi\u015ftir, eksiklikler s\u00fcrmektedir. Bunun a\u015f\u0131lmas\u0131 i\u00e7in h\u00fck\u00fcmetin \u00f6n\u00fcnde \u00e7ok \u00f6nemli bir e\u015fik -viraj kalm\u0131\u015ft\u0131r.<\/span><\/em><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><strong><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">A\u015f\u0131lmas\u0131 Gereken E\u015fik<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">Her kamu idaresi kendisiyle uyumlu bir personel sitemine ihtiya\u00e7 duymaktad\u0131r.\u00a0 Her alanda ciddi de\u011fi\u015fim ve d\u00f6n\u00fc\u015f\u00fcmlerin ya\u015fand\u0131\u011f\u0131 bu s\u00fcre\u00e7te T\u00fcrkiye\u2019deki mevcut kamu personel sistemi g\u00fcn\u00fcn ko\u015fullar\u0131na ve ihtiya\u00e7lara cevap vermekten uzakt\u0131r. Bunun i\u00e7in yenilenmesi gerekmektedir.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><span style=\"color: #800000;\"><strong><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">B- Hedeflenen Kamu Personel Sisteminin Temel Nitelikleri<\/span><\/strong><\/span>\u00a0<\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">Bu konudaki en net vurgu \u00e7al\u0131\u015ftay\u0131n a\u00e7\u0131l\u0131\u015f konu\u015fmas\u0131n\u0131 yapan \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakan\u0131 Faruk \u00c7elik taraf\u0131ndan yap\u0131lm\u0131\u015ft\u0131r. T\u00fcrkiye kamu personel sisteminde bug\u00fcne kadar yap\u0131lan de\u011fi\u015fiklikler bu konudaki eksi\u011fi kapatamam\u0131\u015ft\u0131r. Ba\u015fta 657 Say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu olmak \u00fczere mevzuat\u0131m\u0131zdaki d\u00fczenlemeler karma\u015f\u0131kt\u0131r. Karma\u015f\u0131k ve mu\u011fl\u00e2k oldu\u011fu kadar biri biriyle \u00e7eli\u015fen d\u00fczenlemelere de rastlamak m\u00fcmk\u00fcnd\u00fcr. <\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">1965\u2019ten kalma 657 Say\u0131l\u0131 DMK her yan\u0131ndan su almakta, art\u0131k yama tutmamaktad\u0131r. \u201c\u00dcstelik her kurum b\u00fcnyesinde \u201c657\u2019cikler t\u00fcremi\u015ftir\u201d. Mevzuat\u0131n yeni kamu y\u00f6netimi ve buna ba\u011fl\u0131 olarak yeni personel sistemi ile uyumlu hale getirilmesi zorunluluktur.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><strong><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">2-<span style=\"font-weight: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">Kamu hizmeti tan\u0131m\u0131 netle\u015ftirilmeli<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">Kamu hizmeti tan\u0131m\u0131 anayasam\u0131zda ve yasalar\u0131m\u0131zda \u00e7ok mu\u011fl\u00e2k ifadelerle tan\u0131mlanm\u0131\u015ft\u0131r. Neyin kamu hizmeti olup olmad\u0131\u011f\u0131 netle\u015ftirilmelidir. Hangi hizmetlerin devletin asli ve s\u00fcrekli g\u00f6revleri oldu\u011fu netle\u015ftirilmelidir. Hangi hizmetlerin devlet eliyle, hangilerinin \u00f6zel sekt\u00f6r eliyle veya hizmet sat\u0131n al\u0131m yoluyla yap\u0131laca\u011f\u0131 belirgin hale getirilmelidir. Kamu hizmetinin devlet ya da \u00f6zel kesim taraf\u0131ndan yerine getirilmesi onun \u201ckamu hizmeti olma niteli\u011fini\u201d de\u011fi\u015ftirmez.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><strong><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">3-<span style=\"font-weight: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">Kamu \u00e7al\u0131\u015fan\u0131-g\u00f6revlisi tan\u0131m\u0131 netle\u015ftirilmeli:<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">Kamu hizmetinin yeniden tan\u0131mlanmas\u0131 ile kimin memur oldu\u011fu, kimin olmad\u0131\u011f\u0131 da netle\u015fecektir. Devletin asli ve s\u00fcrekli i\u015flerini y\u00fcr\u00fctenler memur, di\u011ferleri kamu \u00e7al\u0131\u015fan\u0131- kamu g\u00f6revlisi olarak nitelendirilmelidir. T\u00fcm kamu personelinin hak ve sorumluluklar\u0131n\u0131n s\u0131n\u0131rlar\u0131 net olarak belirlenmelidir.<\/span>\u00a0<\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">T\u00fcrkiye\u2019de \u00e7ayc\u0131, temizlik\u00e7i olarak istihdam edilenler bile devlet memuru say\u0131lamaktad\u0131r.\u00a0 Bunlar\u0131n var olan haklar\u0131na elbette ki dokunulmas\u0131ndan yana de\u011filiz. Ancak d\u00fcnyan\u0131n hi\u00e7bir yerinde bu tip bir uygulama bulunmamaktad\u0131r.<\/span>\u00a0<\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><strong><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">4-<span style=\"font-weight: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">Kamu da i\u015f g\u00fcvencesi verimlilikle birlikte ele al\u0131nmal\u0131:<\/span><\/strong>\u00a0<\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">Bu konu konfederasyon ba\u015fkanlar\u0131n\u0131n a\u00e7\u0131l\u0131\u015f konu\u015fmalar\u0131nda kamu emek\u00e7ileri a\u00e7\u0131s\u0131ndan i\u015f g\u00fcvencesinin vazge\u00e7ilemez, temel bir hak oldu\u011fu, i\u015f g\u00fcvencesini tehlikeye sokacak her t\u00fcrl\u00fc giri\u015fim kar\u015f\u0131nda olacaklar\u0131 y\u00f6n\u00fcndeki s\u00f6zleri \u00fczerine yine \u00c7al\u0131\u015fma Bakan\u0131 taraf\u0131ndan g\u00fcndeme getirilmi\u015ftir. \u00c7al\u0131\u015fma bakan\u0131n b\u00fcrokratik yap\u0131dan \u015fik\u00e2yet eden, verimlili\u011fi temel alan bir i\u015f g\u00fcvencesinin alt\u0131n\u0131 \u00e7izen a\u00e7\u0131klamalar\u0131na kamu idaresi y\u00f6neticileri de destek sunmu\u015ftur.<\/span><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; line-height: normal;\"><strong><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">5-<span style=\"font-weight: normal; font-size: 7pt; font-family: 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">Performans De\u011ferlendirme Sistemi Yayg\u0131nla\u015ft\u0131r\u0131lmal\u0131: <\/span><\/strong><span style=\"font-size: 12pt; font-family: 'Times New Roman', serif;\">Bu konuda daha \u00e7ok devletin asli ve s\u00fcrekli hizmetlerin performans de\u011ferlendirme s\u00fcre\u00e7lerinin d\u0131\u015f\u0131nda b\u0131rakan anlay\u0131\u015f a\u011f\u0131rl\u0131k kazanm\u0131\u015ft\u0131r.
